  5. cplusa, just a thought but have you looked at Santander's account offering? Completely free banking and it was an easy application when I did it recently. Even if you got turned down there, assuming it'll take a little while anyway for your Experian file to be cleaned of the erroneous info and for you to appear on the electoral roll, the failed application won't do any harm, and who knows you might get accepted!

Interesting to see how this firm has changed over the few years this thread covers - evidently they've moved offices (have new address and phone number now - no longer a 0870 one) and a website and email address on their paperwork. I've received a letter today regarding an old debt which I settled many years ago (F&F agreed at approx 50% because it was mainly charges, sadly I was too ill informed then to know better than pay it at all) but which has since been sold a couple of times and is now with Capquest. I'm pretty sure it's statute barred now, certainly it doesn't appear on Experian. There's no danger of me paying it because I don't owe it, but after reading the last post from rev.ian I'm wondering whether my best course of action is in fact to ignore them completely for the time being? The last thing I want is to do anything that gives them an opening to extend the 6-years-since-action thingy even though it'd be wrong for them to do so They haven't harassed me - this is the first letter so far though I did get a number of calls and a couple of letters from Capquest, so I'm happy to ignore them (even though I'd written a great letter even if I do say so myself) if that's the best course. Anyone got any feelings either way?
  7. Some news on my case: Went to the court, signed the bits, left a note that I was away until about now in September. Got a letter a few days later from the court telling me I have a hearing on 26th September. Will make additional application for costs for attending that, too I think.

  9. Great stuff, should be a worthwhile claim for costs, then - it's taken ages to get this stuff sorted! Does this look ok for my affidavit: that look OK? What else do I need to provide. Obviously the letter referred to, and the SD itself - do I need to provide the original SD or a copy? Almost the end of the stupid questions now!
  10. Hmmm. Right, ok - possibly not worth bothering with that bit, then, since I'll presumably have to get my employer to prove that I lost a day's wages? I'll post of the detail of my application shortly, if perhaps some kind soul would check it? I am correct in thinking that I can fill in most of it and take it pre-printed to the court to sign etc?
  11. Hi again, all. Question about my application for a set aside, which I'm going to make tomorrow: I intend to make a claim for costs, but whilst most of it's pretty clear, what is the accepted method of working out the value of a day's wages lost? Monthly take-home pay / 20 or so?

Hi woody, a) No, it would appear they don't b) I assume because 1) it's very expensive (I've read it costs them £1000+ to petition for bankruptcy) and 2) if they do make you bankrupt they're taking a gamble as to what you actually have to pay them with - once they've made you bankrupt they'll get their share of what you own but that's the end of the matter. The may feel they'll get more in the long run by obtaining a CCJ and extracting the money from you normally, over time.
  14. One related question, if I may? The address that Capquest hold for me is not my present address. I have since moved, but neglected to inform them of this because of the constant phone calls and threats of doorstep visits they have been making. I understand that I can claim for reasonable costs incurred in having to attend to apply for a set aside, but I would presumably be disclosing my new address to Capquest in doing so, which would be a bad thing. I don't mind not claiming if this is the case. However, the SD was sent by regular first class post. I intend to make reference this is my affidavit (that they simply posted the SD despite the ongoing dispute over the debt and that this implies they're not taking it seriously) but, if I encourage them to deliver further documents in person I'll end up in an argument over my address. Do I have an obligation to give them my new address? I have a redirection in place so I receive all the mail sent to the old address so there's no benefit to me in telling them
  15. Hi Saint, Right, I've looked at the SD and it states that Now I know that I have never taken out a loan. Is it possible that a current account (overdraft) or credit card could be represented as a loan? Second, I have sent them letters in the past (though I only have a copy of one letter) stating that I dispute the existence of the debt and inviting them to send proof. Nothing. Is there anything more specific you mean by a 'prove it' letter? I have drafted the following CCA letter to Capquest: I will make an application to set aside the Demand as soon as I can (possibly not until next week.)
  16. Hi, both First off, I'll get the forms now and have a look through them. With regards to a SAR and CCA letter, those are in the templates forum are they? I'm sure I've done this before and got no reply, but I might be referring to another debt (they had been sending letters about two debts for a time, which confuses the matter further) The 'debt' is apprently one they've bought from a bank. I don't recall if it's RBOS or Natwest (but I never had an account with the bank they were referring to anyway). Are the any specific questions I should raise in my CCA letter?
  17. Morning all, Short background: Letters for a few years from a Debt Recovery Agency regarding a debt I don't acknowledge. I have requested information regarding said debt but never received any. End of last week, out of the blue, I receive a Statutory Demand for Bankruptcy letter, which I'm just doing research on the meaning and implications of now. Thing is, I could afford to pay this money, but I'm genuinely certain it's not a valid debt. The advice I've found somewhere is that I can apply to have it set-aside if it's in dispute (which is it, but I'm not sure whether there's a specific requirement for it to be classed as 'in dispute') The debt is over £750 and I don't own any property. Can someone offer any help? Thanks! Chris

