I cca'd Lowell and SAR to original creditor... Never got a single thing from Lowell, as is par for the course with them...they never have any paperwork on the debts they chase, they just hope you will pay up because your so scared of the legal process. They have ignored 2 court orders to produce docs in my case...thats because they dont have any!

Debshe... welcome to CAG...as Silverfox has said cancel your card ASAP...do not allow Lowell to take anything...Please do it! DO NOT SPEAK TO ANY OF THEM AGAIN OVER THE PHONE, everything must be done from now on in writing. Do not worry or get yourself in a state over this (easier said than done...yes i really do know!) You can, and will, get this set aside, believe me. I am going through exactly the same, SD from Lowell, i will help you through as best i can...others will be along shortly in their hundreds!!! Well i am back to court on tuesday! Hopefully it goes in my favour as the last court order Lowlife ignored was an "unless" order. I will be armed with costs! MJ:)

Hi fmotl, and welcome to CAG:D What you need to do is get it set aside, using a form N244, the court fee for this is £75:mad:. We will need a little more info on the debt, was it a credit card or loan, any PPI or interest added on? Post up these bits then someone can tell you more. Hi derek.. You have to attend a hearing to have the sd set aside. When you take in your 6.4 and 6.5 you will have to swear them in then you get a hearing date..which you MUST attend. If you need help with filling in your forms, just ask. MJ:)

yes keith sorry just read your "history" paragraph... not SB! I received exactly the same MBNA application form that they tried to pass off as a full blown credit agreement..in 2008...mine was eventually struck out i will post a link to my old one if you think it may help, mine was looked at and i was told it was unenforcable. Keith...on the first page of the Ts & Cs it shows the new £12 charge for a returned DD or bounced cheque...so these are not the original ones...as it looks like this card was issued in 1997!! this could be the statute barred route?? hope this helps and im sure someone else will be along to confirm for you good luck MJ:)

update.... letter and court order received today as follows: On the hearing of an application by the Applicant for an order that the SD issued on 10th sep be set aside upon reading the Applicants letter AND UPON READING THE EVIDENCE and upon the DJ directing that this application be brought forward IT IS ORDERED THAT 1. The application to set aside the SD listed for 4th may be vacated. 2.The application to set aside the SD be listed for hearing on tuesday 13th april time of 30 mins. Well back we go:mad: MJ:)

Hi ron.. These are just the process servers (the ones instructed by the creditor to serve you with the sd) when you get the sd all the details of who and when and how much will be listed. Post back when you get it, then you can get some help to get it set aside. MJ:)
