  1. Unfortunately Ebay won’t want to know as you’re out of time for both a PayPal and SNAD dispute. If the seller is a business you have come back, email them and tell them what the problem is and remind them of their obligations under the SOGA. If they’re a private seller there is little you can do.

Ebay has been going down the pan for quite a while now, I used to make quite a good living from ebay doing it in my spare time, it helped pay for a house lol but now I would never touch it to sell anything valuable. It seems you were given very wrong information with regards to giving a refund minus damages. You have to accept returns, ebay will force you to accept them if the case goes against you and if the item comes back damaged you appeal the case. Its best to accept the return and appeal once you have your item back, at least you’ll have your final value fees refunded. It’s true they almost always find in the buyers favour but a few times before I closed my selling account in 2011 I had cases go in my favour ONLY because the buyer had dropped themselves in it telling lies in messages and contradicting themselves, a couple even admitted replacing parts. Its upto you whether you continue selling on ebay, it’s only going to get worse with ebay Tony grinning at the bottom of every page but here’s a tip, never sell anything on ebay you can’t afford to lose.
  3. Isn’t Extak a spin off from WAE+ ? This sounds like something WAE would do, I know a few people who were told to pursue a refund from their card provider in more or less exactly the same circumstances, unfortunately one was told to pay by bank transfer and didn’t receive a penny refund before they went under. I just hope the op paid using a card and not a bank transfer.
  4. Sounds about right for Ebuyer, I recently commented on a thread further down the page outlining the dangers of returning stuff older than 6 months to Ebuyer. I was in the exact situation as yourself, promised a replacement on the phone and fobbed off with a partial refund once they had the item back. Seems to be happening a lot more these days with Ebuyer. Get onto your bank and don’t let them get away with it.
  5. Since it will only cost the op £25 to repair it himself, doing this is the lesser of two evils. Its all well and good quoting the SOGA but if the op was to return it to Ebuyer they would only receive a partial refund, a refund minus 13 months use which could possibly be less than 40% of the original value. Ebuyer will not repair it. There are a few threads on here telling similar stories, including mine.
  6. I doubt it unfortunately. They don’t take much interest in ebay cases, even when there is blatant evidence of fraud.
  7. Firstly ebuyer will NOT replace or refund (in full) an item over 6 months old. Don’t make the mistake I did with my iPad last October, it was 7 months old and developed a fault. They accepted the return and said I would receive a direct replacement only to be fobbed off with a proportionate refund (70% of purchase price) once they receive it back, they sneakily changed my return request from direct replacement to refund. If you still have your tablet in my opinion you should pay to have it repaired yourself, if you return it to ebuyer they won’t repair it despite what they might tell you and in the end you be left with a fraction of what you paid and no tablet.
  8. Like above, you should only refund your buyer once you’ve received your item back, never before. Sorry to say this but ebay won’t help you. If you don’t receive it back there is little you can do other than go down the small claims route.
  9. I bet the e-cig has a little lithium polymer battery in it……..nasty things they are. I’ve had two high capacity batteries from a rc plane blow up on me, admittedly they were bought from china and didn’t have protection built into them and went off like a fire bomb. If you over charge them they blow, if you over discharge them they blow lol.

  11. You’ve found out the hard way how unsafe PayPal can be for sellers. Seems suspicious why someone would want to insist on paying using their sisters PayPal account on a collection item listed on Pre-Loved. Well done for cancelling the direct debit and the card you had on file so they can’t help themselves. Pity you didn’t have the buyers address, I’d be straight round demanding my goods back! As said above a crime reference number usually makes DCA’s run a mile when it comes to PayPal debts. If not there’s not a lot they can do except make empty threats.
  12. Unfortunately you are responsible, buyers can open a SNAD dispute and receive a refund upto 45 days after the sale date. I take it you got though to a foreign call centre? Ebays Manilla call centre staff are a joke that’s not even funny. They often, if not always give out misleading or totally wrong information. They told you the case would be found in your favour when 99.99% of the time SNAD disputes are always found in the buyers favour. They’ll say anything to get you off the phone. Phone back and try to get the Dublin call centre, its totally random but phoning early morning usually helps. They’re actually very helpful. On the plus side, if they don’t send it back tracked you don’t have to refund.
  13. Welcome to the wonderful world of ebay! If your buyer has sent messages admitting they have received the item though ebay’s messaging system phone customer services and point this out, they can read private messages. When you phone try to get an Irish accent. If you get through to the Philippines just put the phone down and keep trying to get though to the Irish call centre, phoning early morning usually works.
  14. I recently had a PayPal email notification stating I had paid Skype £30odd. It was the best phishing email I have seen to date. It had my name in it and everything looked legit, compared it to an actual PayPal email and it was identical. It wasn’t until I hovered over the links and I found out it was a fake, and then I released it came to the email address not linked to my PayPal account lol.
  15. As for sending an empty tracked envelope, it won’t work for two reasons. Firstly the weight/cost would be shown on the envelope, an empty envelope would weigh considerably less than say a mac book or iPhone. Secondly the buyer can change an item not received case to a significantly not as described case. If you send an empty tracked envelope you’re just going to cause more aggro. I’m not 100% sure but I don’t think PayPal debts can adversely affect your credit rating but I’m not sure. I doubt any DCA will take this very far, as you said once you mentioned police and crime number they say it was going back to paypal….hot brick anyone? lol As said above, and I’ve said it myself one zillion times use Gumtree to sell expensive items and insist on cash on collection.
