  1. Its becoming a postcode lottery, just like the health service & schools.
  2. I used the FOS for my Lloyds TSB card. Lloyds failed to provide me with statements requested in February, despite being told to by the information commissioner. So in June, i applied to the FOS, who do not require a lits of charges. I rang them last week, for an update, and was told that they had not looked at it yet. They are worse than the banks. I am going to write to them, asking who i complain to about THEM - the FOSOS? You normally have to pay a fee to have a stay lifted, but we are being allowed to send a letter. I feel this may be a good sign, that maybe the judge knows that there may be problems with their blanket stays. Fingers crossed, they will overturn them. If not, i can feel some angry letters coming on.
  3. Aaaaaaaaaarrrrrrrrrrhhhhhhhhhhhh!!! Give me strength. As feared, a letter arrived today, saying that my Barclaycard case has been stayed until 29th February. Spoke to court, and probably shouldn't have said that the judge has not got a clue what he's doing, but what the heck, i never gave my claim number. Now i have to write a letter. Will wait till i calm down though.
  4. I emailed them , but they rang me back. I was hoping for an email, so i had something in writing. Anyway, after 10 minutes, i was told that if i wanted to complain about the waiver, i should ring the complaint team.   5. Thats good news. Although the FOS are not supposed to get involved with cases that have gone to court, they do have some discretion. I am sure they would agree, that an offer is an offer, and they should pay. I think the bank may know they are on dodgey ground. Good luck, and i hope you have the cash soon.
  6. Brilliant. This one in the eye for people saying that writing to MP's was a waste of time. The FSA are more likely to listen to an MP, than an individual. Well Done.
  7. Thats great. Perhaps a line saying that both the FSA & FOS (use full names) have confiirmed that only current accounts will be looked at in this test case, and that credit card claims should continue as before.
  8. Spoke to the FSA myself today. When i asked why bank charges were not suspended aswell, as there is a question about their legality, the FSA said "Bank charges are nothing to do with the FSA. It's not something we deal with". So why did they stick their noses in then, and grant a waiver? Anyway, if you want to complain about the way the FSA has acted, and perhaps help affect the waiver revue next month, telephone the FSA COMPLAINTS LINE ON 02070 669870.
  9. You can quote what i say, but I think there is a section already for lifting stays. Might be better to get the correct jargon for it from a Mod. If it helps, i have spoken to the FOS last week, and the FSA today, and BOTH confirmed that credit cards are nothing to do with the test case.   10. Don't know why the FSA are saying that. The date as been set for January 2008. No decision on bank charges before 2008 - Times Online
  11. One of the arguements the bansk use to defend current account charges, is that it has nothing to do with a contract. That has no defence for credit cards. There most certainly is a contract, and you have to pay a minimum amount every month, on time, and stay within an agreed limit. Breaching this contract, results in a penalty for breach of contract, which is unlawful, if it is higher than the actual cost to the bank of the breach.
  12. I reported the breach of the data protections act to the FOS in June. I rang them the other day, and they said that they have not had time to look at it. 3 MONTHS AWAITING BARCLAYS, 1 MONTH THE INFORMATION COMMISSIONER, AND NOW THE FOS HAVE SAT ON IT FOR 2 MONTHS. AAARRRHHHH!!!! I JUST WANT MY STATEMENTS!!!! I was awaiting the FOS outcome, then going to court, but i think i might just take them to court now. Most people are asking for £200 + their statements, and the banks are settling before court.

  14. Its important that all complaints are put in. I wrote to OFT/FSA and FOS yesterday, regarding barclays refusal to honour the hardship rule. If they are true to their word, the FSA should lift the waiver, when it is revued next month.
  15. Here here! I for one, am grateful to this site, for all the help that i have recieved. Were it not for this site, and Martin Lewis of MSE, then this 'revolution' would never have even got off the ground. The OFT, FSA AND FOS have made things difficult for us, not the mods on here, or Martin Lewis. I have today written to all three of them to complain, as the anger should be directed at them, not each other. All ideas should be embraced. If you don't like someone elses idea, then don't attack it, just carry out another approach yourself. Many ideas may be the right way to go. But attacking fellow consumers, is definately the wrong way.

  17. I complained to the Information Commissioner and then the FOS about Lloyds TSB, and i still do not have my statements requested 5 MONTHS ago. They are useless, and in the banks pockets.
  18. I am writing a letter to FSA, FOS and OFT. The waiver is under revue next month, so its important that they have all the info. Posted this on the MSE website and got a response from Martin himself. What a guy!
  19. Barclays are already abusing the FSA waiver. They are claiming that credit cards are covered, and they are ignoring the hardship rule. The waiver should be scrapped.
  20. I did state that we were relying on a different law, and not the utccr. But she said that made no difference to the FOS position that they would not entertain any claims at this time, business or personal. I was enquiring for a friend, who did not want to take the court route. The banks will probably try for a stay in court, and from what the FOS say, may be successful. I will wait and see if we get any successes on here, before helping him proceed.
  21. Just spoke to the FOS, and they said that all business accounts, including Limited Companies, were included in the Test Case.
