  2. I would be surprised if you haveto go to court. In my case both suits ended up being settled out of court before the court date even though they said the cases woulod be defended.l Best of luck in your case:)

  4. It all depends how desperate you are to have the cash. If you can wait until Jan it will be easier claiming it all in one fell swoop best of luck anyway. I am presently doing a summary action on behalf of my son who can't wait for the cash:D !!!!!

Brassed off; Actually what makes it much easier is to say I am not giving up I will smoke when I am climbing the walls then when you stick a fag in your mouth stop and say am I climbing the walls?? Not yet so take the fag out of your mouth. You will smoke when you are climbing the walls;) Best of luck:)
  9. My way you never make that final decision. I never threw any fags in the bin actually I kept them in a drawer for years. I tell you it works with not much worry. Good luck:)
  10. Here is to me the best way of giving up smoking if you really want. I have used this method several times and the last time I smoked was 1989. Here is how it is done. You say to your self you are not giving up. Your are only going to smoke when you are " climbing the walls" carry a packet of fags in your pocket, because you are not giving up, every time you feel like a smoke ask yourself Are you climbing the walls yet? not yet so don't smoke.Tell yourself you can smoke when you are climbing the walls and keep asking your self the question because you are not giving up. I even had a cig in my mouth when I decided I was not climbing the walls. Suddenely you will find you have not smoked for a week but you, are not giving up then two weeks then three and so on. the longer you go the better it feels. What made it so hard was when I said to myself I was giving up and was never going to smoke again so I never could give up. This method works because you keep telling yourself you are not giving up. If anyone tries this method let me know how you get on
  11. Flossie; This is what I used to advise my clients to do when they had a large amount of money to invest. Decide how much income you need for one year and put that aside. With the balanceyou can invest it and not touch it for a year which should give it a chance to grow and cover any charges you had in making the investment. the funds you have put aside for the next year put them into a good savings plan that you can draw on when you need them. I would not advise the stock market at present let things settle, before getting involved. I myself have moved a sizeable amount of funds into National Savings until we see what is going to happen. Now that is my idea maybe not the same as others. I have been around for a while.

  13. Having been a stockbroker with an investment banking firm who was a member of the Newyork stockexchange for fifteen years when I lived in the U.S. I know how a lot of Investment advisers work. They are not a charity and some charge a fee and some get paid for their reccommendations from the firms they reccommend. On other words it can be difficult finding the right person. Banks are notorious for poor reccommendations.A good unit trust might be an answer. However at this time the way the markets are going I would hold cash at the best interest rate and when things clear up go for some good investments in the stock market.Midge 61 suggested checking up on the home page which turned out to be the Forresters. Many years ago I heard about them and they were a good company. I don't know if what I said is any help it is a difficult decision to make.

    I have always found MBNA easy to deal with I had several credit cards with them and when I decided to pay them off I offered them a 30% discount which they accepted. Now of course this was in2006 and maybe different people. I have had other dealings with other CC cos which because of no payments the debt ( so letters from DCAs said) was now due to, be paid to them. I ignored their letters and I received a letter from another DCA and then eventually from another. By the way the reason I had not paid monthly payments was because the amount was in dispute and I was sueing and waiting for a court day. I had said I would continue the monthly payments as soon as the court case was settled. Eventually I won the case being settled out of court I requested a settlement. On two occasions where I had made a payment was told the card was up to date and I would not get a discount ( guess what There has not been another payment since.) on another situation where I am not finished sueing received atelephone call to day and was offered a 30% discount so I settled!!! There is a couple of Bank who will not give you a penny off one is BOS and the other is SAGA. I hope this will be of a little help. Best of luck.
  16. I don't know about you but if this had happened to me I would inform the bank if this was not settled to my satisfaction within 24hours including interest for the days the funds were removed. I would be happy to see them in court and the costs to them would increase considerabley. You see I am a B-----d when it comes to banks screwing me I will not have it. Be strong and best of luck.

