  3. Welcome to the forum anotherone. :0) I can't understand why they are being like this to you with only 1 months arrears!! :@ they are a disgrace to society. If you have a statement showing all the breakdown of charges they have added on,write a letter of complaint to ,also requesting they refund you the charges. If you don't receive a satisfactory outcome then you will then be able to take it either through the courts (which will be quicker) or to the FOS If you go down the FOS route but that could take you 18 months before your case is looked at. Are you able to pay your payment & a bit extra towards the 1 month arrears? What threatening comments are you getting?
  4. Definately do not pay Scotts a bean! Take dx and newstarters advice. A lot of us here have been fighting them for 5years or more...the aim is not to give in and not back down...and I would certainly address where they get the 30k figure from.
  5. Hi There Capstone have changed their name to Ascenden & not been taken over. Your friend should should complete a subject access request which is a complete history on her account with capstone since the start of the mortgage. This will cost £10 and you have to give capstone 40days to comply. Once she has received this go through all the charges,fees,insurance,ppi etc which she is eligable to claim back. Write to them and state you are disputing the amount they are claiming,ask for a full breakdown of how they get to £30k. As far as Scotts go..tell them the debt is in dispute & they will have to put it on hold..they can not go for payment or harrass you when a debt is in dispute. I can guarantee that the whole shambles of the mortgage will have een mis-sold or plenty of breaches in the contract somewhere. Don't let them get away with it...the more you put up a fight...the more they back down & bend over backwards. Good luck
  6. Hi budobird How long ago did you take the loan out and for how many years? They do have a tendency to add on the Early Repayment Charge at the end,even though your out of that period. Check your agreement and see how much the ERC was for. Welcome to the thread by the way LD

  10. I'm sorry but I am not prepared to be giving out policy numbers and registration details to someone on a forum. If you are from KGM Insurance then you should certainly know your Data Protection Policies. AI Claims have confirmed they are not dealing with it,as posted on first post. AI Claims were calling back to let us know who was. As husband as attempted to call again today and got no-where,a letter of complaint has been issued.
  11. I requested statements from beginning of the mortgage and was told I would have to pay £35 per statement,for 5 yrs statements they will charge me £175. I'm still waiting for them to be sent as all I received was a quarterly statement. Utterley incompetent!

  14. Hi Yes it states repair guarantee..the car is a mk 1 golf and parts are really east to get hold of. I have heard on other forums that KGM don't respond to letters,calls or emails,so do you think it is best going straight to the ombudsman first or do you think he should send letter of complaint first?
  15. Just a brief intro into what has happened & any advice appreciated. In jul this year my hubby was turning right on a roundabout & a car from the left failed to stop,causing front end minor damage. He hurt his wrist which resulted in a visit to A&E. He contacted the insurance and gave full details of the accident,they then sent a claim form out for him to fill in. A call also to confirm an engineer was coming to assess the vehicle on a specified date,where I waited in & no one turned up. He had pics of the other parties damage to the car along with personal & insurance details & witness name & address. To date he is now waiting on the release of compensation cheque for his injuries which was tendonitis,but the car has still not been repaired. Since then he has been passed from pillar to post,not knowing what is going on. He called KGM 2 weeks ago,who stated that they are not dealing with any claim and had never received any paperwork nor had they sent any out to him. He spent over an hour on the phone,explaining the details of the accident & was told at the end of the call he would be contacted. He has called again today (KGM) who told him they were not dealing with it as it had been put down as a total loss and a company call AI Claims was dealing with it now,he was put through to AI Claims and was told they wasn't dealing with it either and someone would call him back...still waiting... It is a classic car valued at £3k and the policy states that as a classic policy they will repair the car at all costs. 5 months of to and fro and still no-where near further. They really don't know their head from their ass...can anyone suggest what to do next,otherwise it's all going to get very heated and alot of harsh spoken words.
  16. Yes I did,but i'm still waiting for the letter stating I will be receiving a annual statement instead of quarterly one. Then again since the change over to Capstone oops sorry Ascenden, I've never received a statement at all.

  18. I couldn't help but chuckle at this last bit BO2..we have done exactly the same with them. Not let them get a word in edgeways,loads of q's thrown at them etc and they slam the phone down at you because they can't answer you...reverse psychology..i love it!!!

  20. No they didn't comply,it's being taken back to court,judge knows about it and will be issuing a sanction to them.
  21. As an ex Lloyds banking staff,ask them to send you the original agreement,not a copy but the original itself,they keep all records for 10 years + and place them in archive.
  22. I know they are very sad aren't they!!..who would of thought they had so much time on theirs hands,when they have so many arrears collections to maintain & hurl abuse on the phone!! Don't tell me they can multitask aswell!!!...shocking!
