  2. We are working to the new extra hours, not signed the new contract yet.about 6 weeks have gone by and we arenot getting any answers. The new company said they would sort out extra money for the extra hours [ about 3 a week ] but have nat come back to us yet.By working the extra hours can they insist we nave excepted the new contract.Also the area we covered has grown to a 2 hours or more as opposed to 1 hour.Not heard about holiday money owed to me either.many thanks

  4. Thanks,its a new company who won the contract from A.The new contract has big changes such as more hours for same salary but they are working to try and give us some money to cover the extra hours,personaly i prefere same hours for same money,many thanks
  5. Thanks Beau,it turns out that A never informed B about the unpaid hol money,we have now been with B 4 weeks and i am due o/t money from A.I have not signed Bs contract yet .Howlong can i work without commiting my self to either contract,many thanks.

A is still running ok ,just lost this contract to B .I believe that they should have paid hol money ,they say they donot ,company B said they are still liable for the money as they are still solvent? I have looked throgh the tupe rules and cannot find anything otherthan entitlements to the no of holidays many thanks.

  8. If you tupe from company A to company B and you are owed holiday from A does A pay the holiday money to you when you change/leave A to tupe over to B ,many thanks for any replies
  9. Of course they cannot ,its take it or leave,go to the next bank and it will be the same
  10. No negotiation in terms when you sign,are you fully aware of them though,i suppose you should be.If you are aware of the terms and sign could they say you could have negotiated at that time
  11. Allowing the payment to go out of the account knowing a charge would be levied could be unfair,maybe?

  13. Why not say no you cannot have the money,what reasons do they have for allowing unauthorized payments.Is it all auto to a certain point,what or who decides it stops.This all might sound silly but just looking at another angle.
  14. Unfair Term,=Reg5 UTCCR maybe. Also section 4 of the Fraud act ,i think i might add .

Any charge that cannot be justified is unfair to the consumer and if this action puts the consumer at a dissadvantage and the only course of action is to take it to court then it can only be termed as an Unfair Term ..I have to reply to banks letter saying their charges are fine, does the above make sense many thanks

  17. Should they have all the docs they mention in the POC WHEN they start legal action, if so should this be stated and they should be put to strict proof.Although we know they cannot in this case.all the best
  18. Thanks all but the meeting was cancelled do to bad weather. Time is short now as we change in jan to new company so i donot realy know what they will do.We are at work upto and after christmas so they still have time to arrange a meeting which i believe should take place to try and resolve this before we move over.Idid phone the next higher manager twice, left a message but no reply.I am a co-worker and i will advise about the grevance point.Many thanks
