  1. Thanks Dave appreciate that, Black horse certainly have not supplied T & Cs in fact just the page you see here! Will have to check the welcome bundle again, but know there are some items missing from my data... letters and details of their sale of the car at auction etc. They haven't even contacted me to let me know what's going on, since July. Just not sure about my strategy, as I already have court case pending with welcome & Approved Car Finance re misrepresentation, at time of sale.....

  4. Hi Dave, Am now posting welcome Agreement on here as you suggested. Any comments please. Can't see interest, only APR & according to quick check figures seem to be incorrect. Is there any one experienced out there who can have a look for me please.
  5. Hi RubyMay, I'm having the same problems with Next, so will be watching this with interest. They do not hold an Agreement, have admitted that the debt is unenforceable but have still defaulted me.....
  6. I sent the appropriate notices to welcome and have now received my data. However they are still processing my data with the CRA"s even though there is Court Action pending! They have not contacted me regarding the sale of the vehicle which they collected last July. Presumably they should have been in contact, to inform me of this. I know they have sold the vehicle, but interestingly enough there are no facts and figures in the data they have supplied.... As I am taking them to court for misrepresentation, I have not addressed the other issues, as I am unsure of my strategy in view of this. Would appreciate any comments...... ,
  7. Hi Guys, I am currently in dispute with Welcome Finance & Approved Car Finance , there is a court case pending re misrepresentation. However, there are other issues re welcome, which I have put on hold due to the current action. There is the charges issue, also they are continuing to process my data even though there is court action and they have received the necessary notices! I would also like to check out the Agreement as I can only see APR box , no interest....& I think the figures could also be incorrect. Can anyone advise me p l e a s e........
  8. LOL....very funny, will be interesting to see their reply. Don't remind me of my dragged out "case"...not 'til early June. I tried to have it brought forward and was advised to write to the court, stating my reasons. Received reply last week, no chance! So once again, it's a waiting game...

However you continue to process my data. The time has passed and you have now committed a Criminal Offense under the said Act and it is my intention to report you for this criminal conduct to the appropriate authorities. I also understand that under the Act, due to your failure to comply with my statutory request you or any acting agent are unable to enforce an agreement therefore I am ceasing any further payments forthwith and will seek to recover any payments made to date. Data Protection Act (Data Protection Act 199(Idid not include this Cool image lol can't delete it) Furthermore under the Data Protection Act (D10), you are also denied the authority to pass on any of my personal data. To do so in the circumstances is I understand a breach of the Data Protection Act 21988, and also the OFT guidelines, and should you ignore my request it would again result in you being further reported to the relevant authorities. I also require that you remove my data from your files within the next 7 days and look forward to receiving a letter from you within 10 days confirming that you have complied with this request. Y F The reply;- I write following receipt of your further letter. I regret to learn that you are dissatisfied with my response to your original letter regarding the default registered against your account. Under Section 78 of the CCA you are entitled to receive a copy of the executed agreement, if one is held, and any other document referred to in it, together with a statement showing the state of the account, and the amount, if any, that is payable. Section 78 does not require a debtor to be provided with a signed true copy of the original default notice. As previously advised, I cannot provide you with a signed or executed agreement, because Next does not hold one. You have, however, previously received copies of the actual statements you were sent, and copies of the letters which were sent, prior to the account being passed to the debt collection agency, and which advise of the consequences of non-payment. I reiterate that in the interests of responsible lending Next have a legal duty to report the credit history of a customer's accounts to other lenders. To not do so would present an entirely false position with regard to your credit history. I therefor must advise you that the information currently recorded by Next on your credit file will remain. In conclusion, we have provided you with the information you have requested and are entitled to. Y S.

  12. No, not exactly. My claim against the Woolwich was settled in November, unlawful charges refunded and default removed. The charges were also refunded re. Barclaycard...but because of these charges I have late payment markers! Anyway, if you find that letter in your travels around the site, would be most grateful.

  14. Confused my two accounts, Sorry! Barclaycard refunded all charges, there was no default. The default and charges were on my Woolwich account (Barclays). The default was caused solely by the unlawful charges, over 700-00 of returned d/d fees, when in fact they had been cancelled!

  16. Hi Perseus, I requested removal of default in with the court claim for unlawful charges. They agreed to both,day before hearing, and the default has been removed, around Dec. last year.

  19. Hi Dave, Have you got a welcome Finance thread, and was this due to faulty agreement? Could you tell me where I can find all the info. to check my agreements. Blackhorse have only sent me the last page, maybe that's all they've got! Welcome agreement could be dodgy, like the rest of the fiasco with them.

  23. My pending court case is primarily for "misrepresentation" at time of purchase. However other issues have now arisen, and I will be considering adding these to my defense, so I am taking advice....
  24. Hi all, I'm desperately trying to clean up my credit files. Barclaycard have given me late payment markers. I Successfully claimed back unlawful charges and had a default removed late last year. Could anyone please help me with a draft letter as I am really having difficulty wording it.........Just not sure which angle to approach it from !!