I would like to remain optimistic, but a bill credit would not soothe my nerves just yet, as that would mean getting a bill - and since I don't have a phone line that would rather be adding insult to injury! A Credit is no use to me unless I can plug my phone into it and/or order ADSL over it...
  19. Hi all, I ordered a new phone line, online, on September 20th, because I've moved into a new house which doesn't have one. On September 27th I got a message saying that my line would be installed on the 1st of October. I took the 1st off work to wait, but nobody turned up. I called them late on in the afternoon, spoke to a kid who didn't seem to work there - or at least had no idea what to do! Took a few details that they had anyway and said he'd get someone from the back office to call me back. Nobody called back. Contacted them through their website, both as a query and a complaint. Phoned again on the 3rd, waited in a queue for 30 minutes and had to give up. Phoned again on the 5th, gave up after 26 minutes in a queue. Tried again, spoke to another department and got the address for cancellations. Got a message on my voicemail, and an email, telling me that my line had been activated without the need for an engineer visit and that I need only plug in my telephone. Problem is of course, I ordered the line in the first place because there physically isn't a line into this house and never has been. Then the Postal Strike happened, so I didn't bother writing a letter because I figured it wouldn't arrive anyway. Called again on the 12th, finally spoke to someone who sounded like they knew what they were doing. She said that the system must have confused my address with my neighbours, and that it had re-activated an old line of theirs. She cancelled the order, placed a new one and actually spoke to BT Openreach to confirm the installation appointment for October 22nd. She then sent me a SMS message to confirm. Today, as you may have spotted, is the 22nd October. The people I have seen today, on my second day off work, include: Tesco Direct delivery man Post Man Neighbours Neighbours Kids (damn half term) Note that none of those person did, or even *could* install a new phone line. I tried phoning BT at 3.30 and every ten minutes since then. All I get is a message saying 'Thank you for calling BT. We are experiencing a high demand for this service and as such we cannot respond to your request at present. Please try again later.' (Or words to that effect) at which time the call is terminated. Nice touch, that. So, I ask you, what can I do now? I can't talk to them, I've now essentially placed the same order twice, and got no phone line on either occasion. I'm getting desperate, and of course the Freephone number isn't free at all if you're calling from a Mobile on account of not having a phone line! I'm hopelessly lost for ideas, can anyone please, please offer me some advice on how to get a phone line?! I just want the damn line! Thanks (desperately) Chris

  21. Righto, time to go after the charges accrued on my Credit Card with HSBC. Met with some success in reclaiming my current account charges, but seems to have got rather more complicated.. Any pitfalls I should look out for? Got my current account charges back without the need for litigation about a year ago..
  22. Problem is there's no way in hell you'll be able to find evidence that this is why it was withdrawn.. I'm sure that 99.9% of reasonable people will suspect that it is because of the claim, but unless HSBC were stupid enough to write it down somewhere on their computers you'll never prove it :-/ They didn't do the same to me, FWIW and I missed a payment shortly after claiming my current account charges back. That said, I'm going after them for the credit card charges now, so we'll see how they feel after that
  23. Good luck LittleOne - I'm following you, as soon as I get my statements.. Can I ask whether it's a current account or Credit Card you're claiming on? (Subject should read 'Me Vs Natwest' , rather than 'Myself' if you have a few spare seconds for a pedant Don't know what started the craze of using Yourself and Myself instead you You and Me, I recall it happening in a call centre I worked in for HSBC a good few years ago and it drove me mad!)
  24. Hi All, I have a Natwest VISA card and a Current account, both now closed. IS the address on here (or, rather, are the addresses on here) the correct ones to use for Credit Card refund claims as well as current accounts? Can't see any mention of credit cards being separate. DPA SAR Ready to go, just need to know who to send it to! Thanks Chris
