It all depends on which type of interest you are trying to claim for... There are several different schools of thought regarding interest... You claim statutory interest but only applicable once claim lodged at court You claim interest charged (only on unlawful fees) You claim interest charged (on unlawful fees) + statutory interest once claim is lodged at the court You claim interest charged (on unlawful fees) + interest on what they have borrowed at their standard rate You need to have a read around to see which you are most comfortable with...

First off.. To save a mods irritation( OR more accurately to obey the forum rules ) you should keep all your information in one thread... This enables others to see exactly where you are in the process and any other possibly pertinent information... Secondly, some would possibly have advocated suggesting that you insist that you accept it as partial settlement, and possibly informing them that you had no interest at this moment in pursuing this with the ombudsman as you feel that the courts is the correct forum for this issue... HOWEVER, there is nothing that you have done (that I can see !) that should compromise your claim... -
It is possible that it is to do with theft of some sort, or account irregularities. I know that when I've had my wallet lost/stolen then several of the credit cards companies have had to seemingly open new accounts to change the card number...

Well are YOU satisfied that £12 is justified ? Or do you think that it is still in place as a penalty ? The OFT has not said that £12 is necessarily fair. It has said that that is for the courts to decide... Although it will not itself investigate if under £12...

Thanks... I thought the same, but I do recall reading somewhere in one of the many discussions about basic accounts that the law changed in the 80's and I can't find the thread and I certainly can't find any legislation... -

It cannot be emphasised enough... You should not request statements... If you follow the template you will see that it requests your personal information (including charges) which you are happy to have in statement form. If you request copy statements they can charge you for them (up to £5/sheet if not more) whereas if they provide you personal information, possibly in the form of copy statements they can only charge a maximum of £10... IMO It may be better to ask for details from the opening of the account although they may come back and state that they only have the last 6 years info... (Please see the various threads regarding limitation...)

I think that you'll find that you cannot claim both sets of interest... It's one or the other... Either the interest they have charged or the 8% but not both... Although I may be wrong... As Caro suggested have a look round as there is plenty of discussion on this... And ATEOTD it's you that is claiming and you need to be confident for yourself...

You must remember that it's only the interest on the charges and not the interest on the overdraft... (Although they may be one and the same) You can reasonably amend your claim up to filing in court if they continue to add charges/interest... If you have a look around the site I'm fairly sure that they cannot demand repayment if the amount is in dispute... By the sounds of it most of your overdraft is caused by the fees... And hence most of it would be in dispute...

Just a thought to see if anyone could think of a way (or indeed if it was possible) to use this... Sec. 15A(1) Theft Act 1968 as amended by s1 Theft (amendment) Act 1996 :- ‘A person is guilty of an offence if by any deception he dishonestly obtains a money transfer for himself or another.’ Anyone think/know if we could use this against the banks ? Dishonest - They know that these are unlawful... Deception - They maintain that they are legal when challenged ?

I'm not 100% sure but... N4B is probably using a slightly anachronistic term (dependant on if your property is registered or not)... The chances are your house doesn't have (or require) deeds anymore... What I think N4B probably means is removing the note on the register refering to the mortgage charge on the property... I doubt very much whether any banks physically hold the deeds any more and if they do it's only on a very small number of properties...
