I spoke to someone at MCOL helpdesk and they said they didn't "think" it was necessary for me to apply for the Particulars of Claim to be amended as it was up to the judge's discretion anyway to do any striking out if YB request it. However, I've done it anyway (dont want to give YB any chance to say I haven't complied with anything or co-operated) and written to the Bank telling them I've done as they requested but that the £35 will be added to the claim. They really are bullies arent they................. Jas

  5. AArgggggh! Just got a letter from Clydesdale Bank in response to my MCOL I did (this was for the joint account I have with Mr Jas) saying that I need to put his name on the claim (and I REALLY thought I had done that) and I have to let them know within 7 days whether I intend to apply to the Court to amend the Particular of Claim, otherwise they will apply to have the claim struck out. I realloy thought I had included him - how do I go about adding him to the claim? Do I have to issue a new MCOL or just amend the one I've started? Is this just delaying tactics by YB or have I really dropped a major clanger? Jas
  6. I filled in my MCOL 2 weeks ago and the Bank have acknowledged service. I;ve had a letter from them today saying: 1. I haven't provided details of the account I "claim" to hold with the bank - eg sort code, account number etc. 2. If I do not provide these details by 26th September they will apply to the Court to have my claim struck out and then claim costs against me. My problem is I did provide these details, with the Prelim letter and the LBA. I filled in the MCOL on line so couldn't include it with that. Am I ok to send to YB the list of charges and my 8% interest or are they referring to something else? Jas
  7. OK, just one last qustion - who do I submit the claim to? Can't send it to Glasgow can I? Whch branch should I send the claim to - the one who has charged me the most? Jas
  8. I have received acknowledgments about the Prelim Letters so I know they have been received. I put all my mail to YB through their letter box personally after the bank is closed (can't get there during working hours as their working hours are the same as mine). I figured it would be quicker than posting by Recorded Delivery. Jas

I haven't had a reply to the LBAs I sent to YB so my question is the following I have one account with Mr. Jas at one branch of YB and anothr two accounts solely in my name at a different branch. All accounts have been subject to penalty charges. Should I do two Moneycaims or just the one? And if it's just the one, should I include Mr. Jas's name on the claim and which branch should I send it to? Jas
  10. Yes I did. They say you only get free banking if you stay in credit. But surely £25 a month is excessive for something purely automated? And some months my charge was £20 and others it was £25. Did they just think of a number? Jas
  11. I got the standard sod off letter from YB this morning so I will be issuing the LBA tomorrow. At least YB have been quick in telling me this and not wasting much more of my time Jas

I'm hand delivering the joint account prelim letter today (it's a a different branch to my other accounts and I didn't want to confuse matters by it being a different branch AND a joint account - too much for YB to handle all at once eh) I'm still waiting for statements on one account but on the two I've got, it comes to £2,200 including interest. I hope YB cave in soon, I have a holiday to pay for at Xmas Jas
  13. I received my bank statements this morning, for the past 6 years. There's one account missing but they say they will send this asap. Do I have to wait for these statements to arrive or can I carry on? Also, one of the accounts they've sent statements for is the joint one with Mr. Jas. Do I hve to treat this as separate? I don't want to get so far down the line and have to start again because he hasn't signed the letter or anything daft. Finaly, going through the Unauthorised Overdraft Charges, which pretty soon mount up, I notice that on the months where I've had the Unauthorised Overdraft Charges, the Bank have also charged me Charges" of between £20 and £25. The months where I've been extremely good have had no charges. Do I include these in my claim/letter? Jas
  14. Last November my husband and I bought a Philips DVD reorder. It worked fine until March when we couldn’t get a disk in or out of the drive and the LCD display said ‘Blocked’. We took it back to Comet and they said they had to send it back to Philips, which they did. It came back after a fortnight and Philips apparently said they had never heard of this fault before and they replaced the unit. In June (7 months after we bought the original machine), this DVD recorder has gone kaput with exactly the same problem (so much for Philips never having heard of this problem). We took it back to Comet and said we didn’t want another Philips DVD recorder as clearly they are rubbish. The manager said that he had to contact Philips to get a code to authorise him to refund our money. We have pointed out that our contract is with the retailer – Comet – but they will not listen to reason and say they have to contact Philips, send the machine back and get a replacement, which we just didn't want now, as we’d prefer a different make. Eventually they sent away our DVD recorder and again another one came back as they can't repair the fault. They will not guarantee the new machine for 12 months - they say it is a 12 month guarantee rom last November when we bought the first one. We're now on our third DVD recorder and with November a few months away I know it will not last till then. When it goes wrong again, what do we do? I really want either a refund or at least a different make. What are our rights? I pointed out that our contract is with the retailer not Philips but they just would not listen!
  15. Sorry I didn't mean to sound so cavalier about fifty quid! Do I send the request to Wrexham or Bolton (which is where to send payments)? And when claiming, do I inclu the £10 its cost me to get details of their charges? Jas
  16. Just a quick question. I'm pretty sure my MBNA account has only had £50 charges (and that was recently - 2 late payment charges). Do MBNA pay up fairly quickly or should I not waste my time pursuing £50? If so , do I write to Chester with a cheque for £10 for my statements? Jas

  18. I have been with YB for 11 years now and got myself in a bit of a mess about 5-6 years ago when they hammered me for charges. I'm in the process of preparing the Data Protection Act letter but have some questions: 1. Do I send the DPA letter to Clydesdale Bank as per the sticky? I know I read it somewhere (on this forum I believe) where someone said they handed their letter into their local branch. 2. The DPA letter, first paragraph sys "Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable." That period? Nowhere does it mention which period I'm referring to 3. My bank account number was changed (something to do with them being unable to stop a direct debit I had authorised and the recipient of the DD and I were in dispute over it) some years ago, probably 5. I have no records at all of that previous account number. If I supply my present account number will they automatically include the previous account once I have defined which period I want the statements for? 4. Can I include my joint bank account or will they want the other account holder's signature? 5. Am I making sense? Jas
