Hiya Thanks for the reply, I think I have attached a scan of the credit agreement they sent me, Further details are as follows: Original lender is capital one, debt is credit card, amount is £398.40 and Capquest have it now. They sent me claim forms back in dec and I replied disputing the amount, I have not heard anything back from the courts or Capquest with regards to the claim forms, however they are quoting the claim ref on this latest letter.

Hi, I'm really hoping someone can give me some advice asap on the next step in my battle with Capquest regarding an old capital one credit card that was opened in 2004. I received a CCJ claim form off Capquest before Christmas and wrote to them asking for a CCA, they took a month to reply and they ignored my further letter which ment that the account was put in dispute in March. Last week I sent them a letter telling them that they were in default of my CCA and starting that the agreement was uninforcable as a result. I receive a letter from them today dated 29th May informing me that they do not legally need to produce a deed of assignment and they were going to go ahead with the claim against me. The also included two CCAs and a statement of payments on the account going back to 2008 (nothing has been made since). I'm not sure where to go from here and am feeling a bit out of my depth now. The CCA includes the terms and conditions but nowhere is there any details of any credit limit or repayment terms. I would be very grateful if someone could advise me on how to respond to this. I'm just starting to build my credit rating up after a very bad few years and do not want a CCJ taking me back down. Thanks in advance Vikki.

I know that i have not aknowledged this since before 2007 but cannot remember when it was last paid. Sorry i know thats not much help :/ The agreement broke down due to us almost loosing our daughter and then being evicted from our home and needing to find somewhere else to live Just a quick update I have not received the CCA request back and its been over 2 weeks since I sent it. We have just recieved a hospital appt for the 16th so im not going to be around till the 18th and my defence needs to be done by the 17th. I assume I can put it in a day or so earlier is that correct? I have not sent any other letters to the DCA, someone mentioned a SAR request but im not sure what that it?. At the moment I can only get on here on my phone so cant open all the links

I sent them the CCA and yes have acknowledged the claim Ive not had any response from them regarding the CCA can soneone please advise me what to do next

Capquest apparently Just confused as if capital one have no record of any account for me or this number, who is going to get the money if it dit did get to court???.

I have just phoned capital one and they have no history of the account or any outstanding debt showing

I have no idea when the last date was or if a default was issued. It was all done a my old address which we left 7 yrs ago. I have not had anything from them since being here.

I sent one a good few years ago but never had any reply. Know I should have chased it up be we had a family death and things went to pot POC details are Part only of monies due under regulated credit agreement number xxxx between capital one bank (Europe) Plc and the defendant the benefit of which was assigned to the claimant on 18-sept-09. The agreement terminated upon the defendant failure to comply with the terms of the agreement

I have no idea what I'm doing with this and how to do it. There is an entry on my credit file for a capital one card for the amount of £398 which was opened on th 26/05/2004 and defaulted on 30/12/2008. We moved into our new house in 2007 so no payments were made since then. This Cajun is for £299.99 with fees it's £364.99. I did have two capital one cards but can't remember how much was owing on the other. Defiantly not made any payments since 2007 though. I think I've sent them cca requests in the past but never heard back from them. We have had a rough few years and it's obviously slipped my mind

15th jan 2014 I've not made payments for at least 6yrs there is a capital one from cap quest on my credit history from 2004 but it's a different amount to the amount on the claim form :/