How about checking the internet and see who are paying the top or near top interest rate and getting in touch and saying how much you are thinking about "investing" with them what are they about to offer. In other words speak from stregnth not weakness. With the amount of funds you have you sure not speaking from weakness. You can suggest to NatWest if you would like to stay with them, that you want to talk to top management and see the results. My sister had an £ 10,000 overdraft with BOS and got a letter stating she could no longer have the overdraft as she did not have enough income to warrant it. Her investments around £ 50,000 are being handled by BOS investment dept. She is in her eighties and not very good at demanding proper dealings. So I wrote on her behalf anjd said unless she was given her overdraft back she would take her investments away from the bank. It was their fault her income was so low. Guess what the over draft was reinstated!!! It pays to talk from stregnth and not let he bank run over you!!! Best of luck.
  18. 10/11/06 LBA letter sent 23/11/06 Court papers sent rec. dely 12/1/07 hearing date won by default ( I was at court noone from CITI was there) 12/1/07decree granted SA570/06. 12/2/07 Extract for payment sent rec. dely. ( all paperwork sent to CITI Sunderland office, where I had been making my monthly payments. ) No reply.15/3/07 Sheriff officer sent charge for payment to Dundee office. 19/3/07 Letter to Perth Sheriff Court from D Travis stating never rceived original claim ( I have copies of signed receipts) aking for a new trial date. 13/4/07 new call date, second court visit, no defence continued two weeks for defence to arrive. 4/5/07Still no written defence. Judge told lawyer to have D. Travis in court (Perth) 11/5/07. 8/5/07 Travis wrote to Perth Court saying it was unecomomical for him to attend Perth Sheriff Court, requesting decree to be recalled for his client to defend the claim. 11/5/07 Court allowed Defender 14 days to lodge written defence and assign a hearing for 29/6/07 ( I had to go into hospital for major surgery and might not be back before that date.) 24/5/07 defence papers arrived. 29/6/07. at court no one from CITI showed up so lost by default. Had spent two hours on the defence ready for court ( waste of time) 29/6/07 Decree granted. 16/7/07 Extract for payment sent to Falkirk office ( Dundee office now closed for card business) 15/8/07 received cheque in full and final settlement. Now start waste of time suit.
  19. I don't know if you are still wanting notes on CITI time wasting. I am just about to file a suit for time wasting and it has taken my hours getting things ready. Here is the list or whatever. 10th.Nov.06. lba letter sent. 23rd. Nov summons sent recdy dely. hearing date 12/1/07 Won by default caseSA570/06 12/1/07 decree granted 12/2Extract for Payment sent rec. dely. to Sunderland office ( where all payments had been made) no reply 15/3/07Sheriff officers sent charge for payment to Dundee office 19/3/07 Letter sent to Perth Sheriff Court from D. Travis. Stating CITI had never received original claim ( I have all the signed receipts for rec. dely.)Court issued new call date for 13th.April. 13TH April at court continued for two weeks for defence 4th.May at court no defence Sheriff ordained D. Travis to attend court on 11th.May 8th May D. Travis sent letter to court stating that it was uneconomic for him to attend Perth Sheriff Court requesting decree to be recalled so that his client could defend this claim. 11th.May court allowed defender 14 days to lodge written defence and assigned hearing for 29th. Jume ( I had to go into hospital for major surgery and did not know when I would be out) 24th. May defence arrived took several hours work before court 29th June at court no one from CITI there so won by default 29th June decree granted Extract for payment issued 16th. July 1st Aug. sheriff officers delivered " Debt Advice" to CITI Falkirk ( Dundee office now closed) 15th Aug. received cheque in full payment:D :D So now I start my case any ideas?
  20. I am not sure you can claim for damages for not receiving the DPA papers I think you can only report them to the commissioner and they are the ones who do the fining.

Tes she has won by default now she has to send page 11 the minit page informing the court wht she is sueing for eg the amount on the original papers plus court costs ( what she has paid) anything paid to sheriff officers plus 8% from filing date. The folks at the court cna fill you in on what is needed ot has to be in before the calling date. Best of luck:)
  22. I guess it's best to follow Hedgey's advice as I am not up with how things are done in England. Keep at the bank don't let them away with anything;)
