  1. Just today received a CCJ for £350 quid, for parking in a hotel car park. This is the first bit of paperwork that i've had, other than them asking me for money (the pcn) thing. I wrote back to them stating that i was a guest of the hotel at the time, they replied with a letter saying 'we don't care' What steps do i now have to do to get the court to reverse this?
  2. Its a nationwide cc.. i thought it had been transferred to an agency.. but after checking i was mistaken. I didn't think they could add the interest after the default.. but was wrong about that too i guess. There's none for them to have, so they can add a million to it a month if they like.
  3. I defaulted on a credit card for 11.2k , they sent a default notice in october, however, i checked online, and they are adding £170 a month interest. can they do that? - what should i do ?
  4. She changed her address on her accounts to that address. I thought that home visits had to be pre-agreed ?
  5. Sorry.. i didn't type that correctly.. it was a home visit dx. and guy knocked on the door for her, and asked for her. claimed he worked for Nationwide. There is a DCA that the loan has been passed on to from Nationwide.
  6. My wife has been staying at a relatives house. Someone just cold called the house asking for her from Nationwide, she has an outstanding loan, credit card, and overdraft with them.. are they allowed to do this ? - i thought not. ??
  7. Simply because i had seen reference to it, but it was never explained what the difference was in any of the threads i'd read. All of my defaults are less than 10k
  8. Whats the difference between owing a credit card company, more than , or less than 10k? I've seen reference to courts, and type etc. what differences are there on a default, of one, over the other ?
  9. I've had a mortgage with the One Account, for a number of years. we got into financial difficulty a few years ago, and had it changed to interest only. They recently contacted us, to say they were concerned that the capital would not be repayed before the end of the term.. (in about 8-10 years) i think. their mortgage consultant, spent some time on the phone with me, and agreed it was in my interests to change to a fixed rate capital and interest . the product would have to come from Nat West, rather than the one account (same group). They wrote to us, to say the mortgage was approved. a few weeks later a company called Optima Legal, wrote to us to say the they could not approve the mortgage because of a 3k restriction (in my name only) - because their client had to have first say on any structure. This is despite a debt of 166k on a house worth 270k - and a restriction of 3k. So.... I have written to one account today, to advise them, that their actions of refusing to put me onto a fixed rate capital and interest loan may disadvantage me in the future, financially. I also, told them, i believe the one account mortgage type was mis-sold to me.. (way back)... anyone have any legal typeish thoughts on this ?
  10. dx100 - Yes, the information before was about the 6 years.. but this information is different, it relates to the entries in noddle. the companies that have purchased the debt, have made fresh entries, in the noddle information.. so i was was concerned that, that information would not dissapear after the six years. No, not paying anything. As an aside. do you know if a restriction on a property should stop a remortgage ? - as there is no 'disposition' to be had?

They have created another 'open' account in the noddle entries, and the original agreements from both Barclaycard and Mbna are shown as Settled (Barclaycard) and Mbna (Satisfied) Then in the open accounts the new companies who have puchased the debt, show an account, with a much later DF (default) date than the original One is PRA group the other is Lowells. I guess my point is, that as companies like noddle their systems would only remove an 'open' account if the default Date is >6 years. Also, the b/card company, doesn't show in Credit cards, it shows, in 'other' account.. where its shown as Type: BANK. I sent them all one years ago. only ever got 1 reply, that i couldnt read My SB dates are all late 2018 do i need to do anything about all of this with regard to Noddle. etc. ?

One of my original credit card debts for 6k was with MBNA. they have passed this on to PRA group Ltd. however, checking noddle.. the original account was defalted in jan 2013. but now shows as a 'Satisfied Account'. the PRA entry shows default as june 2014, so mbna have passed the account onto PRA. then PRA have started sending in entries to noddle etc. If companies like experian remove after 6 years automatically, won't this PRA entry be over a year later. ? Another thing ive noticed.. is that on my credit report, i have Credit Cards shown, but there is one at the bottom, which has been purchased, was b/card CC. but now shows as as a separate company.. and the TYPE as BANK. not Credit card. should i be worried about this?

