AS you claimed (yes proove in front of you) to have settled this account with B O S prior to the account being passed to 1st credit finance ltd under the financial services Associations DISP 1.7.1, A copy of your complaint has been forward to the BOS who will issue you with a final response in this matter Regarding your comments about the permission to process your personal date we would refer you to part 1 of schedule 2, paragrah 6 (1) of the data protection act 1998 schedule 1, part 1 to the data protection act 1998 the DPA sets out the first data protection principle 1 personal data shall be procced fairly and lawfully and in particular, shall not be processed unless a at least one of the conditions in schedule 2 is met and b in case of sensitive personal data at least one of the conditions in schedule 3 is also met schedule 2, paragraph 6 of the data protection act 1998. 1 the processing is necessary for the purpose of legitimate interests pursued by the data controller or by third partyies to whom the data are disclosed, except where the processing is unwarranted in any particular case by reason of prejudice to rights and freedoms or legitimate interests of thedata subject We consider the interest of debt recovery a legitimate interest and 1st credit ltd being third party to whom the data as been disclosed As a result your data will remain on our system and will continue to processed lawfully in accordance with your request your telephone number will be removed off the account but has been retaind for use should postal correspondence fail to maintain sufficent contect with you. IN VEIW OF MY FINDINGS I DO NOT CONSIDER YOUR COMPLAINT TO BE JUSTIFIED AND HOPE THAT MY EXPLAINATION HAS BEEN HELFUL IN SETTING OUT CLEARLY WHY I HAVE TAKEN THIS VEIW (although you have proove:-)) Your account will remain on hold in the meantime and we will contact you again in due course our aim is to resolve all complaints internally and we hope that this matter has been resolved to your satisfaction. However in the event you remain dissatisfied with our response you may refer the matter to FOS with in 6months of this letter a copy of the leflet is enclosed you may also contact our trade association the credit services association well all what you think:-)

  4. hi Donkey B well received a letter a few weeks ago from drydens saying they were getting in touch with there clients have,nt heard anything, just checked my file it seem that lowell have started to update my file and used the £1.00 i sent drydens for a copy off the cca lowell have,nt updated for a few years:roll:
