  2. Hi , You need to read the FAQ there is a step by step procedure you need to stick to so as not to make mistakes, it is there because it is tried and tested, once you have read it just follow the steps and it will all fall together, read my thread for Data Protection Act non compliance.
  3. Hi, The DPA gives the banks 40 days, so their time wont be up until about 16th October, if you have not received them by then you can find the templates for DPA non compliance in the library Best of luck
  4. Sent off the LBA seeing as though i've had no positive reply, also had a suprise in the post today, my credit card statements well before time this time, must have been that N1 that did the trick:D Total £500 from c/c so prelim off to them tommorow

  12. Got my first reply to prelim usual, "We are sorry you are not happy with your charges applied to your bank account" Too right i'm not Took ten days to get from Halifax head office to customer relations in Leeds:rolleyes: Only a couple of days left before LBA gets sent

Hi peeps, Just starting this thread to see if anyone has had a reply to their complaint to the ICO, specifically regarding DPA non compliance, below is my reply from them. if you have had one please post, omitting personal information Reference RF A0128273 Dear Mr Morgan054 Thank you for your complaint dated 31 July 2006 in which you ask the Information Commissioner to investigate an alleged contravention of the Data Protection Act 1998.Such matters are dealt with as requests for assessment under section 42 of the Act. I apologise for the delay in my response, however we currently have a significant backlog of cases awaiting attention. On receipt of a request for assessment we are under a duty, in most instances, to assess whether it is likely or unlikely that the processing in question has been or is being carried out in compliance with the provisions of the Act. However, we have discretion as to how we carry out the assessment an as to what action, if any, to take. We have considered your request in accordance with this policy and we are of the view that the information which you have provided does not justify starting a formal investigation. We have therefore made our assessment solely on the information which you have provided to us. We have not made any direct contact with HBOS. I understand from your correspondence that you made a subject access request to HBOS on 30 May 2006. You received a response date 12 June2006 stating that the information would be sent by 7July2006. However you heard nothing more from HBOS. As the 40 day response period has now passed you wish to complain about a possible breach of the Act. On the basis of this information, it does not appear that there has been a contravention of the sixth data protection principle, which requires data controllers to process personal data in accordance with data subjects’ rights. This is because HBOS has not responded to your subject access request. We have formed the view, therefore, that it is unlikely that the processing concerned has been carried out in compliance with the provisions of the Act. We do not intend to undertake any further investigation, but I shall now inform HBOS of our assessment. I shall inform them that they are in breach of the Act by not providing you with the contents of your subject access request within the 40 day limit and request an explanation for why your request was not complied with. I will instruct them to confirm that they have sent your information within 14 days if they have not already done so. I will also take this opportunity to remind them of their obligations under the Act. It may be helpful to explain that a contravention of one of the data protection Principles is not itself a criminal offence and the Commissioner has no power to “punish” a data controller. In such instances, the Commissioner will seek a resolution to the contravention and once satisfied that it has been remedied then in general no further action will be taken. Furthermore, section 13 of the Act gives individuals the right to claim Compensation if they have suffered damage as a result of a contravention of the Act. If this is something that you would be interested in pursuing I would advise you to obtain legal advice with a view to taking the matter to the courts. The Information Commissioner is unable to comment or advise on any claim for compensation. I note that you have already filed a Count Court claim for non compliance by HBOS. Thank you for bringing this matter to our attention. This case will now be closed.

  16. However on a purely commercial basis, it will cost YOUR BANK money to defend your claim in terms of legal costs that will be incurred. It is unlikely that YOUR BANK will be able to recover these costs (even if the bank wins) because your claim will probably be allocated to the small claims track. :D :D
