  1. just a wee update for the2 people who read this thread Got a court date for 6th feb 07, 10:30am, room 4, craigavon county court can't wait, only problem is i am supposed to be away over January and won't be back in the country until late on the 4th Feb so i don't think i'll get a settlement, it'll have to go to court
  2. I recieved my statements 1 or 2 days before the 40 day deadline, Barclays seem to stretch everything to the last minute. It's pretty much a waiting game, you just need to last longer than they do
  3. Just thought I'd post a few messages as I have had nothing to do the last month as waiting for Barclays to decide if they are going to submit a defense or not two points I would like to make: 1. Despite all the crap Barclays put you through to get your money back, I have to say that their customer service people are very polite and helpful (when your not ringing about getting charges back) 2. More of a question but, I am considering tackling Barclaycard at the minute, however I have that account on a Debt Management Plan. Will this make any difference to my claim, and could they then pull out of the plan and demand all the money back there and then? Only 1 more week to go until the courts deadline for barclays, so I will hopefully have something of substance to post here (Also intend to prepare a proper guide to claiming in Northern Ireland when I get a chance)
  4. Just a couple of thoughts I wanted to put out there and ask about: 1. When signing up to a bank account, credit card or other agreement, is there somewhere that you agree to the sharing of personally identifiying information with credit reference agencies? 2. I have absolutely no recolection of ever saying or signing anything to say that a credit reference agency could hold, store or share any information regarding me with anyone, again is this not a breach of data protection? Any thoughts or arguments/agreements with this and if i'm right is there any action that could be taken in regards to this?
  5. My understanding of the Data protection act is that they have recieved your request and decided that they do not require the £10 fee to cover the costs of the getting the data together for you. The £10 fee is the "maximum chargeable cost" for a data protection request, and it doesn't matter if the take £10 or nothing or anything in between they still have 40 days in which to comply or they have not met the data protection act.

Just a wee update - My claim has finally been accepted by the small claims court in NI (stoopid online form not accepting English address's) and because the bank is based in England they have until 27th October to respond, so it looks like it'll be a long haul based on Barclays late response's to everything
  7. Is that barclay card or barclays bank, as barclays bank gave me all six years of statements (on the 40th day) where as i have read that barclay card give you the old microfiche fob off
  8. You may also point that you are an individual with far less resources at your disposal than a large multinational company who has representives in your area as well as london, and that this move only assists the banks in their attempts to make people give up on their claims
  9. Just had a thought, what would happen if you asked the court for full-disclosure of the Banks costs in rejecting direct debits etc as part of your claim, and it went to a default decree? I was just wondering as it would make some good ammo if they were forced to release that information, and if it was likely to happen I would gladly refuse any offer that didn't include that information. Does anyone have any thoughts on this?
  10. Thats what i done, I gave them a call to say that i would not accept that as a final offer but before i could get any further they said that they would not be making any further offers. I rung as they leave it to the last minute and i was not going to wait one minute more than what I had set out in my timescales

  12. Can I ask did the settlement include the costs of applying through MCOL and the AQ etc?
  13. Just to sum up so far and fill in anyone who needs to know about the NI court system: 1. go to www.courtsni.gov.uk and sign up for your account. 2. Go to the small claims module and follow the simplistic instructions on the site until you get to the claim details page. 3. In the amount place your claim (do not include the 8% as allowed by the court), tick claim intrest and then enter the amount of interest you are claiming, and for the date the claim arised use the date the first charge was issued against your account. 4. In the actual box for the claim enter the information similar to what can be found on this site for the MCOL, edited for your needs. 5. Finish off the online claim including the payment (not more than £62 ) 6. You will recive a letter if asking if you want to proccede with the claim if the head office of the bank you are claiming against resides in England, Wales or Scotland as this will take more time. this is how far I have got but I will update as I go along as a bit of a guide to those claiming In Northern Ireland
  14. Carrie, I'm submitting a claim in NI and if you have any pointers on completing the form etc for us here it would be appreciated
  15. Its probably too late as the offer usually comes with an acceptance form stating that its a full and final offer and that they will continue to charge you
  16. Recieved offer for £850 (1/2 the amount) gave them a telephone call and told them I wouldn't be accepting this as a full and final service and will be procceding to the small claims court. I phoned them as the letter arrived today and my deadline is tomorrow, so it serves them right for dragging their feet, it just cost them £67.50 extra in court fees and hopefully £250 ish in interest.
  17. I can't use the money claim site however there is an online service for the small claims court on the northern ireland courts service website
  18. Also meant to ask has anyone any experiance in filling out the online service in Northern Ireland and could give me a few pointers in certain areas, ie what date is the claim made from? (I am assuming its the date of the first charge) and you can't actually attach anything ie the spreadsheet so what do you do there?
  19. I am currently preparing my form for the small claims court (I'm doing the old hard copy). In total I have recieved 1 letter from barclays after the initiall letter stating we are sorry your disappointed with our charges and we will be in touch shortly. Should I note in the paticulars of the claim that I have approached them twice and not recieved any comunication of consequence?

Just a wee update for you all, Still no reply from Barclays to the LBA (7 days down 7 to go), However Halifax appear to have frozen my account, I have yet to recieve a letter or phone call explaining why, and i was wondering If anyone has had this happen to them after claiming money back. (my account now says "Enquiry Only Service")
  21. Sorry, but I have yet another question. Barclays have 1 more day to respond to me then I send the LBA. my question is this, do i include a copy of the application form i intend to send to the small claims court? and if so what do i need to list on the claim form?
  22. Ok statements arrived and i have been better than i thought only £1700 (I say only but you know what i mean) anyhow, letter sent and currently waiting for a reply They met the DPA request by 1 day
  23. with 1 week to go before my Data Protection request expires I gave the Data Protection Officer in Barclays a phone, and was told the section that is responsible for the statements is very busy and are 4 weeks behind, wonder why?
