Well, well, well... following my last post of July 11 in which I received an email saying I had 14 days before my account was to be vetted for legal action, I received another email from them this week exactly the same... saying that I had 14 days etc. Looks like this could be some merry-go-round if this continues every couple of weeks!
  2. This issue continues, I'm afraid... I am trying to communicate with MMF via email, using the email address on their two letters they have sent me in all this time qq(@) mmile.com . I have not received one response via email, and even asked them to at least acknowledge the email address is live, but nothing. They have continued to text me and leave messages on my voicemail, and I even replied once telling them this is my one and only text to them, that I 'don't do texts' (I don't - I'm not just saying that for their benefit) and have insisted on correspondence in writing whether that be by post or email. They are totally ignoring my requests and continuing down the text route of 'our home visit dept wants to make an appointment with you'. What part of 'no home visits' don't they understand? They have received the no home visits letter from me at least 3 times via post and a couple of times via email (if the address works). I have been back on to TS again and my contact said she would email them (she has an email address that works for them because they have 'jumped' when contacted by TS on my behalf previously) and ask that they communicate in writing/email, but she did say that it is not law for them to comply. Unfortunately the texts have continued this week. They are threatening the home visits once more (and I believe them because they have turned up uninvited before). I now have a very delicate situation at home - my house mate's father is seriously ill in hospital and the prognosis is not good at all, which I have explained to TSin the hope that they can get through to these clowns that their actions are extremely insensitive at the moment. I told TS that I am not averse to dialogue with MMF, but that it must be writing/email only, but it appears I am still banging my head against the wall over this. I've read on other threads that some people have been having email correspondence with MMF. Does anyone have an email address that is known to be 'live' for them?
  3. I am now possession of something that resembles the CCA I'd originally requested. MMF corresponded with me and sent me a copy of the letter that was supposedly sent on May 25th (but without the CCA). Interestingly enough the final sentence of the copy said "Collections activity has been placed on tempory hold, pending your reply and we look forward to hearing from you". Funny how they stepped up their harassment from the 27th - some 'temporary hold'! Although I do strongly suspect that this letter has been cobbled together in light of my informing Consumer Direct and TS of the harassment and they have made it look like reasonable attempts to recover the debt following a CCA being sent out - yeah right! The actual CCA didn't come direct from MMF but in a copy from TS that MMF had forwarded to TS. It's 23 pages long! It was my intention to post it here, but it's going to take forever to scan and upload. I've checked through to see if there are any anomalies I can use to question whether or not it's enforceable. Is there anything I should be looking for? TS have told me that once the company isues the CCA it becomes enforceable again. I have read somewhere on this forum (it may even have been in this thread) that most of these CCAs from payday loan companies are unenforceable anyway. This being the case, on what grounds may they be unenforceable? In the meantime I have received a text from MMF late Friday afternoon saying "We have not heard from you since our letter confirming the details of the Quick Quid debt. If the matter is fraud please advise" and this morning "Please call MMF on (different phone number to usual). We must discuss a serious matter with you urgently or visit www.paymile.com for an online discount. Access code (their ref no.)" Looks like the harassment is starting all over again. Don't they ever learn? I would appreciate some advice as I need to know how to pursue this. Many thanks.

  5. Have spent several mornings this week on the phone to Trading Standards. MMF have continued to phone and text since my last post, even saying in one text that they will be turning up at my home unannounced within the next 4 days! TS have managed to put a halt to MMF harassment for the time being, so it looks like I won't be getting that unannounced visit! It would appear that MMF are perfectly capable of responding to TS when TS say 'jump'! The long and the short of it is that TS are now in possession of a letter that was apparently sent to me on May 25th with the CCA agreement etc., which I have not received. (It wouldn't surprise me if MMF have contrived their evidence to make it look as though I was deliberately not responding to them, hence their harassment being passed off as reasonable attempts to collect the debt). Seeing is believing though, and TS have said they're going to forward it to me. I'll post when I have it to see where I should go from here.
  6. Just logged in to my emails to find your update to the thread jimbo73 and 2 identical emails from carter forbes saying the same as they've written to you. This follows on from the texts I have also been receiving since the last email. Should be very interesting indeed... Why oh why (starting to sound like Points of View now) can't they just send a letter and do things properly?

