You will now recieve a letter saying we are still trying to locate the agreement but in the meantime we offer you a reduced price on the alleged debt you have x amount of time to accept this offer. This means there is no agreement or the OC is stalling or being slow or just will not provide the agreement . Then you will hopefully receive the goodbye letter from Lowells.

I heard from someone i know that if you defend they will back down as it is a "breach of contract" this maybe wrong but at the time I was pretty convinced he was right.

I am sure I have heard of this before on this forum but the letter is signed by a Kevin Allmark (account review manager) he is new on the Lowells scene. stinks of pure desperation. -

I have noticed they have doctored tampered with the application form to make it look like and agreement, they have added my name and address at the top of the agreement and they have added credit agreement near the signiture box. My question is am I able to go to the police about this as far as I am concerned this is fraud it obviously doctored -

Hi To me it just looks like a standard threatogram to frighten and intimidate you. Have you sent off a CCA request yet if not do it ASAP. They are so automated that they cannot differentiate between those who they can make bankrupt those who they can issue charging orders against etc they just send the same bump to all and sundry as it were please try not to worry too much -

Agree with Hillards Egg rarely provide enforceable CCAs lets see what you show us then we can tell you if its enforceable or not -

I am in litigation with Black Horse. They took me to court on a disputed account that was with the FOS like you said earlier they can carry on with debt collection as normal even if it is in dispute. The only person that might frown upon it is a judge, as when Black Horse were pressed by myself and the FOS Black Horse requested a stay until the outcome which the court readly accepted, the FOS did write to Black Horse to ask them to stop action until their decsion but Black Horse rejected this, it was only until I wrote to them and copied it to the Court Manager that they decided to postpone the litigation. But the truth is they wil carry on regardless they have no respect for peoples rights or the law as far as financial insitutions are concerned, money is the the law and thats all that counts. -
Hi Read your thread If you dont pay it will affect your credit rating. All you need to do if you have sent off the CCA requests is wait for them to reply no point in sending any more letters why remind them of their obligation?, ignore any automated threats they send out. Resnd the MBNA CCA to the corect address with a copy of the postal order receipt which you should always keep then wait for a response, the ball is in their court now all you can do is wait.

What gets me is that when a law is passed the man in the street respects and abides by it and is punished suitably if they flout it example the smoking ban, but companies, banks shops etc etc just carry on as normal with no comebqack or punishment, thats why we are in the state we are in now, its almost like corporate anarchy! -

Fear not of the Leeds Losers. My wife had an account card that was financed by Creation, it was passed onto Lowells, Red and the Happy Hamptons, but they could not find an agreement, the third time they could not find agreements and the 4th one they sent was unreadable, no prescribed terms and no T&Cs. The Leeds Losers are easily dispatched -
AIC will ignore your letters and send you a standard "threatogram" saying that the wrath of the gods will come crashing down on you if you do not pay. Have you had their famous yellow card from a Mr P. Brown yet? Of course whatever you do not speak to them on the phone especially this bunch they are the worst DCA I have dealt with apart from Logic Group. Your best bet is to go back to the OC and send whatever letters you have sent AIC to them, without knowing the history of your problem its hard to comment further.
