  1. I will try and find them. It wont of changed since then I dont think. What will happen regarding the default and the £1 markers?. I presume the default will go but the balance will still be visible? Say if at present it says DDDDD and 605 604 603 602 601 etc will it just show the balance and not say that it was defaulted or if I can settle it will just say setled?. I know I got my head around this a few years back, just a bit rusty now.
  2. It is on there, default date is 06/05/2011. Makes no difference though as I have one from August 2011 also.
  3. Simple terms: Lloyds overdraft, defaulted mid 2011 balance around £600. Had a claim open for bank charges on same account which I was hoping might of cleared the od was of course declined with court ruling. Had been paying Lloyds £1 a month till 12 months ago when I moved from HSBC to Santander, have not paid since. Lloyds have now passed debt to Cabot who are telling me they will accept an offer. I am absolutely in no position to repay at more than £1 a month, self employed, private renter, skint... but could maybe pull a bit together in order to get them off my back. Now considering the debt is made up i'd say of mostly bank charges at some point between 1996 and 2008 when I banked with them how much would be a reasonable offer?. Otherwise its a pound a month for the next 20 years. I was thinking of going in really low, like 10% which is now about £58. Any advice would be appreciated. I know the numbers are all pretty small really and not enough for me to lose and sleep over but it would just be nice to get this out the way if possible. Ps have debt collectors gone soft?, the tone of all letters compared to 5 years ago is very gentle.

Right, they have agreed to it but it will be started as a new tenancy so will be some expense which I cant get out of although they are not credit searching or referencing me which is good and I guess long term having the agreement in my name is a good thing. Cant be kept in my brothers name as its a term of his housing association house although they understand there is an overlap. We get our original deposit etc back which is great but I have to pay it again which is not so great as its 2 1/2 months rent. There is a £400 holding deposit which I gather comes back providing I sign. Tenancy Agreement £300.00 - I guess this is the set up fee, seems to be the going rate give or take. Administration Fee @ £60.00pp £60.00 - Hmm??? Check In Fee £60.00 - Surely questionable considering im already here??? Either way im pleased with this, the plan is to pay the rent monthly into a savings account so it can be paid again in 6 months and even earn a bit of interest along the way. My credit history will clean up in the next 18 months and hopefully I can look into buying.

Landlords totally happy with me staying here on my own but has asked me to deal with the agents who are saying I need to prove a pretty huge amount of income which I cant so they said I need a guarantor which is not an option wither. The people that I could of asked have retired. My only other option which they did not mention is to pay in advance. My dads got enough spare to pay 3, 6 or even 12 months upfront but I guess what i'm wondering is are they a. Likely to accept? and b. Are there any risks from my point? Stressing me out, need a beer or 3.

I will have a chat with the landlord and see what he thinks, i'm pretty sure he wont want to do it privately as I mentioned it years ago and I got the impression that he hasnt got the time nor cant really be bothered with the hassle but then I think he will also be fine with me staying on my own. I know it was his wives place originally and she dealt with us but she unfortunately passed away a few years back, he's more your blue collar worker.
  7. Basically me and my brother have been renting together a few years, made financial sense and we get on well. It is through an agent. He has since had a child(hes not with the mother but they get on) and he has been on the housing association list for a while as he wants to be able to have his son staying over etc. He's over every weekend anyway but stays at my dads. Last week he was accepted for a 2 bedroom flat with the housing association and is going to accept it so will wish to leave shortly. This leaves me in a tricky situation as I would like to stay here, it is his name on the tennancy and he obviously cant stay on it. The reason we went with his name was that I had a lot of recentish adverse credit + was self employed(this was over 5 years ago). I am still self employed and still have some adverse credit but its at the back end of the 6 years, some have already dropped off. The only recent things I have are an ee account which is spotless for 3 years. I believe they probably didnt even check me in any way. I do deal with the agents as much as my brother though if not more + pay half of the rent from my bank. Does anyone know what might happen in such a situation?,we are I believe here till October ie they charge £100 or so renewal fee(excessive I know). I know I can afford to keep the place on my own but again with the knowledge of how agents work I have a feeling I might have to go through all the application etc again. More £££, risk of credit fail and dificulty proving income again. Part of me thinks surely they could swap the names in the knowledge weve always paid without issue and in 5 years only had a washing machine repaired, bathroom floor replaced(due to damp) and a toilet flusher so we are low maintenance. I do know the landlord as he is a friend of my dads if that makes any difference. I presume its in their interest to keep me in as long as the rents flowing, + they still have the deposit + rent advance. I was thinking of maybe saying see where we are in October when the "renewal" comes up. Any views would be appreicated.

Just something I wrote myself above. 12th April 2010 14:35 #22 Craigbadger Basic Account Holder Cagger since : Oct 2009 Posts : 666 (0.28 post per day) Wheres my damn default notice or are Capital one resptecting my dispute? 13 weeks no payment, £1200 arrears but no default notice. They sent me one in Jan for £412 which was removed as it was paid within 14 days and nothing was ever added to my credit history. I have put the account into dispute on grounds of dodgy cca and they never responded. Is this normal or is there a chance theyve messed something up or actually respecting my dispute?. Nothing on my record and they updated it 6 weeks ago showing 2 months arrears. I guess its a matter of waiting(which is the bad bit). Be curious to get opinions though considering the first notice came after 1 missed payment and being over limit a bit for a few months.