  8. Text received today from them. "LOSINGMYMIND You have an outstanding debt with Uncle Buck of £2944.66 call 0850268038 today before your account is vetted for legal action." Still nothing in writing through the post. Two years on I might not even be using the email address or phone I used then. Should I still ignore?
  9. Now they're resorting to leaving messages on my voicemail. Reported the whole sorry tale to Consumer Direct today. They said they would let Trading Standards know. I was told that it would be possible for this to go through the small claims court, but that they would have to prove the debt to be mine, and as I had requested the CCA which they've ignored, MMF aren't doing too well at proving anything other being an irritation right now.

  12. Just logged on to my emails and have an identical email to jimbo. Thing is they're saying 2 weeks and I only received the first email 6 days ago. Would seem they even overinflate time! Would also seem that they're very unapproachable if bilkobaggins experience is anything to go by. So, where from here? If CF aren't playing ball as per the OFT etc. etc. then it would seem we need to know how to fight fire with fire. I'm pretty new to this, and so want to be able to respond with the correct letter/template to get the legal ball rolling. Which letter should go first, given that I need to know a breakdown of where they've plucked their figure from? Thanks in advance ...!

  14. LK85, do you remember dating the cheques when you took out the loan? I can't remember if I had to leave the date blank for them to complete at time of banking. If you dated the cheques for last July, then they're out of their guarantee time already (a cheque is only guaranteed with a guarantee card for up to 30 days after dating the cheque), and even if they asked you to leave the date blank I'd still be careful, because there's nothing stopping them putting dates on the cheques for earlier this month (to keep the guarantee intact). I don't know for sure, but I suspect that although the cheque guarantee thingy ends this month, any cheques written and guaranteed in June will still have their 30 days grace for presentation to the bank during July. If you can find the cheque book you wrote the cheques from just call your bank and put a stop on the whole book. Say you had some cheques still in the book which you didn't use and now you can't find it. Say you've lost your card as well - we need to cover all bases here, just in case they try to raid your account for the money. When UB present the cheques for banking they'll be stopped by the bank and you shouldn't land any bouncing fees. I did this with natwest and cheques for the money shop and I wasn't charged and the cheques didn't go though - my cheques weren't guaranteed though, so I don't know if that made a difference. Technically banks cannot stop guaranteed cheques and are supposed to let them go through, but I don't know how this works if you've reported the card and book missing. Occasionally they will bounce them, but it can be hit and miss. I think it depends on your standing with your bank. If you can get past the end of June + 1 month I think you should be home and dry if you want to leave defaulting until then, or query anonymously the option of reporting cheque book and card missing and the consequences of cheques being presented for paying before going ahead and doing so (hope this last bit makes sense).
  15. So there's a few of us all in a similar situation... just wondering what the best way forward is? Been checking through the carterforbes website ad it would seem that they take a zero tolerance towards debt, and will take you to court within 21 days of taking on the debt if you don't contact them to arrange repayment. Mind you, would just love to get them to explain in court how they conjured up the £2944 figure from £86 of debt! On their website they say they write to you twice and if no contact is made they go straight for court. So far contact has only been made by email and in the small print at the bottom of the email it states "No reliance may be placed on this message without written confirmation from an authorised representative of the company." Does this mean their email doesn't count as attempt to contact no.1? Does anyone have any take on this at all? What template should I use, if any, to query the charges that have been added?
  16. Hi, They will cash the cheques, although if my experience is anything to go by it won't be straight away. I had a loan with them 2 years ago and they paid the cheques into my bank at just short of 6 months after my debit card failed. I don't know how this will stand after this month though, given that last I read at the end of this month guaranteed cheques would be no more... (that is to say the bank cheque guarantee scheme comes to an end)
  17. Hi All, I've just come on here with the intention of starting a thread the exact same as this, but found this one. I have a problem almost identical to m00nwalk00. Two years ago I took out a payday loan from Uncle Buck for £400, and because I'm self employed had to write out 6 cheques @ roughly £86 each and send them to UB as some form of security. When the 30 days was up I was emailed and asked if I wanted to extend the loan, and if I didn't they would bank the cheques. I emailed back to the effect I didn't want to extend and they could go ahead and bank them. They banked them just short of 6 months later. I banked with a different bank then and I seem to remember the first 5 going through OK (they were all guaranteed so was taken into an unauthorised overdraft situation), and the last one bounced. So, technically, I'd paid up except for the last £86. As they had been so lax over banking the cheques I didn't bother contacting them, and I don't recall hearing from them either over the matter. Fast forward to about 6 weeks ago. I phoned UB to enquire about their PD loans as I had seen that they had changed how they do things compared to how I was dealt with 2 years ago. I was told that because they had banked my cheques and not taken the loan payment at the time from my debit card that any future loans with them was no go. At no time did the person I spoke to say btw you owe us £86 plus a load of interest. Imagine my surprise (and total shock) when I logged into my emails just now to find this: LOSINGMYMIND We have been appointed by Uncle Buck to review your overdue account xXXXXXX for collection and legal proceedings. It is imperative that you contact us as a matter of urgency to arrange repayment of this account. Your current balance is £2,944.66. (WHAT!!!!!?????) If you contact us within 7 days of receipt of this correspondence, we will be able to assist with a suitable monthly repayment plan of your balance, or offer a reduced settlement figure of your account should you be able to make a one off payment. Should you not be able to make payment immediately, it is important that you still contact us to arrange a repayment date for your outstanding debt. If no contact is made by this time, your account will be reviewed immediately for possible court action, where we may seek to obtain an attachment of earnings order so that your employer pays your full outstanding amount as a deduction of your salary. Should you have multiple creditors and you feel as if you cannot make suitable repayments; we may be able to put you in touch with a leading financial advisory company to help you manage your debts at an affordable monthly rate with all interest frozen. Ask an account manager for more details. Please call 0845 026 8038 or reply to this email as soon as possible to make repayment arrangements. We look forward to hearing your reply. (I BET THEY DO!)   18. Now I'm really confused! Re-sent the letters on Friday, recorded delivery etc. and sent the whole lot on email too - referenced with the numbers they originally used a few weeks ago. This morning I receive another text "This is an urgent message for losingmymind, please contact Motormile Finance regarding your account on 0844 etc. quoting reference blahblah", (no reference was quoted in Friday's text) only this time the reference is completely different. Now it is possible that this could be another debt coming back to haunt me, however, going on the basis that last time MMF caught up with me it was off the back of Mack Hall chasing, this time there hasn't been any other DCA sending me letters. So I don't know what to think. I now don't know if I'm being harassed over the original debt I posted about, or if MMF have now purchased another (?) and are doing what they did last time - sent a couple of texts asking me to contact, then turning up at the door, then I received the letter, in that order. The fact that there was no reference on Friday's text would lead me to believe that it was connected to the original debt, but now I don't know. Not really sure how to proceed. I want to find out, but obviously I don't want to phone, and I don't want to chance it and wait for their doorstep visit. Any suggestions welcome Many thanks
  19. I'm not frightened of these idiots - it's the person I share the house with! I get it in the neck when idiots like this turn up, so it makes life a whole lot easier if I can stop it in the first place!

