  1. hang in there, be strong and listen to all the advice the guys on the bailiff forum give you, their help and knowledge is fantastic they are a real credit to themselves, ignore those who were rude in the begining dont let them upset you, most of us have posted threads wanting help because we have buried our head in sand, i have been diagnosed with fybromyalgia and i have no idea what ive been doing for the past few years!!! and once we've opened up and been honest the last thing we want is too be judged, dont worry you will get this sorted xx
  2. hi all, i had a letter from Dukes with a breakdown of fees ( of some sort?) 30.06.11 at 07.38am 24.50 pounds( i was in it was a school day so we were all up but he didnt knock he just posted it through our post box, they give the guys name and details of when and where he was certificated but i cant find him on the register 07.07.11 at 12.26, 18.00pounds (again no knock he just posted it) different guy, again giving details of when and where but cant find him on the register, 22.07.11 at 12.39 enforcement visit 185.00 pounds levy fee 60.00 pounds Sch 5 Head Fee ( what the heck does that mean???) 24.50pounds this guy is evil but he is registered, although the court details are slightly wrong we werent in at the time i was in hospital pregnancy complications, and have proof that i had paid 345.00 in council tax by this point so i will make some calls on monday to find out if the 1st 2 are or were registered, and if they werent or aren't then i guess as its council tax i have a strong case for complaint i feel so outraged by what these bailiffs can do and how much misery they bring, that i've contacted the local press and our mp, im going into see them this week and im wondering if i can start some kind of local petition to stop the council from using bailiffs so quickly, something has to be done and i think bailiffs should only be used as a last resort and they should abide by the rules which they clearly dont, and i think these rules need changing big time!!!
  3. no he didnt knock on the door it was 6.26 in the mornin he left a letter on our van, i did phone and tell him i was pregnant, but he wouldnt back down on the fees, i was livid about the 120pounds van fee!!! and the first guy ive found out isnt certified not sure if i can check if he was certified at the time, ( and i contacted the parking fines department but she was just rude and said it had nothing to do with her, and that i had to pay it)
  4. hi there, ok i've had a reply from jacobs in regards to the above template in post 2, (i've sent 3 of these in total, 2 to dukes and 1 to jacobs) this matter was regarding a parking fine, and here are my charges letter dated jan 24th 2011, (which we did not recieve, asked them for a copy of this letter and they refused) 18th april visit from bailiff who i've looked on the register he isnt certified and no longer works for the company(how convenient) fees first visit fee 33pounds and a van fee of 120pounds?? 2nd visit was made on 10th may but fees were removed due to already having a payment plan in place made on 27th april, this guy hammered on the doors and windows like a mad man!!! we then disputed the fees from june and wrote to them refusing to pay untill they reduced the fee they refused so, however on the next date they have wrong, but the time was right 06.26am in august, which we incrued a fee of 40.80, this bailiff is certified, in the end we paid as i was heavily pregnant at this point, so altogether the total amont we paide was around 280, for a parking fine debt of 80pounds, any ideas as to what my next step should be, thanks
  5. hi all, huge letter of complaint has been made an sent by special delivery to the recovery section, the ceo, head of finances, head of taxation- who incidently is on dukes website stating how wonderful they are!!, head of the local councillors, the local mp- i had a call from them, they had no immediate appointments but as they are dealing with complaints like this all the time could i please hand them all the info in they are willing to help, and lastly a copy to a journalist at the local press again who is dealing with this all the time, i also included evidence of all payments made and all correspondance. I have called the recovery dept on numerous occasions this week, they have refused to call of the bailiffs, refused to listen too me and the guy even told me i deserved this!!! I also sent info regarding a really big dispute in 2008 regarding dukes, and can i just check if a bailiff forces his way into your home, can he without threaten to take all your belongings before he has done a walking possession order?? oh and can he carry on threatening you whilst your husband has a diabetic hypo and needed urgent medical attention????

  7. hi PT, yes he is still working its the same guy im dealing with on my other thread, re dukes bailiffs, he has caused misery all over leek!! i have receipts etc, an will get the above sent today many thanks
  8. hi i dug out my paper work 2 letters were sent by hand on the 30/6 and 7/7 by a pre enforcement bailiff? with no knock at the door just put into the post box, by this point we were upto date with payments which were made direct to staffordshire moorlands.

