Hi yes I did accept the DN only gave 14 days and they terminated on the day they issued DN just really dont know what to say to DCA as that is not a reason for the account to be in dispute or is it?

Hi same situation as you with co-op hace DN giving just 14 days and termination dated the day of issue for the DN I am just waiting to see what happens -

I have a similar case my CCA looks completely unenforceable but my solicitor dropped the cas as he said it was enforceable.All I have now is a DN asking for the full balance and account sold before DN expired I hope that is good enough as Experto getting arsy lately. -

Thanks DD the DN says you have repeatedly brocken your agreement with us by failing to make your min payments.Paragraph 8f of your credit agreement provides that subject to sending you any notice required you must pay your whole balance if you reapeatedly break this agreement and fail to sort the matter out.A stop has been put on your card and a default registered.this stat notice is to tell you that in order to remedy this breach you must pay the full amount by.The reason the account was not being paid is because it was in default for no cca.Funny thing is I have just looked at the terms and conditions that I received yesterday when my solicitor dropped the case and there is no paragraph 8f its 13f on the terms they have sent me.

If you put an account in default because no cca is produced,during the default period no interest or charges are to be added to the account or so I was led to believe if the cca is produced 18 months later are they entitled to back date interest and charges to the point it was put in default? The reason I ask is the figure Experto are asking for will include interest and charges added while in default before it was sold to Varde.

sorry to butt in on this thread but I wondered if somebody could answer this for me I have a Dn that asked for the full amount rather than the arrears also the full amount would be wrong as it included interest and charges added when the account was in dispute I also have a letter saying the account had been sold dated 1 day before the dn expired so have they done it all wrong?

yes had DN then termination have asked them again for cca or to confirm they dont have it

After over a year MBNA have supplied my solicitor with terms and conditions and he has now dropped the case saying it is enforceable even though you cant read the back of the agreement. The account was sold to Experto like a lot of others on here I had a default saying that I had reapeatedly failed to make payments and that the whole balance was due under section 87 the notice was dated 7th September giving me until the 24th to pay the outstanding balance in full. I then received a letter dated the 23rd of September saying Varde had bought the debt and Experto would be collecting it am I right in saying that the default should have just asked for the arrears and that they should not have sold it befor the default expired?Any idea what my next move should be?

Just had a letter from the complaints department saying they are looking into why I have not had cca but inthe letter it says that under section 78 request I am not entitled to withhold monthly payments is this correct I have put them in default?

All I got was copies of statements and recent letters no screenshot or anything about cca how long have you been fighting them
