  1. Yeah that sounds about right. I had my first brain haemorrhage in 2007 and that took me 2 years to recover from. Then I had a few years of stressful events, so my first post being in 2012 does sound about right. I don't think I have ever posted anything regarding this debt in another post somewhere. I think the first time I mentioned it was the beginning of this thread when I needed help/advice. Sorry, I feel like I'm not being at all helpful here
  2. There is nothing in the paperwork they have sent me that relates to a charges complaint, only what I have written already. Back in 1999 I didn't even know how to use a computer so sadly there isn't anything stored there. I did have another username on here, LilMissMoosh, but I think one of the Site Team either merged the two accounts or just closed the LilMissMoosh one. It's hard remembering things and the more I try to remember, the harder it gets
  3. No all they have sent me is a few pages of transactions and some screenshots of their system which don't show dates or anything so don't really mean anything to me. Is there any way I can send you images of what they have sent? You might be able to make more sense of it than me. Sorry for being a bit thick :/
  4. Ok this has got me even more confused now! I have gone through the statement that they have sent me , which starts at 31/12/2006 and ends at 13/12/2007 I have added up all the "Unauthorised overdraft charges" and the "Unpaid direct debit charges" and it comes to a total of £420. There are other fees such as interest charged while account overdrawn which range from £4.81 to £19.52
  5. I just want to pay it off. I need it off my back, it's really making me ill The set aside, yeah I haven't done that. Completely forgot about that. I'd actually forgotten about all of this to be honest. My brother has lost his eyesight and came to live with me recently so that has taken over everything. It was only when he asked me last night how this particular issue was going that I remembered, "Oh yeah, I still have to deal with that" I'm assuming it is now too late to do the set aside? And even if I do manage to get it set aside, what's the point if I'm still just going to have to pay it back?
  6. The last use by myself was a cash withdrawl from a cash machine. The next entry is "Account closed contact collections and recoveries". And yes I do believe it is bank charges, that rings a bit of a bell with me. As it is now looking like the account wasn't SB'd and I do owe the money I am going to contact them to offer a payment of £100 per month. I do not want bailiffs coming to my house, especially now I have my recently blinded brother living with me, I simply can't handle that kind of stress. My question to you is, should I contact them by telephone or put it in writing or email? And do you think £100 a month is a reasonable offer?
  7. today received the documents from Santander. There are 16 pages in total, some showing screenshots and a few which looks to be a kind of bank statement type of thing. The last time I personally used the account was on 11/04/2007 and the account was closed with the description "Account closed contact collections and recoveries" on 13/12/2007 with a balance of £1523.00. There is nothing regarding CapQuest and no further action on the account after 2007. There are no letters to say the account is being sold to CapQuest and no letters from CapQuest to the bank. So it looks like nothing happened between 2007 and 2011, when I started paying CapQuest as per my original post.
  8. Do I have to contact the solicitors to make an arrangement to pay? Or can I phone HMRC?
  9. To be honest the majority of the stuff they have sent me is screenshots of their computer system, some of which has no info at all. There are only the three letters mentioned in this thread in with the bundle of papers. I will keep looking though. Thank you dx x
  10. The only correspondence after that letter of theirs dated 25/03/14 (the letter in post #1) is my letter to them dated 09/06/14 which was querying the Notice to Pay I had received. Their next letter to me after that was the one dated 19/09/14 saying I need to pay back £293.88. I think by that point it had been passed over to LCS and they told me I owe £1088.96. The information in post #16 is from screenshots of their computer system.

  13. From their files dated 25/03/14: "The O/P for 11/12 occurred due to increased income. T he award of £1313.73 was made based on household income of £9833.00. The appl told us this income on 28/06/11. The appl then told us that her correct income was £11821.00. We then used the lower CY of £11503.00. This reduced the entitlement to £628.03. T he appl received more than the new lower entitlement amount. HMRC met all resp therefore this overpayment is fully recoverable. Advised more imform required for possible exceptional circs. The O/P for 12/13 occured because the provisional payments were made based on household income of £9833.00. The appl returned the s17 and told us the correct income was £11821.00 which reduced the entitlement to £509.19. The appl had already received more in prov payments. HMRC met all resp therefore this overpayment is fully recoverable." From their files dated 18-09-14: "Decision/Overpayment reason(s) - Overpayment review 12-13. Post receivevd 10-06-14. Previous deision 2-06-14 overturned. Part remit 131.76 as we rec'd income via s17 on 30/07/12 not amended till 26-10-12. Part rec £293.88 due to inc increase on initial award." There is a letter dated 19th September 2014 from HMRC, which I have posted already, saying Thank you for contacting us about your tax credits overpayment. You have asked us to consider if you should have to pay it back. I am sorry for the delay in replying. I have looked at the information that you have given us. Because you were unable to meet your responsibilities under our Code of Practice 26, you do not have to pay back £131.76. This is the money we overpaid you between July to October 2012. You need to pay back £293.88. This is because we paid you too much tax credits. T e reason we paid you to much for this tax year was because we paid you more than you were entitled to in provisional payments at the start of the tax year. We based your provisional payments for 2012-2013 on your estimated income of £9,833 for 2011-2012. The annual declaration you sent us in July 2012 confirmed that your actual annual income for 2011-2012 was £11,821. We used the income figure you gave us in July 2012 to work out your actual entitlement for which was £501.19. Because we had already paid you £926.83 in provisional payments, this meant that we had paid you £293.88 too much. In a letter from HMRC prior to that, dated 25/03/14 they say: "We have recovered £21.38 of your overpayments in 2011-2012 from other years by reducing your ongoing tax credit payments. You still need to pay back £663.32 from your future awards. If the award with the overpayment ends, we will ask you to pay back any outstanding money direct to us. You still need to pay back the overpayment of £425.64 from 2012-2013 from your future awards." My head is battered with all this! I think I should take it to the CAB get someone experienced to look through it all.

  15. I have received a lot of paperwork from HMRC re: my SAR...going to start reading through it now. Is there anything in particular I should be looking for?
  16. I did not enclose a copy of my current CT bill with the original letter, I will send one with the letter tomorrow. What is an N244? Is this something I should have done? Is this the thing with the £200 fee or something like that? If so, I haven't done one of those because I don't have £200 spare.
  17. I think so. I have a street name and postcode but no house number. I don't even know what years I lived at that address for. And now that I have this court judgement thingy against me, bailiffs are a very real threat, something I have dreaded from day one. I just don't know what to do for the best. This has been going on for so long now and I am in a worse position than when it all started (with CapQuest). I don't know how I would be able to find out where I lived in 1999. Why don't the bank or CapQuest have this information already? I'm just going round and round in circles and now this, having to write to them again with an address that I might have lived in in 1999. Why can't they talk to me on the phone? I explained my medical history. But no, has to be in writing. What if that address isn't the right one? Where do I go from there? More letter writing and more time for the bailiffs to arrive at my door. And I'm sorry for swearing in my previous post x I honestly feel like I'm tied up in knots

  19. I have phoned Santander and explained my situation gave them a possible address for where I was living in 1999 and their response was simply to "put it in writing". I asked her if I could speak with someone over the phone regarding this and she said "unfortunately no, it needs to be put in writing".

  22. I can sort of remember partial addresses, but I have no idea when I lived at them. I am going to speak with my Mum later and see if she can shed any light on it. If she can help me then I am going to ring the lady at Santander who sent me the letter and just explain my situation to her.
