Quick update, went to court today but because of Bank Holiday they have an extra day to file defense Close of Business today is the deadline so will be ringing court at 10.05 to check, if not it will be automatically processed as i left the declaration slip signed as it is so far away from me. So wait again till tomorrow to read the next exiting episode:D

I've checked online account nothing paid in, so my plan of action was first thing Tuesday 1.Ring ICO for update on complaint filed with them 2.Ring County Court first to check if they have filed their defence 3.Wait for post 10.30ish just in case its full of statements:rolleyes: 4.Depending on results above off to Court to file Really looking forward to Tuesday:D Thanks everyone for advice wish me luck

Hi Just thought i'd do a quick update on story so far and ask a question. Halifax filed an Acknowledgement of Service on 3/8/06 The Defendant responded to the claim indicating an intention to defend all of the claim The defendant has 28 days from the date of service of the claim form with particulars of claim, or of the particulars of claim to file a defence. 1. Is this the date from my original claim being filed ie. 25/7/06 or from the above date 3/8/06 If it is the former date then I should be able to obtain judgement by default first thing Tuesday If it is the latter then 3/8/06 it is. Bear in mind it is a holiday on Monday they will then have three days in which to comply or submit a defence. I have had no correspondence from Halifax since so now dont know what to expect.

Hi, It looks as though you need to read through the FAQ and a few of the threads, its your money ALL OF IT dont compromise, by reading up you will see the reasons people are claiming the full amount taken by the banks in unlawful charges and you will confident to proceed. Read the step by step guide and use it, it is there for a reason. Best of luck

Hi, I don't believe you can file action on line as its not a money claim, rather a claim to force them to release your statements, although you will need to include a nominal amount in the "VALUE" section, (see my post Morgan054 v Halifax,) You fill in the N1 form as per template, I just pasted and altered to suit, take 3 copies to county court, and you will need to pay £30, I also took with me the information from the same page as regards to information commissioners comments so that they dont try to put you on the wrong track and charge you more, The court will file claim and send 1 copy back to you with details. I also made a complaint to I.C and still waiting for response from them. If you read my saga you will see where I stand at the moment still waiting, just hope you have better luck getting yours, but don't let my experience put you off, KEEP AT THEM

Hi Moonie, Relax, Deep breath, looks like the standard defence as I've read previously on someone elses thread, i'm sure some one of more experience will reply in due course, spend some quality time reading related posts and you will find references to people in the same situ as you and discover similar defence letters. Help???? just had post today and Halifax have acknowledged court summons with intent to defend claim in full, am i missing something here, as its supposed to be primarily to get them to give me my statements what is there to defend, surely not for £40 costs. Can't see as anyone has had to go this far but others may have read a thread similar but after scouring about i cant find one. I have reread all my correspondence to and from the Halifax and it seems to be in order, the timescales have been adhered to, if not generous towards the Halifax so i'm baffled, or thick.....Having sent me a reply(posted earlier) they have then gone over the required time without explanation so surely they are liable. Told you guys i dont have much luck

Hi. Stick to your timescale and take the next step, if you read my thread, carry on, it looks like their latest tactic, most probably testing to see if you give up or persue them, personally i've gone into bloodhound mode, good luck.
