Halifax/blair o;iver scott, can they do this ?
gymfreak1978 replied to kfdh1962's topic in General Debt Issues
They Did To Me But Thankfully There Was Only A Fiver In The Account. Ive Read On Other Threads Banks Are Entitled To Take Money From Other Accounts If Another Account You Have With The Bank Is In Defualt. Bliair Oliver Scott Are The Halifaxs In House Debt Collector. -
wescot are a debt collection agency who manage most of BTs overdue/defaulted accounts. You need to contact Wescot some how maybe in writing if there not saying much on the phone and find out what exactly the debt is for. If they continue to send letters, and I owed them nothing, id be down for the police station with them.

Why so many companys do not have CCA
gymfreak1978 replied to Having_A_Knightmare's topic in Debt Collection Agencies
It would probably put some consumers off having credit cards if they read a proper CCA before they signed it with all the t&c's stated clearly, for low credit limits most creditors would just give out a simple application form then accepted for a 1K card, the limits are then extended when the cards maxed out and youve paid off the mins for a few months, when the card reaches 8K-10K limit, and debtor can no longer afford to pay mins, of course theres no actual CCA. IMO this is how consumers get into big debts as no checks are made when the creditors up the limits of these cards. Wether its the creditors or debtors responsibility is the question. -

Halifax CCA Application / Agreement, does it comply ?
gymfreak1978 replied to harrythehawk's topic in General Debt Issues
this deffo looks like an application form imo, the halifax well the DCA it is with now, sent me something similar. I sent a letter saying back it didnt comply with my CCA request this was about 6 weeks ago aint heard a thing since. -
Been getting letters from Eos solutions with all the usual threats about a Halifax credit card debt, what was originally with blair oliver scott. What I dont get is why Blair gave up so easy and passed it on to Eos, cant seem to get a straight answer wether Eos have the bought the debt or not. Maybe Eos have bought a job lot from the halifax and bank of scotland, what dont have a legit CCA. Anyone with any more facts abut these Eos solutions and who they deal with, many thanks in advance

Hi Chloe you best bet is probably the co-op they wont offer you much probably a simple bank account and switch card with a £100 overdraft.

I like it how all there call staff call themselves Mr and Mrs such n such, who the hell do they think they are, reminds me of being back at school.

These people ring me everyday dont give out my name and DOB over the phone so cant continue. They bought a credit card debt of mine for peanuts off a large bank (what has no CCA) and which apparently give them the right to harrass me.

Just been to court/CL finance**WON IN COURT**
gymfreak1978 replied to bluetack's topic in Legal Successes
Its bad news the judge accepted the application form over an actual CCA. hope and prey these sharks dont come up with the statements, fingers crossed for you. -
Eos have there own solicitors called "Golds", which has the same address as EOS, and have a similar phone number only the last digit different. When checked on a law firm website, there is only one solicitor working for Golds, my guess is Eos just use the solicitors are as a scare tactic.

I think eos solution bought a load of debts from the Halifax just before the financial year was up, what balir lolover scott could get no where with, or they knew they had no CCA's, wouldve bought them dirt cheap I guess they just pester you.

Have you sent them a CCA request, its basically the first thing to do, to be sent by recorded delivery: Ref No/account No: To Whom It May Concern I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter. 1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee. 2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested. Yours Faithfully they have 12 days to come up with a CCA or the debt is toast, if you havent recived one in 30 days they commited an offence. if they come up with one your just have to arrange a monthly payment with them. In hardship cases you can offer a token payment of a £1.

gymfreak1978 replied to purple**princess's topic in Debt Collection Agencies
If they dont come up with a CCA in 12 working days, the debt is there enforceable. Ive read on here people who already have accounts with DCAs have stopped payments as later on they have not produced a CCA after sending the letter when finding this site. After 30 days they have commited an offence. -
Last week sent a letter threatening legal action if payment notmet in full, now this week there threatening a local field collector. ffs there more to life than money EOS!!

No CCA, no debt, in the eyes of the law, congratulations you have got one over the A&L Stop any payments to them right away.
