  1. I doubt they will even show up in court, isn't this all an abuse of court process? Can anyone make them care? Ah well it's their money !

  3. I'll have to check but what I meant was what if it becomes statute barred before a verdict is reached I.e during the case
  4. defense filed today can this legal action be a bid to extend the 6 years statute barred which im guessing may be due soon? does an ongoing case extend/prevent a dept becoming statute barred ?
  5. Ok they've sent me nothing back , no cca no response to my CPR 18 and 31.14 i must file a defense soon , any advice/ template on a defense?

  7. ive had no DN or any communication from cahoot , im not even sure when i made my last payment some time in 2004 i think so not quite statute barred yet i sent a CCA to RW last january 09 but just got an illegible photocopy back ill send a CPR31.14 request to them , ill look for a template on here
  8. hi ive recieved court documents from Robinson way from an old flexible loan to cahoot/abbey of 7,000 , ive filed my acknowledgment of service but am confused as to the next step should i send a cpr 18 or CPR31.14 request ? the POC are a bit vague "THE CLAIMANT CLAIMS OUTSTANDING MONIES DUE AND PAYABLE BY THE DEFENDANT UNDER AN AGREEMENT WHEREBY THE DEFENDANT AGREED TO REPAY WITH INTEREST THE VALUE OF THE CREDIT OBTAINED" ive never had any agreement with Robinson way ive checked with cahoot and they said they closed/sold on the account in december 2008
  9. Is the UK unique with 6 years? ive heard other countries its 3 years wouldnt that be an idea to reverse deflation and the credit crunch if it was 3 years?

Just to end this thread i ended up with the help of a relative giving them a full and final payment offer that was accepted at about 70% of the amount owed im still upset that the law can be used to force the sale of someones home for what was originally unsecured dept my advice is to fight them every single tiny little step of the way dont let things get so far like i did

  12. "Morgan Stanley accounts were bought by goldfish" Thanks for the info , the Cabot clowns are writing to me about a goldfish card and i was mystified as id never had one but i did have a Morgan Stanley one. i have cca them and await the usual nonsense about them not being the original creditor
  13. i have a secured loan with Igroup (now GE Money) and they have fined me many times, i think its £35 a time when im late with payment

I was 1 month in arrears with my abbey mortgage and they wrote to me saying they were sending someone to pay me a "home visit", i then wrote to them requesting they did not do this. they have since written to me me saying the person had visited(i have seen no evidence of this) and were now charging me £79.90 for the unwanted ghost visit and added it one to my mortgage! ?? has anyone had this before? or advice on what to do about it?
  15. i assume u have already CCA requested them you must download forms 6.4 and 6.5 , application to set aside a stat demand on the form you say you DISPUTE the ENTIRE DEPT you dont know what this dept is and who they are and you have writen to them asking and they have refused to provide any documents supporting their claim that any money is owed i.e failed to send a)copy of the alleged agreement b)copy of the deed of assignment

I had a stat demand from these muppets a year ago and had it set aside, they refused to even bother contesting my set aside , then they gave me another one 6 months later , this time i didnt even bother to have it set aside as they just seem to do it for fun. Still go ahead and set it aside but you can relax, they are using the SD like spam mail these days.
  17. ok ive filled in section B and requested that i resume monthly repayments Do i wait to the hearing to show my income and expenses form or should i file with the acknowledgement of service? also when im in court will i need proof of all my income and expenses?
  18. so i pick section B in form N210 " i intend to contest this claim" then propose another way? i.e pay arrears and continue with previous monthly payment arrangement?
  19. sorry for the confusion , i have a mortgage 85k with ABBEY and a secured loan 25k GEmoney all payments on those are up to date ; plus this CCJ from natwest/shoosmiths of 10k = 120k total secured dept, they valued the property at around 160k and want to force the sale to get their 10k
  20. They have a copy of a letter before action in the court bundle which they say they sent out in Feb but i never received i was paying £50 a month and the arrears im guessing is about 1,000 , the term is until the full amount 10k is paid off i think
  21. i wrote to Nat West offering a reduced final settlement (money from a relative) as i was having trouble making monthly repayments which they refused. I then missed about 10 payments so thats my fault Shoosmiths never contacted me until i got the original charging order that i didnt contest as i thought i would be selling soon and i could pay them off . I didnt imagine they would be so aggressive in forcing a sale as i have to pay this off when i sell myself anyway. Ive had no contact with Shoosmiths apart from the court documents

I fell behind on payments of a CCJ of approx 10,000 to Natwest last year Shoosmiths then obtained a final charging order against me which i did not contest as i intended to sell my flat and pay it off due to the property climate at the moment i havent put my home on the market and out of the blue i received an application for an Order of sale from my county court . I had wrongly assumed they wouldnt go for a forced order of sale and would be happy to wait until the property is sold. They have externally valued my flat at what i think is 10k less than its true value It seems they are determined to force the sale of my flat and make me homeless, i have 2 weeks to respond with the N210 form Any advice on what i can do? or what defence section to fill in on the N210
