  1. Hi Folks I have attempted to attach the offer letter, it was saved as two pages but I cannot separate and I think it has only attached page one. However, basically page two says my second option would be to accept £13,390.81, but choose not to pay the arrears on the loan, the refund of the advance payments of £4,934.82 would be taken off the loan balance, but all my accounts will be closed down!   2. Thank you dx, I have been trying, I have managed to scan, save, paint out info but I cannot separate the two pages? I scanned them together, but it appears now I have painted out page one that page two has disappeared? I will upload and see if it can be read. Although I have not been able to paint out page two bank employee name. JQ
  3. Hi ims Many thanks once again, my brain went blank when I looked at the spreadsheet, but I shall attempt it again. I have been trying to copy and upload my offer of settlement letter, which I have not accepted yet. I wanted to know if I could request not to have to pay the interest charged on the arrears because if it weren't for the whole PPI scenario there would be no arrears? Can I add this to my settlement? I will continuing trying to sort this document out to upload. JQ

  5. Many many thanks ims, Yes that is correct and first payment was one month after draw down. The account was put on hold pending PPI query so I am in arrears of approx £3.5k, which if I do not immediately pay to loan account upon taking PPI settlement they will close all my facilities, personal and business! I have a letter confirming this, but I cannot find this sec, papers everywhere! I will find it tomorrow and sort pdfs etc and post, although I do have some appts so it will have to be in between! From their copy agreement:- Loan 1 APR 10.9% Cash Loan Premium Loan Amount of Loan £25,000.00 £9,459.83 Total Charge for Credit £15,522.80 £5,873.77 Total Amount Payable £40,522.80 £15,333.60 Monthly repayment £337.69 + £127.78 = £465.47 Number of Repayments 120 120 This is as it is outlined on the "alleged" agreement! I say alleged because this looks like it has been engineered to squash in the bank manager's signature! I have deeper concerns about the exact distribution of funds/fees, but I will make sure I have full details before I details that issue. JQ
  8. Thank you both great minds! First loan still stands, not rolled over, I have their print out copy. Loan two rolled to loan three, all with PPI. First loan personal, two and three business, and I am afraid to say all three with Barclays!!! Mainstream and all done through my Business Bank Manager at the time! Loan three I have "borrowers" copy and two and three their print out copy. Tomorrow I can do pdfs but in a couple of mins I will type up the first loan totals. JQ
  9. Just to add IMS, the bank letter confirms the breakdown of the totals, but does not confirm the number of months refund they have calculated! JQ
  10. Basically I have been mis-sold PPI, (condition of the loan, self-employed and already disabled) I have complained about all three and the first has come back (First loan). Firstly, they made an offer over the telephone and expected me to make a decision there and then, I refused and asked for paperwork, they refused and said they would ring back after w'end for an answer and kept repeating that they had detailed everything and what was there to query? They rang back and again insisted that I make a decision and refused to send it in writing. I explained that with something wrong with my brain, I needed to see it in writing so that I could ingest and understand it and seek advice if necessary. This was refused until I suggested that under the Disabilities Discriminations Act that I, or perhaps others maybe with learning difficulties or mental health issues would be disadvantaged if forced into this position, and if they were going to force me I would make a formal complaint. They agreed to send something in writing, which they did. I wondered what they were trying to hide, so I have been trying to research the details, especially as if I accept the offer of repayment of the PPI it cancels the original agreement and the remainder of the laon has to be a whole new agreement, which makes me wonder if it is a single or multiple agreement even more. Anyway, having discovered so much, I wonder if the big cover up and forcing the issue was to prevent me from discovering that the whole agreement was unenforceable, so they wanted me signing another agreement sharpish? Sorry to waffle! JQ

I have made a couple of observations regarding my agreements that cause me confusion:- a) First loan has separate totals for the loan and the premium loan, but not the "total" of the two added together, but is 01/10/04, is this compliant re prescribed terms? b) Second loan (business) does not have "total" of the two added together either, but is 03/05/05, is this compliant re prescribed terms? c) Third loan, which replaced second loan has all three totals and I think dated 02/08/05, so probably compliant? However, I cannot find two signature boxes on the same page, is this compliant? d) Does the exact wording matter for the prescribed terms, ie, does it matter if the total is called "total amount payable" or "total charge for credit" or something else? e) I cannot find two signatures on the first or second loan, but as they are pre 31/05/05 does this exclude them? f) If the third loan replaces the second and thereby must pay of the balance of the second loan, does that mean that if (assuming it is not a single agreement as in Q1 above) does this add a third element to the multiple agreement, ie, a proportion of restricted credit to pay off the previous loan, and therefore should have its own list of prescribed terms? g) I have requested signed agreements under s77/78 and you guessed it, no signed agreements received, only print outs, so I have no idea if there is a signature from the bank manager, if there is no signature is this enforceable? h) If I am being charged interest on the PPI and it is called Premium Loan and not just PPI added to the loan, does this not reinforce the idea that it is a single agreement, because it is two parts of the same loan, being made up of loans, not just PPI? and there's more but I am trying to formulate it all in my head!   13. Thank you DOH I have spend half the night reading this thread and I have to say with poor brain function to begin with, today my brain is fried! I cannot remember what is what and the new dates and changes etc! I have three agreements, two pre 31/05/05 the third (replacing one of the first two) Aug 05. All three have/had PPI as described above, ie, conditional. First loan is a personal loan and has amount of credit, total charge for credit, total amount payable, monthly repayment and number of repayments for both cash loan and Insurance "Premium Loan" with interest charged on BOTH at the same rate. The second is loan for business (me as sole proprietor) has amount of loan, total charge for credit, total amount payable, monthly repayment and number of repayments for both cash loan and "Premium Loan", with interest charged on BOTH at different rates. The third which replaces the second, has amount of loan, total amount payable, monthly repayment, number of repayments for both and interest charged on BOTH at different rates. I am so confused!

May I ask, if the PPI was a condition of the agreement, ie, the loan would not be offered without it and the terms of the agreement state that if PPI not concluded or cancelled the whole agreement would end, would this make it a single agreement instead of a multiple agreement? Any thoughts? JQ
  15. Truthfully, I have no idea. It was the most stressful day and went in a blur and I am waiting for the confirmation in writing. Basically I explained the circumstances and that the bank knew I was, nor had been at the address they served at, within the time frame. The Judge was very curt and when she was looking for a piece my evidence to quote when she was reading her judgment, I tried to pass it to her and she bit my head off. She then read out that in the rules/regs or something, it states that if there was a reasonable knowledge that I was not living at that address they should not have served it there and come back to me, so it was a non-service. I was awarded the £80 I had paid to file the set aside and it should be entered that no costs are added to my account for that hearing, or the first hearing that gave the ccj. The biggest horror was to find that they had filed an interim charging order on my residential property, when the debt was a business overdraft and should have been levied on my business property. If I hadn't collected the mail from the previous address, I may have had a charge against my property and not even known about it JQ!

  17. In the olden days, they used to set it aside and then have the hearing and relist it if necessary! I had forgotten we had moved on! Lol! JQ

Just in case it helps, I have just won a hearing and had my ticket (PCN) overturned at a hearing because the car park, mult-story operated by the NCP, but for the council and thus with council issued tickets, is covered by signage that states "subject to NCP's standard T&Cs" on the bottom of its NCP sign. As it covered by a council traffic orde,r it is not clearly or correctly signed, therefore my ticket was cancelled! I hope this may help someone else? Yippee! JQ
