  1. I was told BC are now auto rejecting every single claim of any charge of £12. This supposidly came in around 6-8 weeks ago.
  2. Well, thought i'd give an update. Didn't get round to sending an LBA as not had money to start the court process yet. Spoke to someone at the FOS who set up a complaint for me, and I sent copies of my letters etc to them including the fact BC had taken so long. Finally after 72 working days (!!!) someone rang me to say they had worked my case and a refund would be applied to the card. Brilliant I thought, till I realised they hadn't said how much. When I pushed them the response was £58. I'm pretty sure that a £12 a month charge for over-limit for the last 2 years comes to a bit more than that! The girl explained that BC are now auto rejecting all complaints and only refunding the last 2 months charges. Waiting for letter to arrive before I can check it over. For the record I actually received a refund of £24 and £14.20 which i have no idea what that is for. Once the letter arrives I will decide my next move. Probably give the FOS a couple of weeks to see what their response is
  3. BPF have a habit of charging you £22.50 for every late payment. And they do it every 15 days too. I was in a similar situation with my balance 3 times the size of the original amount borrowed, despite repaying for 2 years and not actually having anything outstanding. I calimed every single penny back eventually. Good luck!
  4. Thanks IMS Forms completed and credit agreements copied. Off into the post today. Looking at the 2nd loan I was due to pay over £400 in interest on the PPI alone, so if it did run its course, I'm hoping for a sizeable return. Here's to another 8 weeks of thumb twiddling and see what comes back. I'm pretty sure HSBC are going to find something that shows rebates etc. If so, then maybe a letter to the IC after would be good as HSBC have already replied to a SAR that they had no information on anything that ended before 2005. They did supply me with a PPI Policy number for a Flexi Loan, but had no detail on what was paid etc, and a SAR gave me no information on the Flexi loan itself.
  5. Thanks CitizenB. I'm supposing its for HSBC to prove they paid me back a rebate if I have my credit agreement clearly showing how much PPI would have paid?
  6. Having cleared through some more draws at my mothers I have come across yet more paperwork for old loans at Midland / HSBC bank. The first loan was taken out in November 1996 over 42 months. Loan was for £5500 and had £750 PPI added to it. APR was charged at 9% and obviously front loaded The second loan was taken out in November 1998 over 60 months. Loan was for £9500 and had £1697 PPI added to it. APR was charged at 9.9% and again seems front loaded. As you can see the first loan roled into the second. Pretty sure I would have had a rebate but not sure if for the interest / PPI or both. I have no other paperwork showing any refunds etc, just the initial credit agreements As per each of my previous claims I had 6 months full and 6 months half pay through work at this time, so would have been covered. The fact each of these was front loaded also helps my claim If I had put in a SAR (I actually have done) on these loans, HSBC would (and have) said they no longer carry any information. However I'm pretty sure they will magically find info that may show any rebate against either of these loans if I put in a claim. Just want to check that I have all I need to put my claim in?   7. Response back from HSBC today, upholding my complaint, apologising about the phone lines (again) but telling me they do accept calls. Seems the information I was given on 10 week time frames was incorrect. HSBC hit 7.5 weeks. Offer was slightly below what I expected using the FOS running sheet and then the 8% stat sheet, but near enough for me to accept Thanks to all for your help, I will let you know when money is in account
  8. It seems that the HSBC Regulated Complaints line no longer accepts incoming calls, only gives the answer phone message that they are busy. The line used to do this often and go to a ring tone every once in a while, but according to the customer service person at HSBC bank today, you can no longer contact anyone direct, and have to await a call back. He also told me that HSBC are now running to a 10week response time which is a worry as i'm not aware that the FSA have granted them permission to do that

I hoped that this was going to be quite straight forward, but after ringing today I have been told that no-one has looked at my complaint, its not even allocated to someone and yes I can go to the FOS. The guy on the phone was pretty candid with me, was very aware that BC would get a fine for an investigation, but told me I wouldn't hear anything more until their investigation was complete - whenever that may happen to be!! As they had complied with the FOS 8 week time limit, but were no further forward, they were under no obligation at all to contact me again until any work they were doing was complete. Whether 2 days or 10 years. 9 weeks of waiting to be told this! Based on that, no bank need ever respond to any complaint and just let everyone go to the FOS after 8 weeks. It would be carnage! The FOS would be under a deluge of complaints, and nothing would either get investigated correctly or within years. Surely this is all a bit wrong?
  10. Hi naithr, apologies for getting back to you late. Follows IMS advice and you'll be ok. I put my complaint into HSBC, but showed I alsready had an HSBC life policy for Income protection and that I was covered through work. HSBC paid out without any issues. Good luck
  11. Good point Slick. I'll wait til the end of the month, when I can afford a court fee. In the meantime i'll send my letter to the FOS so at least BC get their "fine" and see what comes in the next couple of weeks. I don't have a card for the account and just make sure I make my payment every month, so not a massive difference if sorted today or next week. Its just slightly more interest added so BC's loss not mine. I've taken Cap One to court so know the process. The threat to MBNA worked without me having to go that for, so fingers crossed
  12. Rang today to find out what was in my 8 week letter and was told they still haven't resolved my complaint. Unbelievable!! I was told on the phone I could go to the FOS now, I informed the girl on the phone that I find it unbelievable that Barclaycard take 8 weeks to do nothing with a complaint and that yes I will be going to the FOS which will cost BC £750 for an investigation which is considerably more than I was complaining about. No wonder the banks are in a total mess. FOS form will be off in post today, so disappointed with the service from BC as my last complaint was dealt with in time. One guy I spoke to claimed that they were dealing with more charge complaints than they were PPI complaints at the moment. I'm starting to understand why! BC will also get an LBA letter of 1 days to hurry them along and I think i'll be considering court
  13. I should know the answer to this in a couple of days. I don't see any issue with trying to get these back, and as someone said earlier in the thread they paid out once, so no reason why they wouldn't do it again. Untill BC prove the cost of managing an account that is paid late or over the limit is £12 per month then i'm not sure how they can defend themselves. I've even heard that BC are refunding all new £12 charges on old Egg cards, but won't refund anything when Egg were charging £16. Very strange!

