I'm almost sure that I was sent a Notice saying that this debt had been transferred and that Mortimer Clark were now dealing with it and told me to pay them and not Optima legal. so - bottom line, do I have to pay or not? I'm a pensioner and so an attachment of earnings order doesn't frighten me.... The restriction on my deeds says that notice has to be sent to ........ etc. not that it is a secured charge

  3. Help! Today I got the attached letter from Mortimer Clarke. I was under the impression that Mortimer Clarke couldn't enforce the judgment? Is this correct - that they can take me to Court to enforce the judgment? IMG_20210203_0001.pdf

  6. should I start to pay MBNA £20 a month? What will happen if I don't? I understood that if the original credit agreement was produced and signed by me, that I had to pay? Sorry to sound so vague - I should be used to all this by now.....

  8. I defaulted because I couldn't pay. The original debt was for an MBNA credit card. I had to go to Court a few years ago and Optima Legal said I had to pay £20 a month. Then the debt was changed to Mortimer Clarke recently I stopped paying the £20 a month to Optima.
  9. Can anyone help? I've just got a letter from Mortimer Clarke, chasing a debt originally payable to MBNA in 2003. I asked for a copy of the credit agreement and told them not to write to me again until they have it. MBNA originally said they didn't have a copy. Solicitors for MBNA said when I defaulted that they couldn't locate a copy of the original credit agreement which I signed. The copy which Mortimer Clarke has sent me is just a signature page, which shows my name and address, account number, the amount of the debt (which they say is £11,313.14), my signature and hand written date. The copy "agreement" is only just legible. They have also sent me an income and expenditure sheet. I'm 71 and retired. Given that the agreement is dated 2003, I defaulted in 2008 and it's now almost 2021, is this not statue barred? I have been making regular monthly payments of £20 since I went to court in 2010 but cancelled it recently when I heard that my debt had been transferred to Mortimer Clarke. I don't know how I can repay this debt and I'm sick with worry.

  12. I hope I am posting this in the right place. I had a DMP which I cancelled after advice on here (thanks guys). Three debts, all with Yorkshire Bank. Cabot says that they now own all the accounts. I wrote to Cabot with a CCA request and they wrote back saying that they didn't have it but they would try to get it from the OC. Much later, they wrote to me again saying that as they couldn't provide the information I requested, that the debt was unenforceable but they would appreciate my payment as I still owe the money. Since then, I am being contacted several times a week by Cabot and so I wrote to Cabot twice, asking that they contact me by letter only as I do not have the facility to record phone calls. They are still contacting me by phone and letter. The letter offers me a payment plan. They have still not sent me the information I asked for. Is there anything I can do to stop them contacting me? And the debt is still unenforceable, right? Many Thanks

  14. I'm confused??? Unclebulgaria67 said I had no option but to continue the payments so I made the £60 payment they wanted, online. But now you are saying I shouldn't pay? I don't have a CCJ, just a restriction. There is nothing on my credit file about it. It was Optima Legal who took me to Court, not MBNA and Optima Legal are still in existence. If they are true to their word and I have to go back to court, can they place a full charging order against my house, as they have hinted at in their letter? Will I have any defence if I do go to Court? I didn't defend it because I was with Payplan at the time and they told me I had to go to Court as Optima Legal had the right to pursue the debt. Why doesn't anyone check that the "debt" is enforceable and how can I now prove it isn't?

The restriction on the documents from the Land Registry reads " 24.1.2011 RESTRICTION: No disposition of the registered estate other than a disposition by the proprietor of any registered charge registered before the entry of this restriction, is to be registered without a certificate signed by the applicant for registration or their conveyancer that written notice of the disposition was given to MBNA XXXXXXXXXX at care of Optima Legal, Arndale House, Charles Street, Bradford BD1 1UN being the person with the benefit of an interim charging order on the beneficial interest of XXXXX (i.e. me) made by the XXXX County Court on 14 January 2011 (Court Reference xxxxx)" I didn't think to challenge it as I was with Payplan at the time and they told me to go to Court. Uncle Bulgaria67 above seems to think that I have no option to pay it?
  16. No, Payplan decided how much all my creditors got and I wasn't consulted on that.
  17. Help! I've posted before about my debts and had three written off (or almost - they say they aren't enforceable but would appreciate me making further payments!). I have one outstanding for an MBNA credit card. It went to Court quite some time ago and Optima Legal Services got an interim charging order against my property. I wrote to Optima Legal Services in June, asking for documentation which I had signed and received no reply. Then the other day I got this letter (attached) which says that they have not received my payments (I cancelled Payplan and stopped paying some months ago). I sent a CCA request to Optima Legal Services twice, on 29th April and 26th May this year, once to their address shown on the interim charging order and the other to the address I found on Google. This letter I've just got threatens further court proceedings and advise that a full charging order will be put against my house, meaning that the debt has to be repaid in full when I come to sell my house. They want a payment of £60 for the arrears which my wife wants to pay to get rid of them but is this the right thing to do? I've not had any responses to my letters so not sure if I should reply to theirs? Jaz IMG_20171014_0002.pdf
  18. Sorry, I thought I'd hidden my details. Yes, it came direct from the OC. I got nothing from the DCA. No, I have already checked. So MBNA and Yorkshire have no say in what happens with the DCAs? If that's the case, aren't the DCAs stuffed?
  19. I sent a CCA request to the DCA and got no reply. One the suggestion of another CAGGer I sent off a SAR and this is what I got back. There were other documents with it (copy statements etc) but nothing else with my signature on. The SAR was answered within the 40 days, yes.
  20. I tried to upload my Yorkshire Bank document and apparently I don't have the permission. Yet I managed to upload the MBNA one? I have attached the Yorkshire Bank doc here without a problem. IMG_20170701_0005.pdf
  21. I received this following a SAR to MBNA but it's only signed in one place and they haven't sent me anything else with my signature on it. The quality of the copy is very poor too. IMG_20170701_0004.pdf