  21. Thanks, but which letter do I send again? Am I starting the whole process again, or just the failure letter? Also, what do I do about the fact they said they'll pass to their home visit dept? Last time they sent the text about 2 days before the w/e and turned up on the Sunday evening - nothing in writing arrived contravening OFT guidelines until after the fact - and even then it was the letter from Mack Hall and MMF in the same envelope telling me MH had passed the debt onto MMF, and MMF telling me they'd taken the debt from MH. I suspect if they don't hear from me today their field agent will roll up over the w/e. They don't play by the rules at all.
  22. Hi all, I have an update, and not sure what to do next. The clowns at MMF did not respond to either letter I have sent over the past couple of months - and I know they've received them because they were signed for. This morning I have received a text from them asking me to contact them today to discuss a repayment plan and that failure to respond will result in them passing this over to their home visit dept. So, no reference made to the fact that they didn't supply the CCA as requested, my £1 postal order has not been returned, I included the paragraph about home visits not welcome, and the account is now in dispute as the 'failure' letter was sent and received. Please help - I need to know my next move. Many thanks.

  24. Well it's now Saturday and nothing has arrived from them, either through the post (today's has arrived without a late reply) or hand delivered. Where do I go from here? I found a 'failure' letter in the library, is this the way to go? Thanks in advance for advice.
