  2. If I take Lloyds to court and the case is stayed, are they allowed to keep adding more charges to my account until the OFT court case is finally resolved? Or are the charges then frozen? Would it be better for me to pay the existing charges and bring my account back within its limit and then claim the charges back when (and if) the OFT case is resolved in the customers favour?
  3. Does the OFT test case affect credit card claims? I have already successfully reclaimed my bank charges from LLoyds but also have large amounts to claim on my LLoyds and Barclays credit cards.
  4. My court hearing was set for July 27th. I just happened to look at my account online this morning and was pleasantly surprised to see that Lloyds had paid in the £1956 that I was claiming. No conditions, no threats to close my account; in fact no communication from them at all. To all of you still going through the process, keep at it. They WILL pay up in the end.
  5. Well, nearly a year after my initial letter I have finally got round to sending the letter before action. Wish me luck and I'll keep you all posted on developments
  6. Is it OK to claim a small amount, say £50, to cover the time and hassle involved in adding up the charges, working out the interest and writing the letter.
  7. Thanks CARO - you've answered my question. I thought that I must be able to claim back the interest the b.....d's have charged me as well as the capital. If that's the case though, whats the 8% for?
  8. Having looked through the site, I am clear on everything except what interest I can claim back. As I understand it, the only interest I can get back is 8% of the illegal charges, which is done when I file a claim with the court. So, the procedure is as follows: 1) Initial letter claiming back the total amount that was illegally taken (but not including interest). 2) A second letter in response to their 'get lost' reply, saying I will take them to court in 14 days if they refuse to pay up. 3) When the 14 days is up, I file a claim with the courts, at which stage I add the 8% interest. 4) They pay up after stalling as long as possible. Can someone confirm that I have got this right. Thanks
  9. Yeah, I don't suppose a compensation claim would be easy. However, to contest one, the bank would have to go to court and, as we all know, they don't want to do this. So if the compensation claim is reasonable, surely they will pay it to avoid appearing in court.
  10. Sent off my claim for £1053 plus £161 interest last week. Received the standard fob off letter this morning. I am now sending another letter demanding payment within 7 days or court proceedings will commence. Does anyone have an opinion on whether it's worth claiming compensation for stress caused, etc. If so, are there any guidelines on how to work out a realistic figure?