Scandalous.. that the government introduce rules.. supposedly to improve air quality.. then, when the consumer switches to low emission cars, they start to recieve less taxes so then change the rules, so boost their income. I know its normal, and in line with what every Labour or Conservative government have done in the last 100 years.. but.. wouldn't it be nice and refreshing to have a government that acted in a manner that benefits the people. ? - Instead of trying to raise taxes for those that do pay.. why don't they :- Track foreign vehicles on the roads and make them have an MOT and pay car tax. Ensure foreign lorries have to pay to drive on our roads. Set up a scheme where all new bicycles have to pay a tax , to set up an insurance scheme for bikes.. (bit like the Motors Insurance Bereau) Penalise heavily anyone buying any car worth over 50k. and probably a million other things i can't think of..

  15. Went to see an IFA today.. and recieved some information which, i think , conflicts with what i've read on here.. (might be me making the mistake). He has said, that debts owed, are not wiped from your credit file, until 6 years, after satisfaction.. ie: they stay there.. and if you want a mortgage or something, they would still be considered, even after the 6 years. My CC;s are on 4 years. and i will need to change my mortage in the short.mid term.
  16. I think a CCJ is inevitable. it makes no difference, i still cannot afford to pay much. I have completed the statement of earnings, and sent it back to drydens. I'm guessing at this point its up to them to take it further? or does it automatically turn into a CCJ ? (even though i sent it to solicitors)..? i offered to pay £1 per month.
  17. I still don't understand which bits of this form i have to return, and to whom. its very confusing and makes no sense. It says i should ''read the notes for defendant' attached to the claim form, but there weren't any. just 4 pieces of paper. (the claim form) If i admit the full amount, i have to send it back to drydens. (but they have added a lot of £12 payments) if i admit part of the amount (which i do), i have to send it to the court, with another page, the defence. what am i best doing? - if i send it to drydens, is it then up to them if they want to proceed further?
  18. I registered with the MoneyClaim website. It seems to suggest that i need to make a ''full admission'' ie; i know i owe the money, but i have to then fill in the paperwork? can i not do this online or am i clicking something wrong? Also, it says that if i don't suggest an amount to pay them, then they will decide. I can't really afford anything but a token amount. Back to the full admission point, i know i owe them the majority of the money, but, what can i do to get them to give me info on all the £12 overlimit fee's etc, i don't believe i should admit to having to pay these, because its their interest that made it go ''over the limit'. when i admit the amount, i just want to admit the right amount on the form, not all these £12.00 pounds they have kept adding ?
  19. Well my outgoings exceed my incoming monthly salary at the moment. When its assigned to a local court, do i have to attend in person? (its very difficult for me to get time off work) i have 5 credit cards that i owe money on, (27k total) - hardly any equity in my home, is there any possibility of a charging order? (i noticed the change of the law from october 2012). where it seems the law has decided that an unsecured debt, is really a secured one !?

  21. I owe money on 5 different credit cards, that i stopped paying last year. I sent each of them a statement of my financies to show that i couldn't afford to pay. I am paying a secured loan and a car loan. as these are priority debts At this point, i have no money to pay any of the credit cards, and am just keeping my head above water, so to speak. One of the lowest, has had a county court send me a moneywise claim. its for 3.5k and the court says nottingham, (i live east of london). Its a post office credit card. Its asking me to show all my outgoings, and incomings, but doesn't ask for proof of any sort. Is it just a case of registering with moneyclaim, and filling all the details in? never been in this position before, and no info. any advice from anyone?
  22. Yes. i have just stopped paying them. they are all fairly recent, some maybe 4-5 years since i've had them. I just wrote to them all saying that as i only had my salary, mortgage etc, i could not afford to pay them. i included a summary of primary bills, gas elec, mortgage, one car loan. then all the other debts. (5 credit cards). None have PPI. So, my statement just shows how i will somehow be negative £250 a month, and that severe financial hardship was coming my way. I asked them to freeze the interest, and any penalities. and also to only communicate with me via post. I didn't offer to pay anything in the letter.
