  1. Depends on his care needs and whether you would get anything for being his carer. Is he working or on JSA or ESA? You'd probably get low rate mobility for DLA but I'm not sure how/whether you'd get any care or carer component? Looking on your council website or approaching you local benefits advice/welfare rights services would be able to tell you more and assist with the applications. Whatever you chose being a Mental Health problem it is always advisable to get help with and for somebody other than the claimant to fill in the application forms.
  2. Not sure why you are panicking here? As long as it's awarded before the ESA WCA medical it should be fine and everything will be back dated to the date of the claim. DLA decisions generally take between 2-8 weeks. How long has it actually been?   3. Just to add you will only need a new certificate when your current one runs out. So say you get a DRs cert in June covering you until Sept but failed ESA today. The next cert you would have to submit would be when the current one lapses in Sept. Confused me a bit this did
  4. Well spotted that man It is the actual 23 page ATOS medical report in all it's wonderful glory! That's hidden behind 3 pages of a filled in by ATOS but not by the DM - DM's scoresheet.   8. You'll have to excuse me I'm semi compus mentus atm ATOS are employed to produce the report for the WCA assessment as DM's are non medical. Are they also employed to summarise the medical content of the ESA50 form for a DM to read in non medical terms in a report? If so would a DM actually need to read the ESA50 or just the non medical termed report done by ATOS? Trying not to have ago I'm just confused atm It seams to me that everything from the point you telephone until a decision is made is now controlled by ATOS under the umbrella "Medical Services" DWP say we don't know we must contact medical service! ATOS say we don't know either & must contact "Medical Services" All correspondence from "Medical Services" is actually ATOS (it says this on the letter head # facepalms ATOS on behalf of the DWP) and non of it makes sense or is coherent :! Where it says on all the processes documents etc that there is a DWP DM decision made in reality it is only possible via a referral by ATOS sorry "Medical Services" back to a DM which never happens. So from the initial telephone call until the 2 non medical reports (one for the ESA50 and one for the WCA) land on the DMs desk they have no part in it at all? I may be way off the mark here but that's the impression I'm getting

I may have worked for them on the floor down from the DWP contracts Once, twice, three rings then I'm allowed to put your 1 hour emergency fix call on hold for 24 hours since you didn't answer Sema = ATOS as they were absorbed by them I know a lot about DWP and IT contracts (well a bit anyway) :idea:
  10. From the experience I've had the DWP never get to see the ESA50. In fact it is only ATOS who produce for the DM a report on the ESA50 and also on the WCA assessment, who handle any of the documents from the initial telephone call for the claim until decision. With no DWP involvement until both reports are sent for the DM to decide on. No bias whatsoever in backing up your own initial assessment of the ESA50 in your subsequent report on the WCA medical? Call me paranoid but paying somebody to assess both the ESA50 and then provide a medical where by they can support that initial decision is erm.... open to abuse for ???? profit ????
  11. Thanks DJ I'm just trying to figure out how your are supposed to write the initial appeal letter when you are not give any information that tells you how they've come to that decision? I'm just getting that feeling that something just isn't right and I'm usually correct when that happens. Any more all welcome I'm off to de-stress by pawning some noobs on Mario Kart for a bit
  12. Right I am really confused here I thought all decisions on benefit had to come with an explanation from the DM who made the decision? So I've just rung again and they say they will pass a note to "Medical Service" (or provided on behalf of DWP by ATOS) to get a copy of my medical report sent to me. Is this correct? Did anybody else get a statement of reasons for your failure off the DWP as surely this should be coming from the DM who decided my claim not ATOS. Help.... my brain hurts

