  1. I currently owe Barclaycard £10,189, along with a couple of other debts. My uncle has said he will help me out with settlement of all my debts but it's a "settle all or settle none" deal he's put to me. I am in a debt management program with Payplan. Barclaycard have sold my debt on to Cabot Financial Services. I have offered Cabot £4,500 in full and final settlement, which is around 45% of the total I owe (which includes all their charges and ridiculously high interest rate). They have said they will acceot £9,000 then when I said we weren't in the same ball park, they said they'd accept £7,500. They then asked me how much the other creditors would settle for. Is this relevant and should I tell them? They said that my offer of £4,500 was a "starting point" when in fact it was my ending point. I said I would get back to them when I know what the other creditors will acceot but I can't see that that's relevant. How much do debt management companies buy credit card debts for anyway?

I haven't read all of this thread so forgive me if I'm answering something which has already been answered, but under s20A Housing Act 1988 Assured Shorthold Tenants are entitled to a statement from their landlord as to the major terms of their lease, which are mainly to do with rent but your landlord may just supply a copy of the tenancy agreement, which they may find easier.

  4. No, I haven't, Slick. Do I send the "account in dispute" letter before the complaint to the FOS? As I understand, FOS are quite slow?
  5. After three requests, sent by Recorded Delivery, to Barclaycard, they have still not sent me a copy of my agreement. Could someone please advise me what to do next/which letter to send? They are clearly not going to send it!

  7. Update: I've now written to Barclaycard three times, telling them that they haven't actually sent me what I asked for, but merely blank terms and conditions and clearly I'm getting nowhere. They just keep sending me blank T & C saying that this fulfils their obligations. Do I complain to the FOS next? If so, is there a template letter somewhere I can use?
  8. I got a letter back from Barclaycard (outside the time limit but never mind) and have attached a copy of their reply. All they sent was their Terms and Conditions, nothing with my name on or signed by me, which I understand is what a lot of Caggers have received. I am attaching a copy of their letter to me.   10. Thank you very much for your reply. Yes, I can see my naivety now, I just wondered whether it was normal for BC to do this. There are no penalty charges or mis-sold PPI on this account. They did charge me £35 for a late payment 3 years ago but I complained and they refunded it. I will wait now for the copy of my agreement.

  12. I have a Barclaycard, which I took out prior to 2006, although I'm not sure of the exact date. Last Friday I sent off a request to BC for a copy of my agreement and used a template from here. I noticed that the last paragraph of the letter said that I understood that if they could not produce a copy of my agreement, then I believed that my agreement was unenforceable. Just been to Asda and the only card I had on me was my Barclaycard as I picked up that one by mistake. My bill came to £14.84 and my card was declined - twice! Ironically I posted my monthly payment to them last night but it was after the last post was collected. My payment isn't due till the 16th though, so it's not late. Naively, I never thought this might happen as a result of my letter - but is it normal for BC to "cancel" cards once they receive the request for my agreement? Jasmineuk

  15. Forgive me if I sound a bit thick, but I'm not sure I understand the unenforceability thing. If I had, for example, a credit card taken out before 2007, paid loads of interest on the outstanding balance and then the credit card provider couldn't send me a copy of the actual agreement which I signed, does that make the agreement unenforceable in that the debt is written off, or just that they cannot claim the interest? And if I had already paid £££££ in interest, does that mean that they have to repay it to me? And if it's unenforceable, I assume from what I've read on here that although the provider cant enforce the agreement, the amount is still outstanding?
  16. At the top of the "Pre Contract Information" sheet they sent me after I'd signed up, it says "Fixed Sum Loan Agreement". It describes the goods and says it is regulated by the Consumer Credit Act 1974.
  17. today and the finance company (Santander) tell me that I have a personal loan and not a car loan therefore they have no interest in my car. They tell me that I can hand the car back to them at any time but if the car at auction fetches less than the amount owing (highly likely), then I will be liable for the difference. I don't have (never got) a copy of the actual agreement that I signed, just a copy of a document outlining what I borrowed. I'd never have taken out a personal loan from a car dealership - if I'd wanted a personal loan I would have gone to my bank. The dealer I bought my car from knows I always VT my car. Realistically, my car is worth £4250 to a car trader and I currently owe £5544 if I settle within 10 days. Is there ANYTHING I can do to get rid of this car? It's been a bag of s*** since the day I bought it.
  18. You need to see an independent financial adviser or alternatively,just walk into your local Building Society - Abbey, Halifax, etc should all be able to help you. As long as the lender will do a self-certification mortgage, as long a you have an excellent payment history with Derbyshire, you should have no problems. I would try ringing round all the Building Societies first, then if no luck, see an independent financial adviser. Most of the Estate Agents on your local high street will have an in-house financial adviser or PM me if you would like me to recommend one local to me, who would be able to assist. Jas
  19. If you already have a mortgage and haven't defaulted (and have a good credit record) then I would look into re-mortgaging, possibly a self-certification mortgage if they still do them? There may be an Early Repayment Charge but I would see a financial adviser who can give you proper advice. On your earnings you should have no trouble though - do you have audited accounts? Jas
  20. I'm a conveyancer and Derbyshire HL are one of the worst companies to deal with as they are very slow and don't reply to letters. And they ARE affiliated to Kensington Mortgages (who are just as bad) .... Jas
  21. I completed my AQ weeks ago then I got theirs. In it they said they were applying to th Court to have my claim struck out as I didn't include Mr Jas in it. A very helpful lady at the Court advised me to leave it as it was and it was for the Judge to decide if Mr Jas needed to be on the claim, not YB - and the Judge would give me time to do it in any event, not just strike it out. She said they were used to Banks' bullying tactics! Jas
  22. I received a copy of YB's Allocation Questionnaire in which they asked for one month to resolve the dispute, yet they have made no effort to contact me. Presumably this is normal? What is the next step - a hearing date?
