  1. Its all legit. I had the same and got a nice refund. The tax is on the interest and can be reclaimed by a non tax payer.
  2. FiL has received the attached letter. Assume do nothing for the time being. Also attached is an article form the local paper. AC Parking article.pdf PCN letter 0002.pdf AC PCN Letter_0001.pdf
  3. F-i-L went back to get photos and they have replaced the signs. # The white marks above the sign are where the old signs were. also see this link from the local paper http://www.yellowad.co.uk/article.cfm?id=135702&headline=EXCLUSIVE:%20Basildon%20Westgate%20car%20park%20management%20company%20says%20it%20is%20%27not%20happy%20with%27%20parking%20firm%20behind%20controversial%20fines&sectionIs=News&searchyear=2018 Westgate Parking Notice.pdf
  4. 1 Date of the infringement - 22/09/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 01/10/2018 3 Date received - 04/10/2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] - N 5 Is there any photographic evidence of the event? -yes, 2 very dark pictures of the number plate 6 Have you appealed? {y/n?] - N Have you had a response? [Y/N?] N/A 7 Who is the parking company? - Smart Parking 8. Where exactly [carpark name and town] - Westgate Retail Park Surface Car Park, Basildon For either option, does it say which appeals body they operate under. - POPLA (IAS) There are two official bodies, the BPA and the IAS. Father in Law went back to check signage as soon as he received the PCN and all the signs had been removed.
  5. Father in Law received the PCN (speculative invoice) through the post. The date of the alleged offence was 22/09/18, date of PCN 01/10/18. Interesting scenario. In Laws are Blue Badge holders and have used the car park before with no issues. They remember seeing signs on the wall saying where disabled parking were and parked there. When the PCN came through they went back to check signage to find they have all been removed. Interesting article from their local paper about the car park. Article and redacted PCN attached. I assume usual procedure of ignore! Article from paper.pdf PCN 2.pdf PCN 1.pdf
  6. Friend of mine received a call like this and agreed she had an accident whilst driving her husbands car. They got all excited and started to go through the process. So the accident was wife driving husbands car hit her car driven by husband on their drive. This confused them as they were now not sure if you could claim from your own insurer whilst insured with another insurer. Had them going for a good 20 minutes on speakerphone in the office. They eventually hung up. Not productive but a bit of fun that stopped them hassling others for a while.
  7. So they have given a ticket when they can't prove the alleged offence and have an incorrect location. I assume that this is easily defendable, if it comes to that.
  8. Not sure how relevant but checking the address given on the ticket I have noticed it is wrong. There is not a road called 'Oldchurch', this is the area (name of hospital that used to be on the site). The road relating to the postcode is totally different. To add to the above. I have had a good look at the photos on the NTK. Even zoomed in you cannot tell whether or not there is anything on the dashboard as they are too dark.
  9. What would be the next move. I assume a letter may need to go out or just ignore still.
  10. NTK now received and attached Sorry. Now as pdf's Parking letter 2.pdf Parking letter 1.pdf
  11. Sorry for not being in touch earlier, been away for a few days. What is the key information that the ticket requires - not doubting you just trying to get me head round it. Checked with the driver and she claims that she could not read the signs clearly without getting out of the car.
  12. For the sake of 6 weeks just let it run to renewal then cancel. As long as you are not claiming there will not be a problem.
  13. The ticket was scanned at its normal size. I no longer have the original but will try to enlarge the scanned copy I have.
  14. Hi Dragonfly, She doesn't live there but was visiting friends and they gave her the permit to use (none of them have a car so she uses it a lot). Its quite a new housing estate and there are not enough parking spaces for the properties and the permits go along with the property. Her friends are renting the property and the parking permit comes as part of the rental agreement. I've been there myself when visiting clients and it is a nightmare as there are no visitor parking spaces.
  15. 1 The date of infringement? 26/07/18 2 Have you yet appealed to the parking company yet? [Y/N?] N if you have then please post up whatever you sent and how you sent it and the date you sent it, suitably redacted. [as a PDF- follow the upload guide has there been a response? please post it up as well, suitably redacted. [as a PDF- follow the upload guide] If you haven't appealed yet - ,......... have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] N/A at the moment what date is on it Did the NTK provide photographic evidence? 3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] 4 If you appealed after receiving the NTK, did the parking company give you any information regarding the further appeals process? [it is well known that parking companies will reject any appeal whatever the circumstances] 5 Who is the parking company? Park Direct 6. where exactly [Carpark name and town] did you park? Oldchurch, RM7 0FS - This is an underground garage on a private housing estate
  16. Friends daughter has received a ticket for 'failing to clearly display a valid parking permit'. It is permit controlled parking for an underground car park. She had the permit on display but feels that it may have been the wrong way up. Do we wait for them to write to her asking who the driver was.
  17. Hi All, Just an update. As suggested it was complicated due to the finance and V5 being in the name of the limited company. Well all solved now as the van has been repo'ed with about £500 owing. Unfortunately due the Ltd company being dissolved they would not take payment - should have been done prior to dissolve (words with accountant I think). Friend not too fussed as van had over 100k on the clock and was starting to cost money. Also found out that the van had a charge against it due to unpaid parking fines - all in the name of the Ltd Co - hopefully these will now disappear as they are in the name of the company.
  18. The company was voluntarily closed as no longer needed to be Ltd, doing same job but as sole trader. The accountant that dissolved the company should have sorted this at the time. There were no debts, other than the van. It was only dissolved last year and closing accounts have not been produced yet as far as I know. I guess he could buy the van from the company for the value of the outstanding finance and clear the loan, or clear the loan and just change the V5 to personal name.