  16. While Hammy is technically right, PayPal are in the wrong on this. In my opinion if anyone should be out of pocket it’s the person who let a fraudster use and abuse their eBay/PayPal account either knowingly or not, ignorance is no excuse. Ebay know sellers are left open to this kind of fraud but won’t do anything to stop it.
  17. You should have rejected it outright when you found the damage on delivery. Since you have admitted to the seller that someone has repaired it could this not be classed as accepting the goods? I think the seller has been quite reasonable upto a point, giving you a partial refund for a friend of a friend repairing it without giving the seller a chance to rectify the issue first. To me it seems like a long time to wait.
  18. I wouldn’t be bothered either if I’m honest, id rather have my ebay account suspended than be conned out of £400. Apple stuff is like a magnet for fraudster’s on ebay. There is a good chance ebay will suspend your account and all those associated with you so you better warn your brother.
  19. I use ebay quite a lot for selling but over the past couple of years I’ve stopped selling expensive items due to the risk. I’ve had negative feedback a number of times for refusing PayPal on collection items, a few non performing seller reports too just for trying to protect myself. As you say you can’t remove any bank account details I would inform your bank to stop all direct debits to eBay/PayPal. Even though you have a crime number don’t expect PayPal to help you, it’s down to you in their eyes and you probably got hit with a £17ish surcharge if it was a chargeback. I was following a thread on the ebay sellers forum regarding a similar situation, even the pinks (ebay staff) were involved and despite the police recovering the stolen property and making a couple of arrests ebay did nothing and the police didn’t pursue it due to PayPal not cooperating, though the seller got their goods back after a couple of months. Has ebay suspended your account yet? Do other people at your address have different ebay accounts? If they do and ebay suspend your account due to the negative balance they will also suspend every account at your address and the accounts of anyone who has logged into ebay on your computer, ebay are very good at linking accounts using addresses, IP addresses, cookies etc.
  20. I recently had dealings (last November) with ebuyer’s “customer support” and it was atrocious, both by phone and snail mail. Actually it was worse than Comet in my opinion. They have a very confrontational attitude and they are very inconsistent. It’s even worse when they send you an incomplete order with an item missing from the box. I know where you’re coming from with this. As for YODEL they are renowned for doing this and I have first hand experience. We used them regularly until last year when we had 5 items go missing in the space of a month. 2 just vanished after being collected and 3 were left in a “safe place” and then vanished. I would go to the police regarding the YODEL driver if he is harassing you. By the way he’s acting he knows he’s done wrong, either by stealing it or leaving it outside unattended. I don’t know where or how you can leave a large screen TV outside in a safe place even if it is a communal entrance.
  21. Was this an Ebay purchase? If it was you might run into difficulty. As far as ebay are concerned your seller has done everything by the book, delivered it to your (incorrect) registered Paypal address and sent it tracked. Since its showing as signed for you wouldn’t win an item not received case. If it’s not an ebay purchase I think the same rules will still apply with PayPal, if it’s showing as signed for there is little you can do. Maybe pop round to the address it was delivered to and ask for it. Did you fund the PayPal payment using a Debit or Credit Card as they might be able to help. Still though, if the seller was informed beforehand there’s no excuse.
  22. You should hope your phone is not sent to SBE (T-Mobile/EE’s repair centre) Just over a year ago I had my mint x6 repaired by them and they ruined the phone. It came back twice with the same fault, when it came back the third time it was wrecked, scratched, scuffed with bits missing. Their customer services (SBE) didn’t want to know and eventually T-Mobile replaced the handset after being sent before and after pics.
  23. I was once told this by trading standards during a battle with Comet over a faulty in warranty TV. They said that if Comet couldn’t repair it they could only replace it with a used TV of similar age and not new. Again late last year, Ebuyer only partially refunded me for a faulty in warranty iPad, deducting 8 months use from the refund. This was despite me having written proof from Apple that it was a manufacturing defect. As others have said you’ll be lucky to walk away with anything after all this time. Move on, you could replace it for a far better spec’d machine now for £250.
  24. I had SNAD dispute opened up against me last year. I sold a Laptop as faulty and the buyer was disappointed it was as I described it – dead lol. He tried everything to extort money from me but refused to return it, he eventually opened up a dispute and lost as he had mentioned in the messages he sent me he’d removed parts and ebay noted this, so there is some hope lol. If your buyer flat out refuses to return it and only wants a partial or a full refund without returning he won’t get very far with ebay, they’ll require him return it tracked for a full refund. No return, no refund simples. Also if it’s not sent back recorded/tracked and it goes missing they’ll lose the dispute, if its not sent back within a specific time frame they’ll also lose the dispute ….. keep that in mind.
  25. Well it won’t go against you if ebay can see the messages you’ve sent your buyer. For me messages have been acting up since last Wednesday but I have read ebay have been tweaking possibly causing the message issues. By the sounds of it you have an awkward buyer on your hands, they might be angling for a partial refund to exploit the unmentioned damage. I would brace yourself as the case will more than likely be found in the buyers favour, finding you at fault. Like I said before all they can do is ask the buyer to return it for a refund, actually since its sub £100 they might issue a no fault refund to your buyer, finding neither of you at fault and paying them out of their own pockets. Its not worth getting stressed over, they’ve done all the damage they can to your account leaving you negative feedback and probably low star ratings. At this stage I might be wise to accept the Phone back before its escalated, if ebay find in the buyers favour (99% certainty) it’s a black mark against your selling account. The system is shocking and very one sided, I’ve scaled back using ebay myself especially for valuable items as its too risky. I wouldn’t close your account over this, you can’t anyway if you have active disputes.
