  1. My case was on stay, and my local court refused to lift it. Barclaycard had not requested the stay - it was automatiically applied by my court. In a change of tact, after getting nowhere with the court, i wrote to Barclaycard pleading for them to settle, and pointing out it was immoral for them to accept a stay that they were not entitled to. To my shock, they have today refunded all my money....... BUT.... No interest, which i would not have been bothered about, had i not already filed at court...... and no court fees paid - which leaves me £120 down. If i cancel my court case, will i get the £120 back from MCOL? I would not be bothered about interest in this senario. If not, any ideas what i should do now?
  2. The FOS will take on cases if you cancel your court case. Well, thats what they said LAST week. But i have written to the court asking for my money back first.
  3. Received a letter from Loans.co.uk, saying no compensation is being offered, and telling me i can write to Information Commisioner, but i would be wasting my time.
  4. Seriously, you should have been allowed to go on. I cant see them being allowed to go bankrupt, but what if an asset stripper wins the bidding for it. Can't see them taking on any liabilities. You really have been let down by another crackpot judge.
  5. True, thats why i am pushing mine hard now. Dealing with the FOS is worse than dealing with the banks. We need an ombudsman to oversea the FOS.
  6. Not for bank charges im afraid. If they go bust, thats is for bank claims. Besides, this government might not be around either
  7. You should have appealed the stay, citing the fact that the management of Northern Rock is so poor, they may not be around at the end of the test case.
  8. Martin Lewis was assured last week, that it would be made clear that credit cards were NOT included, to help people clarify it with the courts.
  9. Thanks for the advice folks. I spoke to the FOS today, and they admitted that they were wrong, and asked me to return the original forms that they have returned to me today. The person i spoke to has marked the case to be referred to her, so fingers crossed. The whole system is a mess though, and they just don't seem to care what problems they have caused people.
  10. Originally complained to Barclays, who said they would deal with it after the test case. I therefore referred it to the FOS. In the meantime, i receieved an apology from Barclays, and a promise to deal with it within 8 weeks, under the hardship rule. Yesterday, the FOS wrote to them asking them to file it until after the test case.
  11. Unbeleivable! Barclays accepted a claim of hardship, and promised to sort it within 8 weeks. The FOS have written back telling them they don't have to honour the hardship rule, and have until February. I am livid!!
  12. I should add, that although the FOS can award you compensation, they cannot reverse the banks decision. So maybe you should accept the refund, complain to the FOS, and prepare to change banks because they may ask you to leave. In my case, a false default is against the consumer credit act and the data protection act, so i have the law on my side.
  13. NatWest can be pretty nasty. When i made a complaint against my business manager, he cancelled my business card, my business overdraft and my personal overdraft in retaliation. I therefore used my cheque gauranteed card to pay for stock, as i was short of money. I was charged accordingly. Now, having just received all my bank charges back, they have stuck a default on my credit rating. Clear reatlaition - something which usually results in compensation of around £200 from the FOS (The FOS is the banking ombudsman).
  14. It's just clicked why my limits were being reduced a few months ago. In retaliation for re-claiming charges from NatWest, they slapped a default on my account. I am currently getting them to remove it. But it has been a lot of hassel, and as knocked my credit rating for 6, and resulted in my first credit knockback ever. Compensation you say. Letter to FOS will follow its removal.
  15. Just proves what a lottery it is. I was told to write and send no money. After a month, they changed their mind and asked for £35 and the correct forms.
  16. I complained about my court staying credit cards. I reieved a letter from Halifax CC today, saying that the district judge declined to deal with it, saying that it was a matter for the designated civil judge. So if you get a numpty judge, who does not know whats happening - your basically stuck with him.
  17. I assume you asked for an hearing on the stay form then, and paid the extra. I might do that, instead of paying £35,
  18. If your CREDIT CARD case is stayed , and you cannot get it lifted, then the FOS would take on the case, if you withdrew the court case.
  19. Yes thats right, FOS is the Finacial Ombudsman Service. You are right that they are slow, but so are courts if the case is stayed. Credit card companies like Capital One, who paid up pretty easy before, are aware that the judges are messing up, so they are now holding back some offers. Follow the bank reclaim thread on the Money Saving Expert home page. Scroll down to the FOS option, and it tells you what to put on the form.
  20. The baliffs were instructed for my friend 5 weeks ago against Barclaycard. They have failed to act, and ignore her letters. My case has been stayed by the court. I told them it was a mistake. They said write a letter, so i did. A month later, and they have decided they do want £35 after all. We started this because of unfair charges. How ironic, that i now have to pay a judge £35 to correct HIS error, with little chance of success.
  21. Sorry about that - I was anwering the post above re credit cards, but should have quoted. I have made ammendments. I meant credit card claims are still proceeding. They are handling mine. Whereas my credit card claim in the courts has been stayed.
  22. What address did the correspondance come from. I am just starting a claim.
  23. You would be better off with the FOS. No fees and No stays, and u can still go to court if it fails. (Credit cards)
  24. Don't expect anything soon. I am still waiting for a caseworker to look at a letter i sent in June. Mind you, as the case may already be known to them, they may be up to speed on this one. I will see what your response is, before making a move myself.