  11. I have only ever sent one CCA for this account which would be early 2010. Capital one sent me the typical unenforcable sheet with seperate terms, I disputed it and they wrote back saying they could not enforce it but it was still owed then its just been passed around. No I have not CCA'd Lowells. Reading the letter they want a response by the 17th of March so i'm going to wait till the 15th and send a CCA, hopefully that will be enough to get us close.
  12. ive got to letter 3 from Lowell after a few years silence on this account and I know this is near enough statute barred. Are they likely to know this and put in a last second claim as the letters are getting more threatening? Have checked noddle and the default date is early May 2010 so my gut instinct is that ive not paid since maybe Jan or Feb 2010 but for the benefit of doubt im considering it as May. I know the agreement in unenforceable and Capital one admitted as much in 2010 but I cant find the damn letter. Its one of those sheets of paper with a signature in the middle. I just ideally dont want to have to go through the hassle of court again . I was wondering if maybe I should cca them again to just delay things or just keep quiet and hope it passes? Its a large debt but I like think that irelevant given the lack of enforceable paperwork.
  13. I just rang them and they said to send a letter and £10 to my nearest branch(which is now not that local) requesting which statements I need and they will post them me within 5 days. Seems simple enough. I'll just drop a letter with a £10 note in the post.
  14. No, one was literally closed june this year and the other the year before. I only need 13 months worth of statements. I was doing online only through that period so didn't ever have statements.

  16. Just doing my tax return and need to check a few things. In order to do so I need statements for a couple of closed accounts with hsbc. Now I only need the statements and nothing else and I know it would take them a long time to compile a SAR while I imagine statements could be done very quick. I have no local branch now so any ideas what to request would be appreciated.
  17. Well 6 weeks later I got another letter giving me 2 months notice to close my account and move on. I suspect it was business use. Have since opened a business account with Santander and a Cahminder with Co-op. Being extremely careful and looking after everything and keeping things in order. Strange no doubt.
  18. Just reading online about accounts being shut. A lot seem to end up with markers. I don't know specifically why its being shut just t&c.
  19. Fingers crossed then. I did check experian last night and they have done an unrecorded search before emailing the above which I presume is a good thing. Also I notice Co-op did a couple as well so would be fair to presume they found the application form so fingers crossed. Something I was slightly concerned about. Ive read all sorts of horror stories about fraud markers getting in the way at a later point. I'm fairly sure my hsbc account was shut for breaking t&c which I presume is down to using for business. If it was anything more than t&c or just me not earning them money etc would they of just shut me immediately?.
  20. Basically I had a hsbc business account which I shut due to the fact I slowed trading for for a while. Started to use my personal account for a bit and then a lot of business subsequently got asked to leave for breaking t&c. Left me without an account, 7 defaults and 3 arrangements on my credit history in the last 6 years. Ive put in an application with Coop for a cash minder, they seem to of lost my application in branch which is a pain. Had a look at the bank groups and basically hsbc aside I had history with all except Santander, figured I had nothing to lose by putting in an application for a business account. Went basic no overdrafts, loans etc. Had an email off them yesterday with a questionnaire which I completed honestly, emailed it back then today received this. "Thank you for choosing Santander Business Banking. We’re pleased to let you know that your Business Current Account is now open and ready for you to use. What’s next? In the next 7 – 10 days we’ll send your card, card PIN, Online Banking passcode and registration number separately (for security purposes) to the home address you gave us." Is that it?, I've been accepted?, can I have a beer to celebrate? or is there something that can go wrong from here?. Other than my credit history I have no other skeletons in my closet or anything. I know all banks are as bad as the other but I did not expect to get a highstreet account in a million years with my account history. I was thinking best case I get a cash minder and a pre pay. I had a large loan and Credit card with Abbey national which were paid in about 2007 but did reclaim a lot of ppi.
  21. Also make sure you are on the electoral roll as although they don't do credit checks they do ID checks. As you say there is an issue make sure that is sorted. I know its an old thread but just incase someone else reads this.
  22. Yeah I think i'll keep it, I didn't really get myself a birthday present. Its just one of these all in one things with the printer also and its wireless so I won't have to keep taking the laptop upstairs to print things off
  23. today I have received a Notice Of Discontinuance. Its 5 days before my witness statement is due and typically I spent £50 on ordering a new scanner this morning(before the post came) to scan all the documents in. I just want to know if I should still complete witness statement? Just to make sure I've done everything as instructed. Im absolutely buzzing, when the letter came I knew it was either this or a witness statement, massive adrenalin rush while opening the envelope and its just amazing. Although I hadn't been stressing about it too badly there was just a massive weight lifted off my shoulders almost instantly. Thanks everyone for the support, i'll certainly be making a donation.
