  2. I have acccepted their offer as part settlement and without predjudice, pointing out that i reserve the right to seek compensation. I was already a member of credit expert. Today they closed my account and refunded last months fee, so that i could rejoin for FREE using this offer. Loans.co.uk may be ordered to pay compo, so this seems to be their way of getting people to accept an offer, so that they cannot claim later.
  3. I agree. Hardly the actions of a bank in retreat. Although it is an admission that charges are too high, it barely scrapes the surface of the issue.
  4. I am already using credit expert so drafted a letter asking for my fees to be stopped for a year. But is this loans.co.uk trying to get people to accept an offer, and therefore forfeit any compensation payout which may become due?

  7. News about the OFT action was not leaked, and i doubt news of a banking defeat would be leaked. The information is stock market sensitive, and this can carry a severe penalty. That said, its a great rumour, and i can't wait to tell my friends.

All very well, but my complaint WAS about the FSA, so they are playing games, just like the banks have been doing.
  9. Just spoke to the Halifax County court, regarding my credit card stay. I sent a letter, as instructed by the court, asking for the incorrect stay to be lifted. Today, i was told that i now have to fill in the correct forms and send a cheque. I was also told that it does not matter what the FSA, FOS, AND OFT say, or the credit card companies - If the judge wants to stay credit card claims aswell, thats up to him, and there is nothing i can do about it. For what its worth, i have asked for a court complaint form. I am more bothered about the lack of justice now, than the money. Is there a thread for removing stays for credit cards anywhere?
  10. Thanks for the bump peter. Much appreciated. Rory, you are right. I am always telling people to write recorded delivery, but was so angry, i had to phone them. Chris w - that link is just what i need, and i will start writing to bank next week (off on hols today). Already complained to Experian, posted today. More a complaint about their slack acceptance of information, than my default on its own. Will keep you posted!

  12. That explains the delay tactics then. Thats why the waiver should not have included cases already started. The banks were able to abuse their knowledge of the planned test case, to stop these people getting their money.
  13. Everythin i have read, says the banks approached the OFT in June.
  14. I have an agreement to pay NatWest £40 per month. It has run for about 2 years, and the original arrears were due to bank charges. My payments are always above this amount, and on time. A few months ago, i got all my charges back from Natwest. They have now filed a deafult on my account, which as appeared on my credit report, knocking 100 points off my score. Exeprian say they cannot do anything about it. Natwest lady on phone says it looks like an error. But she then failed to return my call. Where do i start in getting this removed? I am sick of banks abusing the credit report system.
  15. Hows that worse than them constantly taking money from your account, sending you further overdrawn, and resulting in more charges. This is taken from the money you need to live on, and means you can't pay other bils - resulting in yet more charges, and more debt. At least this way, there is a chance the charges will be deemed unlawful. If not, they will almost certainly be greatly reduced. As the test case approaches, you can change banks, or get your money out. Then, if we lose, you can make an agreed AFFORDABLE monthly payment plan, something which is not an option now. By the time you see your charges, the money as already been taken, whether you can afford it or not. The waiver has given banks breathing space, and a chance to take stock. Its only fair that the consumer gets the same.

Barclays Bank have been told that they cannot add any more charges to a claimant while the OFT case goes on. http://news.bbc.co.uk/1/hi/business/6960358.stm The tide is turning folks, and although it does not set any presedence, it must help our case to get a fairer deal with the dodgey waiver.

BARCLAYCARD:- By order of designated civil judge His Honour Judge Hawkesworth QC (Halifax) IT IS ORDERED THAT This case be stayed until the 29th February 2008 pending the decision in the Commercial Court with liberty to apply, any such application specifying the reason why the stay should not apply.
  19. Just about to write to court, to try and get my stay lifted. Will let you know how i go on.
  20. Barclaycard have got a stay on my claim, due to the OFT action. Ive been told to write to court if i do not agree with it.
  21. Most courts are accepting a letter, rather than the normal form, and do not expect you to send £35. Check with your court.
  22. This is what the FOS have to say about the waiver:- "Thank you for your e-mail which has been received by the Financial Ombudsman Service. The waiver has been put in place by the Financial Services Authority and the legal action against the banks has been taken by the Office of Fair Trading. If you have any queries regarding the waiver or the action taken in the High Court I would recommend that you refer to the authorities taking the action and applying the waiver. The OFT has taken the action in an attempt to have the issue clarified as a point of law and to try and ensure that the matter is dealt with once and for all, rather than cases being considered ad-hoc. As a result, we are unable to pass comment. We must have due consideration for the law and we must apply the rules of the FSA to our handling of complaints. Details of the bank charges issue are available from our website and those of the FSA and OFT." Well, thats cleared that up then.
  23. I'm handling a friends claim, and Barclaycard failed to defend. The other day, i had the pleasure of instructing the baliffs Made me feel a bit better. :grin:
  24. HALIFAX CC have now put a blanket stay on CREDIT CARD CLAIMS.