  16. Well, I got what I should have expected which was a fob off for another 4 weeks (the 8 allowed by the FOS) Didn't get letter till well after the 1st, even though it was dated the 1st. I spoke to someone on that day and they said as it was the 1st they had the day to send something out. If I ordered something to be delivered on the 1st of the month and they decided to send it on the 1st and it turned up on the 6th I'd be pretty unhappy, so why do BC think that they can say I'll have a response by a particular date, but what they actually mean is they will send a letter by 4th class post on that day. Total joke. thought about an LBA but as thats a 14 days letter and I have 14 days till they have "promised" a response then i'm just going to have to sit put
  17. I wouldn't worry too much about what they class as accounts. BPF told me that the change to £12 charges only counted for Credit Card charges and as this was a loan they could do what they like. They seemed to make it up as they went along. Anyway they still paid out in the end once the FOS got involved. Angel_Islington had the same success so hopefully not long for you to go now

  19. I have loaded all my information into the FOS running spreadsheet, just checking that this is the one that I should be using? The figures are much lower than the stat interest spreadsheet as this runs up to current date, but the FOS running spreadheet finishes when my credit card was closed in 2006. How do I then work out the interest up till the current date and what numbers would I use? Is it the PPI Paid or the card balance excluding PPI figure which obviously has the interest added in? A loan is pretty straight forward but I want to be able to check what HSBC might offer Many thanks
  20. Had a very interesting telephone call from DFS today who have confirmed that it is indeed them that I need to put my complaint in to. I must admit i'm pretty surprised. Leeter to go off to them today!
  21. Decided to ring HFC as time had elapsed and I had heard nothing additional. The man on the phone inisted that this was not HFC's issue and that I had to take it up with DFS and offerend me a contact number (which was just the store I had bought it from) When I asked why HFC had paid me back for 2 other loans that were also store credit he told me it was to do with when they were taken out and as the DFS loan was newer I had to speak to them. Is there any possibility of a grain of truth in this? Thanks
  22. Just as a heads up, based on my experience with BPF, they hadn't added any interest to my balance at all. Once the initial interest in the contract was added (mine was a buy now pay later contract) all they added was the charges which I wrongly said were £15 a time (they were in fact £22.50 twice a month!!!!) I did get mine to balance correctly though. Check you dont have any D/D return charges etc. You should get every penny back from them to put you back to the point as if no charges were added. Please do make sure you read my thread. However as slick says - if you are going to sue, go for the compound interest!
  23. As I have been moving house, I have just come across a pile of HSBC Credit card statement copies from 2001-2005. I's requested these back in 2007ish to check for late payment fees, but there wasn't any. Hadn't realised these were tucked away somewhere. Anyway i've checked through and there is over £600 of Credit Card Repayment Protection fee's across the period. HSBC have already refunded me the PPi on 2 loans and my mortgage due to a miss sell so this should be pretty straight forward. I have done my spreadsheets and I think I have a healthy £450 of simple 8% interest and a further £1,968.58 of compound interest. I know there have been issues with 6 year rules, but fortunately I have copies of all the statements and will include them with my FOS complaint form to HSBC. Lets see what HSBC offer

Having been in a similar situation please have a look at my thread http://www.consumeractiongroup.co.uk/forum/showthread.php?315743-Barclays-Partner-Finance-Clydesdale-PPI-amp-Charges-***WON***-with-full-refund I sent in a complaint to the FOS and a copy of all the letters that had gone back and forth with Barclays Partner Finance. BPF coughed up without too much of an issue once I had got half of everything back myself. BPF charged £15 a time for late payment fee's and charged twice a month. Also they keep charging untill you are caught back up, hence why your balance will be so high. Good luck
  25. Hi Slick. Yes spreadsheet was included with letter showing each charge and it's date plus interest at 8%. Letter was dated 2nd May that I sent so having them confirm a response by 1st June is quite a surprise.
