  2. MCOL doesnt give enough space for a decent POC do it the old school way. can still download the forms etc.
  3. My statements had 3 lots of interest applied. I assume 1 is cash, 1 is purchases and the 3rd Maybe PPI? but not sure.
  4. Well if you go the court route it will be quicker, mine took circa 9 months, FOS is snowed under and slow. If you go court you will have to do more work to prove your case to a judge but can decide the time-scales and tell them what you want. You have to be prepared to go to court if it comes to it and argue your case in front of the judge and the bank will bring a brief to try and knock you down. FOS will do the work for you and tell them what you will get according to their calculations (I dont know what these are). If you go court you will have to pay some fees up front but you can also claim reasonable costs for your time @ £18ph iirc
  5. Having had dealings with them for the last 9 months I can say with confidence they will take longer than the 8 weeks because they seem to like to do what they want. Get on at them a few days before the 8 weeks is up and be prepared to keep on at them for rest of the claim process. They have YOUR money so be forceful and dont take any rubbish from them. Are you going FOS route or court?

  9. yeah, could have next day'd it eh. Shows their utter contempt towards the courts though doesnt it! they simply do not give a **** about anything a little county court orders them to do. I take it there is no one I can complain to really.
  10. Well deadline (set by them in Tomlin) was today and no cheque!!! Phoned but no answer so message left. email on the way in a bit. Can I order Bailiffs now and will it cost me more money, they told me last Tues the cheque had been released!
  11. Is your claim £5K+? or just complicated? I take it the reason for the N150 it will be fast track. Directions will be specific for your case and based on their defence and what you think they should do to resolve the issues.

Get the court papers filled out though as I am sure they will send you a letter stating they have investigated this matter and do not agree etc. I am aware you have read my mammoth thread so you will be aware of the time scales for court action, still faster than FOS but you will need to put in the hours.
  13. They have released a cheque and I am waiting for it. Monday is deadline set by them ironically, I expect them to be late and will phone or email on Monday and threaten bailiff's. My advise is to stop trying to reason with them on the phone they will just waste your time with we will look into it etc. If they have sent their final response then it is time to start court proceedings. don't worry about the fact it is back to 2002 mine was 2004 so not that different. they will say its barred due to being over 6 years but this is not true, its 6 years from when you realised there was a mistake in your case this was 2011, I stated 2007 in mine as that is when I was aware the PPI was not part of the service and was actually voluntary. There is no need to over complicate things in the POC part of the claim, just state the fact that you did not want it, did not ask for it and it was added despite you saying no. write and ask for a transcript or recording of the phone call and they will write back saying they have nothing. Good luck keep off the phone with them until its their solicitors you are communicating with. One other thing to note is that as a LIP you can claim £18 per hour (I think check thread) costs so make sure you keep a diary of how much time you spend on writing letters and emails etc, if they phone you or you them note these times down too and keep a note of postage costs etc to claim back too. I claimed over £400 in costs so it does add up.
  14. It was the FSA that fined Cap1 and it was due to an investigation they done on their PPI selling.
  15. FSA FINE.pdf You will probably find they will tell you that PPI was purchased during a telephone conversation, they will have no record of it though as it was too long ago. Just go through the steps and take them to court. It wont get there but it will drag on for a long time. dont let them win, we can all help you on here.   17. Court said they received order on 17th and its with the DJ, Cap1 say they will raise cheque when they receive sealed Tomlin back from court.
  18. Unless its the date it is ordered by the court in which case I have heard nothing so far! Was I supposed to file the Tomlin order or them? they said sign and send back!