Hi i have another thread on here and as i have been going through old paperwork i have come across some from march 2008 when we had a horrendous experiance with a bailiff, i have always been too scared to complain but this guy took £550 in fees for himself of me in front of a police officer, am i still able to do anything about it and can i still go down the form 4 route????   10. hi there i am just digging out my paperwork now, apart from the letter this week we havnt heard from the bailiff since july 2011, as i havnt contacted dukes the only breakdown at present is as it was in my previous posts, i have also contacted our local mp and councillor via email, and have a meeting with a reporter from the leek post on monday, i went to the council office today but the recovery dept dont work on a friday!!!
  11. first of all josephbloggs and nicbbb please dont use my thread to waste valuable information that i was requesting, and josephbloggs believe me i know dukes are bailiffs, i want to pay my council tax and after clarifying much legal advice i also know for council tax they cannot charge such an outrageous enforcement fee amount. please dont reply unless its something that will be beneficial to me in the situation i am in. hi ploddertom, i recieved 2 letters in the post, however as soon as i recieved the first letter i went straight upto the council office to sort it out, basically due to being on a low income we missed our 1st payment in april, i went to the council to make a claim for council tax benefit and the lady logged our claim but due to staff shortages it wouldnt be processed for 6-8weeks, she ensured me that providing i could make minimal payments no action would be taken, however i was still sent a summons, by june i had paid 345 pounds which left me in no arrears at all, but the recovery department still sent in dukes, they also had a go at me over the phone for not contacting the bailiff, and because i had made payments to the council and not the bailiffs, even though i was upto date with my monthly payments they sent the bailiffs because they wanted me to pay the rest of the year, in full when the bailiff came in july i had then paid 490pounds in payments (bearing in mind my total bill is 1150.40), only when he had come round and left the enforcement did they back down and call of dukes, but i was left with unessesary charges. from august to january this year my husband was out of work and we recieved 22pounds per week council tax benefit, which worked out at 484pounds, according to my calculations we only owe 176, which whilst i am waiting for our new claim to go through i have asked to pay it back at 10pounds per week which started last friday, but they have ignored my letter and the bailiffs are saying i owe 636pounds!!!
  12. thanks for the advice its really appreciated!! i will stay strong, i've emailed my local mp, and i have an appointment tomorrow with the council tax recovery department i dont understand why they have instructed dukes as i wrote to them with our repayment plans!!, and up untill jan we recieved council tax benefit, i will have to try and hide the van, this has ruined my day! im not letting the kids play out tonight!!!!
  13. hi again ok, ive stopped crying!!! and now i want to do something about this and do it properly, 1st of all before i go to the council to complain is there anything legal that i can say in regards to the outragous enforcement fee of 185.00 and admin fee of 24.50 and i also want to send a formal complaint to dukes to complain about this fee, i know they will fob me of so any advice on wording etc will be much appreciated, also we cant move our camper van but if its covered up and the reg is covered can they still threaten to take it???? many thanks

  15. the camper van is worth around 2000pounds, and this is all a big mistake because we were late with our payments last year, the thing is though we had paid 490pounds by the end of july and were upto date, but the council seem hell bent on sending it to the bailiffs, im really sorry but im sat here at home in floods of tears because dealing with dukes makes me a nervous wreck, does anyone know if there is anyone who can deal with the council on my behalf

  17. hi i managed to find the original notice of seizure of goods and inventory from dukes dated 22nd july 2011, first visit fee 24.50 second visit fee 18.00 (these werent visits but letters) levy charge 60.00 enforcement fee 185.00 administration fee 24.50
  18. no my husband only went back to work in january but because he isnt on a high wage we are still entitled to council tax benefit, and i have a claim going through, i spoke to the recovery department this morning but they refuse to deal with and have said now its in dukes hands they cant do anything about it, tbh the guy was rude and really unhelpful, if the bailiffs do come what should i do!!!
  19. hi the bailiff came to our home last july, we werent in and they left a distress levy on our camper van, however the council acted too quickly in contacting the bailiffs and ignored all our communication, our coucil tax bill for 2011-2012 was 1,150.40 and we were late with a couple of payments but by july we had paid 490pounds, then from august we were entitled to council tax benefit due to my husband being out of work. the total bailiff costs come to 412.00 i am just hunting out their letter from last july right now.
  20. hi there, we are having problems with staffordshire moorlands council tax department, my husband was out of work and we recieved council tax benefit from august to january this year, the council are still saying we owe 632.00 pounds even though 400 of this is costs for dukes, i wote to the recovery department last week and delivered the letter by hand saying that we would pay what we owe but were disputing some of the amount, and also because we are on a low wage we are still entitled to council tax benefit, and a new claim has been submitted, i have heard nothing from the council until i recieved a letter from dukes toady saying that they will attend in a evening to remove our goods, and they want full payment of 632.36. i phoned the council and they refused to deal with it saying that its in the bailiffs hands and its got nothing to do with them, i am now terrified of getting a knock at the door, please can some one advise me what to do, many thanks

  24. hi there, this week i thankfully with the help of this site managed to get a suspended eviction order with birmingham midshires, our arrears are 6,500, we took the mortgage out in sept 2006 for 110,000.00 and after trawling through our bank statements have worked out we have made in the region of 30,000.00 in mortgage payments, however birmingham midshires are stating that our outstanding balance is 107,323.00!!! when the judge saw this yesterday he was horrified and advised me to get advice on what appeared to him to be very unreasonable arrears charges, and he asked the rep for BM to make sure they comply with this. I complained to them in august 2011 and they offered me 3011.00 in charges back, and an extra 100.00 pounds because they sent a really rude rep round to hound me into having a meeting with him, i didnt accept the 100.00 or the offer but now they are saying the matter is closed and finished with. Any advice on my next steps would be greatly appreciated
