I'm amazed that you received your offer that quick, my claim started in October, im still waiting for a hearing date and have so far received 2 offers of settlement the second one was 2/3 of the full claim and I have refused it again. This is dragging on and on. Lucky you for not having to go the whole way.

I had my letter from the court a week ago giving them 3 days and the day I thought I was going to file judgement against them I had a letter from DG and they had sent in their AQ, they did it at the last moment, I noticed on their AQ they have asked the judge for an extra month. Tuesday of this week I received my second offer from them but it was still only 2/3 of what i'm claiming so I refused it and also sent in another list of my charges with the interest calculated up to that day. I have a feeling that is going to be May before I see any money and I can't believe I started this one in October, it's doing my head in now.

My account used to be a joint account too, my husband left in 2001 but I didn't bother closing the account til 2003, I have done the claim under my name only and when I first put in my claim they were addressing the letters to the 2 of us. As the account is now closed and we are divorced when i'm made an offer I will ask them to put it into the account I now have open with them. As far as i'm concerned he left me with an overdraft without a second thought and I ended up paying it back so I think this money is rightfully mine, I just havent explained to HSBC during my claim that we are divorced, I am now waiting for a hearing date and hope that I won't have a problem when I do get the refund.
  4. I seem to be a few days ahead of you, it's getting frustrating. My AQ had to be in by the 18th and HSBC did not return theirs, on the 19th the judge gave them a further 3 days and if they fail to file it I am then at liberty to enter judgement when i phoned the court this morning they said it was 3 working days from the day I received it so it will be Monday before I can enter judgement. I am hoping and praying now that an offer does not come in the post before Monday, somehow though I think it will, looking at some of the threads it seems that those who have had offers have been told the money will be in their account within 7 days and some are still there a month later waiting for it and they don't seem to be getting any response from HSBC, I am hoping that if I enter judgement and they have to pay immediately, I will actually get the money. I started this claim last October and will be so glad when it is sorted.

I think we are at the same stage with HSBC, the date for our AQ to be in was the 18th and ive had a letter from the court this morning to say they have given them a 3 day extention dated the 19th and if they do not respond by this date I am at liberty to enter judgement. They seem to be treating everyone differently and i'm not jumping for joy yet because it seems that even when they say they are going to pay it, people don't seem to be receiving it.
  6. Hsbc have until the 4th Feb to respond to my MCOL, I guess that as that is a sunday they actually have to respond by the 4th(next friday). Just had my first ever letter from them offering me around 55% of what I am claiming, obviously I will ignore it but if I do what happens when it comes to the 4th feb and the deadline is up, any idea anyone?

  8. I did phone and strangely nobody knew what it was, I sent her off 3 times to find out and in the end she said that she would find out and call back,as expected I had no call.
  9. I hope someone can help me before MBNA call back On my statements I have noticed they have charged 3 different types of interest Retail interest Cash advance interest ???????? Special cash interest, ive noticed they only started adding this when the account went into arrears.I recognise the cash advance and retail interest as the norm on credit cards but not the special cash interest.

Have you any idea if claiming back interest is different with store cards than it is for bank accounts.I have noticed that you all seem to be adding on interest when you write the prelimery letter, with banks you add it on when you get to the mcol stage and that is a rate of 8%. Also what do we do about the missing statements from GE Money, do we ignore it or write again demanding them?. I couldn't believe it today when I received mine with a statement missing and little pieces of cut out paper, hardly proffesional is it.

Yes they can pay it to Cabot,I am going through the same thing at the moment and the money I received from Nationwide was automatically taken off the debt I owed them too.Although it would have been nice to make a bit of money out of it i'm just as pleased to see my debts go down more with each claim I make.

I have read many threads from people on here who have been very succesful when phoning MBNA,is it just me or have they decided to make things more difficult?.This is what has happened to date. 22nd October sent off SAR with the £10 cheque. I received a letter back saying sorry about your complaint, we will get back to you before 4th December. Yesterday I received a letter with the normal excuses and also to say they have credited my account with £325 as a goodwill gesture.There was a number on the letter to call to speak to a Gavin Theobald, I tried him several times and he was always out of the office and was told he would call back, asked for a few other names but there was apparantly nobody in the office. Today he was there and in another call and was told he would call back, I put on my sternest voice and said, ive heard that several times but its just not happening so this time I did get a call back but it was a waste of time. I tried everything, asked why the 40 days were up and they had ignored the SAR and his reply was that we don't charge for it because all you really want are the statements, I told him that they hadnt bothered to send them either and he apologised and said he would get them to me in a week or so, I asked if he could give me a figure over the phone as he must have some idea but he wouldn't tell me, I reminded him the 40 days were now up and that I would be sending out the LBA but he didn't seem bothered at all, I tried everything to provoke him but he wouldn't budge. I have now sent a letter telling them that as they had not sent the information I had requested I would have to estimate the charges myself, ive done this and as I have no idea of the correct amount I have put 1,200 + 200 interest and i'm hoping that this will shock them into working out a figure. I am guessing the real figure is more in the region of 800.00. Why was it that difficult for me, am I too much of a softie????????
  14. I sent off to HSBC for my statements on monday after succesfully receiving a full settlement from Nationwide. The only problem this time is that my HSBC account has been closed for 3 years but i'm going to give it a go anyway, has anyone else managed to claim on an account that has closed? I would be interested to know as I actually had that account for around 15 years so it could be quite interesting to see how much I could claim back.
  15. Hi I have succesfully claimed back 1697 from Nationwide plus 315 interest which they say they have calculated correctly, my claim went back 6 years and I calculated it to be 500 more. My account was untouched for a year as they had put a block on it but before it was closed they added so much interest to it that my 950 overdraft shot up to 1697, when they put my settlement into my account they took back the 1697 overdraft which left me with just the 315, this has confused me slightly now as I can't get my head around the figures anymore( a bit of a mental block)so do I now just carry on and try for the other 500 or if i had calculated it incorrectly in the first place do I not risk it and be grateful my debt has been wiped. Help i'm totally confused and time is running out to reply to the court letter.
