  1. Hi SabreSheep I have a lot of UK debt but also now living in the Philippines. None with HSBC though. Every chasing letter I get I reply to the initial one quoting my address along with a CCA request and informing them that it MAY take up to 4 weeks for letters to arrive. I usually get the same garbage that arrives but nothing happens, Don't forget that if HSBC decide to go down the CCJ Route you must ask yo have it transferred to your local court house and under English Law. Not too many Philippine lawyers are up with UK Credit Law.

The LA's can take thier kick back and add it to thier bottom line at the end of the financial year

  5. Hi I emigrated to SE Asia in May 2013 I looked up my Credit File with Noddle and found that they are using my old address even though the creditors are using my new address. As it stands if one of the creditors wanted to issue a county court claim would they be able to issue against my old UK address and gain a default judgement??
  6. Why did he not use the official .gov.uk web site. Okay, you cannot pay for your passport via the website but they send you a print of the application along with all the information you require. You sign the paperwork and return with the other required documents to the processing office. You can also select the Passport Office that you wish to attend for your initial interview

I keep getting letters referencing an account that is not mine but for a previous tenant of where I live, these have continuously been returned with the new address of the person on but seems to have been igmored. I know it is about bills as I have seen them open in the waste paper box before he left. No the ex tenant has really hacked me off with many other debts being persued via the address Can I send you a PM with his name, previous address and his new address before I get even angrier and inform both the OFT and the ICO that Vodafone are not naintaining accurate records. Sorry, not meant to be nasty but I am now well and truly ...... off with all his debt collection letters
  8. Andybars Thanks, looks like they don't have too much chance with me then on two counts. First of all I do not have a Capital Bank loan and secondly I would love to see them try and get a judge where I live to understand English Civil Law concerning the CCA. I know one who has said that 99.99% of them here would just laugh at the claimant.
  9. Yes, the debt is in my name but was taken out with HSPF, not Capital Bank. I have received nothing in writing to tell me that it has been transferred or sold.. This was being collected by Moorcroft, but when I requested the CCA they suddenly could not provide and referred me back to Capital Bank. That is when I realised the different name. I will be doing a SAR when I return to the UK for a few days (actually quite a few SARs) as I can remember some charges at the beginning of the loan were £25 and £30 or more To be honest I don't really care what they do with this debt as they will not be able to enforce this where I live (I have that in writing) Quote "as the courts here have not got a clue with reference to English Law" and I have no desire to return to the United Kingdom of all Europe Crime and Benefits
  10. Filrobbo The debts are from 2010 and is only one of 12 debts due to my ex. They are on my CR file but not under Capital Bank. Originally was a HSPF Loan. Have never received any letter or documents referring to a change of name or ownership (may be due to paying via payplan) The link you kindly provided is not from a UK Bank and I cannot see them operating in the UK. Thanks anyway for the efforts, looks like I will have to dig further. Would appreciate if someone could advise if they are registered with a CCL and / or Companies House The only reason that I ask is that I don't think they have my new address and I do not want them obtaining a CCJ by default.
  11. Hi Once again I have to come to the only forum that can give good advice. Can anyone at all give information on Capital Bank please Are they a part of another mainstream bank or a new bank etc. Much appreciated and thanks 1 million to any replies PS: Debts is around £14,000 but have many charges and front loaded interest.
  12. Send a CCA Request to both them (costs £1.00) by recorded delivery, if they cant provide one stop all payments until they can. They have 12 + 2 working days to reply from the date of receipt. You can track the request via the royal mail tracking system with recorded delivery.
  13. Hi again I only have part of the answer with the replies I have. I really need to know who should be holding the CCA as the Moorcroft have referred it to the Original Creditor who state that I have to go to them for it. Surely if Moorcroft are collecting they must hold a copy of the said agreement and if this is correct then can someone point me in the right direction of the legislation / OFT guidelines with reference to this. Thanks

Hi DX Yes, very naughty, and the best bit is the house where I used to live have just emailed me a scanned copy of the infamous "We have a parcel for you" card with the same telephone number on. This will go to the Trading Standards and OFT as well. I will await Trading Standards decision whether to let the police know about this. Although I do think that this telephone number is a front room of a large house being used as an office by two or three people.

