  1. Dx many thanks for your guidance, i got there in the end. Date for submitting my defence is 26th Sept 2023 Particulars of claim below The defendant (d) is indebted to the claimant (C) for a parking charge(s) issued to vehicle xxxxxxx at Mcdonaldds Bristol. 2. The pcn details are .......... 3. The pcn was issued on private land owned or managed by C. The vehicle was parked in breach of the terms on C's signs (the contract) thus incurring the pcn(s). 4. the driver agreed to pay within 28 days but did not. D is liable as the driver or keeper. Despite requests the pcn(s) is outstanding. The contract entitles C to damages. AND THE CLAIMANT CLAIMS 1 £170 being the total of the pcn(s) and damages. Interest at a rate of 8% per annum pursuant to s.69 of the county courts act 1984 from the date hereof at a daily rate of £0.02 until judgement or sooner payment 3. Costs and court fees.
  2. MCOL - MoneyClaim Online - Welcome WWW.MONEYCLAIM.GOV.UK I cant login to the MCOL website. When i try to login it just brings up the government gateway login window, i use the claim number and provided password but it does not seem to work. Am i missing something here?   5. Hey guys i am still in my house 1 month past the eviction date. I had a problem which prevented me getting another place, the new job i was in there had a 3 month probation period and this meant i could not get references. So that has probation period has passed and i can start looking again. I was informed by the letting agent that the landlord had started legal proceedings, i was told the legal proceedings would stop if i moved out. They could not tell me if im responsible for any fees if i did move out before it went to court. Can anyone tell me if i am legally bound to pay any fees if i move out before it gets to court? thanks all

  8. @dx100uk thank you for your help and i am sorry for taking your advice the wrong way, i struggle to do day to day tasks and i find it harder to deal with matters like this and write letters. I would happily pay someone to do it on my behalf but i have to force myself to do it sometimes. Thankfully Dave has written a template letter for me which is a massive help. I have written the letter and done 2 copies. 1 to DCBlegal and the other to UKPC and i will post them tomorrow.and get proof of postage. Re the sar, we can leave that for later if needed. Thanks to Dave he has helped me with the template letter, i have done 2 letters and it tackles the snotty letter and the change of address. @FTMDave Many thanks for your help, i cant thank you enough for doing the template letter for me. I did find it hilarious when i read it too, well done indeed. I struggle to write letters now so i am very grateful that you did this for me. I have done the 2 copies of the letter and i will post them tomorrow, i will get proof of postage too. Thanks again. @lookinforinfo many thanks for your help, i read your post thoroughly with great interest and im very impressed at your legal attention to detail. It just goes to show what a bunch of morons they really are. Dave has kindly done a letter template for me, i have done 2 copies and i will post them tomorrow.

You went from hero to zero. @FTMDave - The recent letter from DCBlegal was sent to my new address so maybe they got it from the voters reg. @Nicky Boy - Thanks for your reply, it is easy to lose an old email i think everyone can relate to that. IM from Scotland so im not used to bombardment of parking charges in England, i guess its wishful think that they will all go away but this one has come back to bite in the bum. How will a SAR affect the letter of claim?
  10. Hi Guys many thanks for your patience. It took me a while to go through everything and provide you will the correct information. Here is my questionnaire. 1 Date of the infringement 09-12-22 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 13-12-22 3 Date received 11-01-23 BUT!!.. – This was during the xmas period and there was also the mail strikes going on. It was originally sent to my old address in South Wales, it was then redirected to my daughter in Glasgow, Scotland because I had been living in a hotel for a short period of time and i had no address. My daughter is young and she was not opening my mail very frequently so she had no idea that there was anything urgent there. had a redirection set up from Nov 2022 to Apr 2023 (6 months). I did email UKPC all this information and tried to appeal but they told me I missed the deadline to appeal this PCN. 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes 5 Is there any photographic evidence of the event? yes 6 Have you appealed? [Y/N?] post up your appeal] yes but i was told I had waited too long before appealing, I explained the reason why I missed the deadline but they did not seem to care. I don’t have the email or ref number sadly. Have you had a response? [Y/N?] post it up yes but im sorry I cant find the email 7 Who is the parking company? ukpc 8. Where exactly [carpark name and town] Mcdonalds Bristol Patchway, Bristol. For either option, does it say which appeals body they operate under.   14. Hi Stu many thanks for your reply. I managed to get a hold of Shelter as per your suggestion. It does seem like everything had been followed properly and the notice is valid. As mentioned i can stay beyond the notice date but it looks likes i will have to pay the court fees which can be up to £500. So that is still an option if i have no choice but i do want to avoid those fee's. I have found out that the landlord has decided to sell and that is why i am being evicted. At least it makes it more acceptable knowing its not being done out of revenge. So maybe i can ask for some more time to work around this situation and find a place to stay. It would have been better if it was handled better and given this information at the start.
  15. Hey guys after reading those articles on the Shelter and C.A.B websites, it looks like i will be charged for any court fee's, is this correct? It looks like i will need to move at some point so maybe i should start looking for another place, i'm in the Bristol/Gloucester area so it might take a while to find a place and for my application to be accepted. I cant get a hold of the Bristol CAB, the site says the opening times are to 5pm, i phoned at 4pm after work and its closed, i fear my half hour dinner break wont be enough.
  16. Stu - sorry for the late reply. It does look like they have done everything correctly. I cant seem to get through to the local CAB as by the time i get home the offices shut at 5pm. Ill try and call tomorrow before i drive home.

  18. many thanks for your reply, i had a quick look through the link you gave and it suggests contacting the CAB to get advice if it is an eviction because i asked for repairs. I will go through it tomorrow in more details to see if the section 21 is valid or not too. The landlord is in America and i deal with a letting agent. I was not given a reason but i will send an email and ask the question. It seems obvious that it is because of repair requests. Ill let you know what they say. I moved in here in 5 months ago If i refuse to leave as requested, if they go to court am i likely to incur any costs or fee's? thanks
  19. I have obviously overdone it when it comes to asking for repairs to this house that im renting. I have been given a section 21 notice of 2 months to leave by the letting agency. Do i have to leave on that date? I have severe mental health issues and i really don't need this right now. Can i appeal against this? Evil landlord strikes again.
  20. Unclebulgaria many thanks for your reply. I am in England at the moment, when i was living in Scotland and up until the end of 2021, your housing benefit is paid through your UC account. Thats why i was thinking that because of my late wages i will lose it all. From what i know council tax follow the UC assessment periods too so i will lose out on that too. So i wont be able to recoup the housing and council tax benefits.
