  1. We have requested a Welfare Rights officer to assist us with the ESA50 form, form to be returned by Nov 2nd. Still awaiting the call out from WR, they are very busy. My wife asked her G.P for a medical certificate or a letter for evidence of her condition, which we thought would necessary to return with the ESA50 form. However, the doctor who fully supports her condition and agrees that she will never be fit enough to return back to work said that a medical certificate was not necessary at this stage. Medical Certificates and letters are usually requested from the DWP when they make a request. Is this information correct? seems to conflict other persons views with the ESA changeover.

  3. My wife is currently on Incapacity Benefit she recently had a letter to migrate from IB to ESA. After reading on the changes I am shocked, it appears that very few candidates will go onto the support group. She cannot walk 50 Yds and needs assistance for any limited walking that she does do. It looks like the ESA may classify her onto the work related activity group?? that is just an assumption going by other people experiences. If this is the case will she be allowed to have assistance (an aid) to get to these work focused interviews ? Am I allowed to go along with her to these interviews? and in the event of her being put back into work, am I expected to go with her to her work place? I just cannot believe what the new ESA system is requesting for genuine disabled people to do!

  5. I am hoping to claim a carer's allowance for my 92 mother who is registered blind. My wife is currently on incapacity benefit which is due to stop and change to esa, esa forms etc. have already arrived. Reading the requirements to qualify for the esa support group appears to be just about impossible, she cannot walk for more than 50 metres. So how an earth she is expected to return back to work is beyond me! If I do claim a carers allowance for my mother, and I do currently spend over 35 hrs a week helping her etc. Can I also claim income support for wife? dont think we will manage just on the £55 per week carers allowance.
  6. I have sent a letter to the secretary a few weeks ago, no reply. I would had thought that an acknowledgement letter would be the least thing that they could do, especially with the mention of a small claims action taking place. I am no expert in liability insurance, but I hold the club fully responsible they were fully aware of the fence problem and are negligent in getting this fence sorted out, which was reported back in Feb 2010. It is up to the club to seek reimbursement from their liability insurance cover, that's if their insurance policy will allow a payment when they discover that the fence is inadequate.   7. Thank you for your reply. The club issued a letter to the residents several months ago stating that any damage to residents cars have to be reported to the club by letter so that it can be handled by the club's liability insurance. The reason for the club issuing this letter is due to an inadequate boundary fence at the grounds and the ball leaves the grounds on a regular basis. I have followed the procedure of informing the club that damage has occurred, unfortunately the club refuses to aknowledge the incident or reply back to me.
  8. I need advice for issuing a small claims against a football club. My car was damaged when a ball left the grounds and caused damage on my car when it was parked on my driveway. The club is refusing to acknowledge any of my letters regarding the matter and to admit liability for the damage. Being a club I believe that the small claim procedure may be different than a company. To date I have been sending all of the correspondences to "the committee", which includes the 14 day notice of intent to start court proceedings. I found an article on the web that it is advisable to use the committee members names and personal addresses for issuing a small claims. This seems very complicated does it mean that I have to send individual court forms out to each committee member? Please could someone give me advice on this?
  9. I recently ordered a driveway alarm system from an online retailer. The item that the retailer sent me was different to the one that was advertised i.e the web page picture of the alarm was different. The alarm which I received is not suitable because of the size etc. I have contacted the retailer who has not yet replied. I would like to know who is responsible for paying the return postage? which will be quite expensive. Do I have to return the alarm in a certain amount of days because I am rejecting the order?
  10. Royal Mail lost a package that I sent abroad last June. The item was sent using the international signed for service. I was assured by the Post Office that I would be covered if the package was lost, which it has. I completed a Royal Mail compensation claim around 2 months ago and I have received nothing. I contacted Royal Mail who just informed me that there was a backlog for their compensation enquiries. This is not good enough. If it was any other company they would have sorted out the problem. I am now considering writing to Royal Mail and to give them fourteen days to compensate for my loss. Has anyone else threatened Royal Mail with Legal Action before? or am I wasting my time?
  11. I recently made an online order for a car part, the company sent the wrong make and the wrong part. The payment was made by credit card which is now been investigated by the card company for a chargeback too be made? I have contacted the company who are trying to claim a handling charge and requesting for me to return the goods at my expense. I believe that they cannot do this under the distance selling regulation where it states “If the goods are faulty or do not comply with the contract, you will (the retailer) have to pay for their return whatever the circumstances” I have written to the company requesting a refund and for them to arrange a collection for the goods. I have received no reply, so it looks like they are trying to be awkward! Is there a deadline I can give to collect the goods before I dispose of them? I am sure that I previously read somewhere that there is a time limit? If this is so it should speed things up!
  12. My daughter recently purchased a car from a garage the car was covered with a 30 day warranty. The car was working fine but 10 days after the warranty the car broke down and now it will not start. She has tried contacting the garage but there is only an answer machine and they are not returning any of her calls. She contacted trading standards who informed her that after the 30 days expired there is nothing you can do. Is this correct? It seems that this may be incorrect after doing a bit of research? TIA