  14. Your problem is that when you applied for LHA/HB/CT you agreed (on the application form you signed) to inform the council yourself of any changes. No matter what another benefit department tells you, you have agreed and signed on the dotted line to do this. Therefore any failure on their part to inform them is not a clerical error as it's not what you have agreed to do. Although these automatic notifications work most of the time. I think that it is very bad advice for them to be telling you this as if anything goes wrong it is you that is responsible. Until there is a single benefits computer system which controls everything from a single point/reference across all departments this will always be the case. It's not the DWP staff fault either as they are being trained to believe this myth and are therefore giving out advice on benefits they have limited understanding of.
  15. Morning all The letter I received from JCP saying that I'm fit for work states that Any ideas on how long this takes or where it comes from? As it's been a week now since that was sent and there's no sign of it Now I've just called the DWP and they've told me that it's nothing to do with them and that it's down to ATOS (# spits) to write to me. Is this correct and since I will need this info next week is there anyway I can get it like pronto?
  16. Surfer is correct Access to Work - practical help at work : Directgov - Disabled people It a health & safety matter. Everything has to be done by the book and approved before being implemented. Not sure about the jealously thing? It's more about compliance with regulations etc so as not to do anything that harms the employee and also so that the companies covered just in case. My last H&S were brilliant and although an employee would go 'they say I need this' would research it then suggest stuff more suited to the workplace they were in.
  17. Exactly the same thing happened to me! Very little scope to expand on questions as they were delivered in a yes/no format. Although I tried to expand as much as possible. My nurse actually said that they didn't believe me when I answered one question! You should be notified of the decision within 2 weeks of the medical. If you haven't heard by the end of 14 days call the DWP number on your ESA letters and ask them what the score is. There's no point fretting about it now as it's just a waiting game. What you should do is have a plan for what to do if you get a failed letter. So have a look at the GL24 (appeal form) guidance, how to appeal (plenty of stuff on this board) and who you want to approach locally for help (CAB, DIAL, Welfare Rights, etc). You never know you may pass but if not you'll be prepared for what to do next.
  18. No wishface the rule is; If it is within 6 months from the date of the original decision your condition needs to have deteriorated for a new application for ESA to be accepted/considered. If you do not wish to appeal then you can apply for JSA (or any other benefit) if you want to. After 6 months you can just bang in a new claim for the same condition. So if your appeal etc takes longer than 6 months you are free to re-submit exactly the same claim as before. Simple

  20. It's silent because it was an automated dialler. It dials x number of numbers at a time. When you picks up it looks for a free person in a group of people their end for x seconds. If it can't find one free in that time it will hang up as it costs them money to keep you on the line. That's why it's silent.

  22. Hello Quick question please. You have made an audio recording of your medical assessment for benefits, recorded without the other participants knowledge. You also have a 3rd party independent representative who fills in all benefit related forms for you, submits appeals etc. Now a report is produced based on that medical and used to decide benefit entitlements. Would it be legal for me to pass a copy of this recording on to my 3rd party for their use if the report was in some way inaccurate or elements needed refuting? Sorry if that's a bit convoluted but how would that work? Would that be legal? If not how would one go about getting round it?
  23. So can I now say that my hair pre-emptively fell out years ago in preparation for ATOS Just read your ESA50 and make sure you have everything set in your mind. The medical is not stressful at all tbf and since you'll be in your own home it should be quite comfortable for you. Home team advantage The questions on the whole will be very simple do you own/can you/do you? Just be honest and remember to expand you answers where you have to. You may get asked specifics about how things effect you - just respond as above. There is zero point getting in a big tizz about it, as the medical isn't nasty in any way and it will be over very quickly. Take it easy, relax and do the best you can.

By your response I've obviously touched a raw nerve or two? Just because you don't like this view there is no need to abuse the person who suggests it eh? I also have suggested that as well as your problems with UW there is another angle on this with regards to your tenancy and the fact you have more than likely broken it's terms and all that entails. Since it was being suggested that you approach you landlord or letting agent it would be prudent to get the facts on this before it was attempted. I could be wrong here but the landlord could well be within his rights to evict you then charge you for the cost of rectifying this? But hey I'm just a troll
