Hi, Spoke to Marstons office who advised that when I made the payment on the friday it didn't get allocated to my account until the Monday and the account was passed over to the enforcement agent over the weekend so the fee still applies. I mentioned that as no attendance had been made before I paid the account then I should not be required to pay. I called the enforcement agent but he has not called me back and has not returned either. Hopefully that will be the end of it.
  2. Hi All, I have recently received a letter from the HMCTS historical debt team about a fine from 9 years ago. they informed me that I had a fine for having no TV licence. I knew nothing about it. About a month later I received a letter from Marstons Group Bailiffs asking the payment of the fine which was £250.00 and also a £75 compliance stage fee. A The letter which was dated 23rd October gave me until 5th November to arrange a payment plan or make a payment. I received the letter on 4th November (a saturday) and when I called to discuss they were closed. I contacted them by phone and was told that as I missed my chance to come to an arrangement I had to pay it in full and that as it had not yet been passed to an enforcement agent then I only have to pay £325 ( 250 fine plus 75 compliance fee). I wasn't happy and made a complaint to which I received a an email advising me to go online and pay. I went online and paid the £325 in full as thats what it said I have to pay (you can't change the amount you pay online as its preset). I got me receipt. today which is a week later I get a knock on the door from an enforcement agent asking me for £235 enforcement fee and that he will use a locksmith to enter to retrieve goods. I explained that i had paid it but he says that on the same day i paid online they sent the account to him. Can he force me to pay this when I already paid the amount requested by their office and online. I have a disabled child to which I am the carer but should that make any difference? He is coming back tonight to force his way in apparently. thank you and appreciate any feedback.
  3. I pay it card most of the time but have paid by bank transfer. I haven't paid the restock charge yet and I also haven't received an invoice for it either. In fact I never received an invoice for the goods as they were never collected from the store.
  4. It was on an business trade account. But I wasn't invoiced as I had not collected the goods.
  5. Hi sorry for asking but I previously made a purchase for some products at an electrical wholesalers as a business. I cancelled the order before I even had the chance to collect the goods as my customer cancelled the job. I was charged 600 pounds restock fee as they said they are charging 25% fee as the goods were ate the store ready to collect. My question is that I never received the goods nor was I invoiced fir the goods but they charged me a restock fee.

  7. Thank you for the info. Unfortunately there is no stacks of cash. The only items of value are the TV'S and the kids games consoles. Nothing that's owned by the Ltd company or business related. Is it worth calling them to tell them this.
  8. Yes it was. There was also no personal guarantee. I'm just concerned that the hceo will gain entry and take my personal belongings and I won't be able to prove they are mine.
  9. Hi. I was a limited company. The company has not closed down yet but is being processed. As I said the company was registered at my home address but for a mailing address. There are no business assets or anything.
  10. Hi all. I had a business that has ceased trading as it didn't go as well as I'd hoped and I had a debt with a mobile provider. Cut a long story short, the debt was for £3400 and it has been passed to a HCEO. I have found out that it went to court and a ccj was issued by default which has now been transferred to HCEO. The business was registered at my home address just for administration purposes and there are no assets or anything to do with the business at my address. Can the HCEO force his way I to my house and if so can he take my personal belongings. I have read that I have to prove that the items in my house belong to me or they can take them. How do I do this. Thanks

  12. I have had a look at the threads and the arguments proposed but I didn't see any successful outcomes to the arguments. I couldn't afford to pay legal fees trying to fight it in court. I did write to shoesmiths solicitors stating that I didn't fill in the application form as it was done in the screwfix branch by a chap at the counter and I was just asked to sign at the signature section. I also stated that I wasn't told by the member of staff that I would be providing a personal guarantee if anything went wrong and that on looking at the application that I was sent in the court documents that it looked misleading. The response from shoesmiths solicitors was that I am responsible for reading what I sign and that it's not misleading at all and that the wording is totally acceptable and legally binding.
  13. Hi Yes have been served a claim form to My home address. I have filled it in accepting the debt and offering 50 a month. But what I don't want is for them to accept the offer and obtain a ccj then transfer it to a high court.
  14. Hi all. I was running a limited company as a director until may last year when it all went wrong. Most of my suppliers were paid except a couple, one of which was screwfix. I have just had a letter from shoesmiths solicitors saying that I have a personal guarantee and that they have gone to court to get a ccj on my personal name and file. I have checked the paperwork and I am liable. The only question is that if I offer a repayment offer and the accept this and I get a ccj. Can they they push this straight to the high Court for a writ as the amount is approx £2200. I am happy to pay the debt but don't want a hceo knocking on my door. Look forward to any assistance. Thanks I just want to know that if I keep up the accepted repayments can they still transfer the ccj to the high courts.
  15. Hi. My 2 eldest children are autistic and do not like people who they do not know visiting our home. I understand that an HCEO can visit any address but there is only our personal property here and no company assets so can he take them and do I have to prove they are ours.
  16. Thanks. My car has been outside the house both times and he has not levied against this or clamped it or even threatened to take the car. The car is in my name only as well as my van. Is there anything I can print out to show him that he cannot just chase the debt at my home address or threaten to take goods or even just walk in the door. I also have 2 disabled children at home. thanks again for all your help.
  17. Hi all. Bailiff HCEO turned up today when I was not there and just walked in past my wife. Luckily the kids were upstairs at the time. He said he was going to seize goods unless she can prove they are not the company's assets. My wife told him to get out and that this is a residential address and nothing to with the business. He left and sat in the car outside. I spoke to him as he gave my wife his number. He has asked me to prove that the items in the house are not the business and also to prove I am not trading. I told him that the business premises was closed in January and there are no assets or bank account which there isn't. He said that the company still shows as active online. Said to him that it takes about 6 months to close. Can he come back and take my goods from the house or enter the house at all.
  18. Hi All, I was running my own limited company when it fell on bad times and I ceased trading in January 2015. I only had one creditor which was Howdens Joinery for about 2k. Today my wife opened the door to a HCEO from Equita asking to speak to me regarding a business debt that I am liable for. My wife explained to him that I no longer trade and that the registered business address was not my home address and also that I had sent a request to companies house to close the business down. I have no business assets and no business premises. He left a letter with my wife addressed to the company but with my home address on it advising that they will return in 7 days if I do not contact them to discuss and pay the debt. Again, there are no business assets at my home and my car is registered in my name. Can he remove goods from my home or take my car? Would be grateful if anyone could assist as I want to call the back but need some feedback. Thanks
