  1. No notification sent to say it was sold & they can't prove it either as they can't find or should I say told us they don't have the original paperwork,hence why they couldn't provide the mortgage deed & offer when SAR them.

  4. Has your family read through the t&c's Kegi? I know mine mention nothing about them changing. I would get them to double check. I've already been into court last week & spoke to the enforcement team about it,even they said it would be breaching contract. I'm now putting it all in writing for a DJ to look at(inc all the evidence I need),so a decision can be made whether to bring it back into court.
  5. Had letter off capstone this morning,they don't half contradict themselves. The transfer will now take place from the 17th May & I have been issued with a new account number. It also states the following: Although LMC is transferring the servicing of you mortgage to capstone,this process has no bearing on your contractual obligations with LMC. Your mortgage lender remains LMC. Any changes made by LMC to the way your mortgage is to be serviced are carried out in accordance with the existing terms of your mortgage. Yet I have received AGAIN a new tarrif of charges that differ to the ones I am currently paying. To me that results in a change of t&c's.
  6. Thats awful EIE, I've lost a brother in law to suicide & it's not a pleasant experience for their families to go through. I know how easy it is for them to feel like that,we all must have felt like this at some point.
  7. I am absolutley mortified in whats been going on here! I thought this site was to help others in simular situations? The capstone wordpress is easy to navigate around instead of trawling back & forth between posts. Why can't we work together on this as a partnership? At the end of the day it's helping peoplefrom losing their homes.
  8. No notice was given,I will have to look back through my docs from when I sent a SAR & see if it was included in there,although not everything was sent & lots of paperwork was missing. I have been to the LR twice & both times I have been told their is nothing that can be done without an order from a DJ or if a solicitor takes it to court. Yes Matlock t/a london mortgage company was who we took mortgage out with & now it is SPML t/a LMC. 1st time in court I queried defendent & solicitor told me it had been assigned on 2nd may 2006,which ties in with spml 06 a/c. Mentioned a couple of times when in court about the LR & spml being on the charge 4 months prior to them assigning. There is nothing in my t&c's re administration,only thing it mentions is "we may sell your mortgage on". What would the statutory s136 notice look like? would it come in the form of a normal letter on letterheaded paper?
  9. ANW No there is no signature on the letter,but this is Southern Pacific Mortgage Company Ltd trading as London Mortgage Company & not LMC Ltd. The reg no I have is (3266119) whereas LMC Ltd reg no is (5673094). LMC is my administrator on behalf of SPML. Work that one out if you can...a trading name & a ltd company!   10. As you all may remember a couple of months ago,I got a letter stating my administrator was changing from London Mortgage Company to Capstone on the 10th Apr. Well yesterday I received a letter(dated 23rd Apr)from LMC stating all payments made by chq had to be made out to them. NO mention of CAPSTONE!! I wonder what is going on! I find it all confusing,that capstone are supposed to be taking over,then get a letter saying something different. Has anyone else in the same position received anything from either capstone or LOndon Mortgage Company?   12. Hi Dancer199 It can be done in the same way as the bank charges,only you can claim back upto 12 years with a mortgage,whereas bank charges is 6 years. Send them a SAR from the templates library & amend it to suit your needs,send it with £10 postal order or cheque recorded delivery,then you have proof it has been signed for.They then have 40 working days to reply back to you.   16. The car still had 3 weeks mot on it & was being done in advance ready for shows. Everything was checked on the car including wheels before it moved.

Court order to send it to their solicitors-returned, LMC-no longer available at cheltenham address, No details to send to crapstone...so you see in a bit of a catch 22 situation. Going to have to see what the courts say tomorrow when I call them.
  18. Having been through the t&c of mortgage,we signed for the charges of LMC. As crapstone have now taken over,is it possible to take them on unfair terms of contract? as the arrears fees have changed & not what we originally signed for. March payment returned from their solicitors,need to get it back in court asap,before they start repo AGAIN!!
  19. Just checked the bank again & payment has gone out on husbands debitcard,we only gave them sort code & account number & are very puzzled as to how they have hs card details. Think we are going to report this as fraud.
  20. Help it just gets worse!!! I have the property up for sale,The HIP payment has ben deferred until property sold. Received letter on 29th mar stating upon completion of sale,payment of £463.85 will be made via solicitor. Husbands account has had £498.85 removed from the company yesterday. Theres no direct debit on the account for it to go out as it was cancelled when they claimed it would be dealt with via the solicitors. What can we do? as they taken over the amount that was supposed to be paid. ARRRGH!!!
  21. I used to work for Lloyds & had a current staff account with them,when made redundant it was converted back to a cutomer account. I had a £2.5k overdraft which I struggled to repay,they gave me a loan of the overdraft amount to pay off on the condition that I handed back my cheque book,guarantee card & cancelled all direct debits. The loan was over 2 years & was repayed 2 years ago,with confirmation that the loan had been paid off & the loan account closed. Last year Lloyds closed my account as I didn't use it,as I had a savings account & used that instead. Over the past year I have received numerous letters off DCA's stating that I owe over £800 pound to LTSB,but never received any clarification from them to say my account had been closed or that I owed any monies. I got a letter about 6 weeks ago off LTSB to say that I owed this £800,but with having mortgage problems have put it on the back burner. I have since had 2 letters from Moorcroft stating that if I don't pay up litigation proceedings are going to be started against me. 1. LTSB cancelled my DD's & put a block on the account so that I couldn't set any up. 2.The account had not been used since 2006 3.How can I owe money when the account was inactive. If I send them a SAR,who's to say they won't close my saving account. Who do I dispute the amount to? Lloyds or Moorcroft? Any help appreciated.
  22. An accident is an accident at the end of the day which can't be helped & thankfully no-one got hurt. My husband did offer to have a new sign made but he wouldn't accept it. Went back to the pub later in the evening,where the pub landlord admitted he did not have a licence to have the board there,an agreement has been arranged after admitting he was out of order for complaining about his sign,as someone could of been seriously injured.
  23. Thanks for all the advice,it was the fact that he was more bothered about his board than anything else.Someone could of been hurt if they had been passing. If it had been an old dear driving the car it would of probably been a different story. Will check with my local council on monday.