Sorry all, have been out of the country and still out (now an ex pat) Also whilst they have investigated they have informed me that the debt has been through the following and that it was eventually not Advantis that sent this doorstepper but Moorcroft TDX (never heard of them, no letter, no telephone call, Same with Scotcall, Viking then Moorcroft and finally Advantis. It was only Advantis that bothered to write to me. Moorcoft, obviously to protect their door stepper stated that they sent him out to collect cash but were told too late that the debt had been passed to Advantis so with the initial letter from Advantis I assumed that it was them who sent him as they also gave me a load of c**p that they could sent anyone at any time and I could do nothing about it.. However the Police just sort of brushed it under the carpet with a response that they have given Mr XXXXXX a severe warning to his future conduct and that the report will stay on file. Should they receive any further complaints they will include the action from this. I considered taking Civil Action myself but was persuaded not to by my Lawyer due to the costs and the protection that his employers were giving him. BT washed their hands of any complaint but still wanted the full costs and the 25% ... they are still waiting for it and have no hope ever of getting it now I no longer have a UK address It was passed to a company called Passed Due who were so obnoxious on the first phone call that I reported them for abuse to BT who took no further action. They actually sent a door stepper to me on the day I was leaving the UK so all he got was a hello idiot, goodbye idiot. So the bill is still outstanding with no hope whatsoever of being paid. They can take me to court, they can send the bailiffs out but they have no jurisdiction where I am and with no intentions of ever returning to the UK they will be wasting their (your) money.

Thanks unclebulgaria I have received nothing from Morrcroft apart from the letter attached in my first post, they say that I must write to the original creditor, or should I say that the original creditor has told them that I must write to them and not the DCA Thanks for the info regarding the CRA's, most of the creditors have my new address and I think it may only be the BoS for whom I have nothing address wise. I have been trying to leech an email address but seems like no one has one. Lowells chickened out of a small debt Crapquest have not replied to a CCA request from January this year Wescot failed to respond to a CCA Request in June Santander, who continually sent mail to my old UK address had to go to the ICO. So all in all I am only worried really about BOS They are welcome to go for Bankruptcy as all my cash has been transferred to my wife when I got married and I don't think that the Philippine government would allow her to be made bankrupt for a debt that is not hers. Anyway, thanks for the info re: change of address

Hello and good day MOORCRAP and BANK of SCOTLAND May have seen the answer somewhere but currently in such a mess that I dont know where or how to look and I expect this to be a simple answer I have a debt with the Bank of Scotland £14,000 and originally had me fooled with the solicitors for hire ... DrysdenFairfax ... for three years. Now the solicitors have passed the debt on to Moorcroft. I assumed that when I made the CCA Request I should send the request to Moorcroft as they are the ones fleecing the cash.The request was made on in September but due to me being at least 28 days post away I have only just received thier reply. [ATTACH=CONFIG]47662[/ATTACH] If the reply is correct then fine but this obviously indicates that Moorcroft do not hold the CCA requirements, I will have to write to the Bank of Scotland, if not can someone who has the expert knowledge of CCA and OFT regulations so I can put them right (okay, you all have expert knowledge in some form or another re: debts), or maybe help me write a letter to Moorcroft. I am not trying to dodge the payments but being 17,000km away and now an ex-pat it is sometimes difficult to get things done as they should be. I would also like to know where I stand with the Original Creditor with regaurds to my new address. I have not received any contact from them scince and no longer have the address to contact them and I have asked about an email address but have got no replies in the bank forum here. I started to pay the Lawyers for Rent. I was then living in the UK at the address I took out the loan. Since then as stated above I have now become an ex-pat and have informed the DCA on many occassions and requested that they inform thier client. Where would I stand if the creditor decided to try for a CCJ. Would I be able to use the DCA refusal to inform thier client as a defence. I know it is getting close as the new owners of the house have had letters from Northampton and they have been returned with my new address written on the reverse and I will not let them get a CCJ or anything else by default. I have currently sent an email to Moorcroft placing the account in dispute Many thanks for the help in advance Anon

Over the years I have had with Abbey National / Santander the following Bank Accounts Loans Mortgage Credit Cards Now I wish to claim back all the PPI and the charges. When I send the SAR request it will go to their Milton Keynes Head Office so will this be one payment of £10 or does each account require the payment (4 x £10) Many thanks in advance

I used to work for a National Company and use the same (called Role Clarity) although if you had TUPE's across you were on previous terms and conditions (that is if you were on collective bargaining then you stayed with collective barganing), if you were on a personal contract then they could do what they wish. I would suggest that you read your Contract Of Employment to ascertain your employment status and then seek help from your Union Representative
