Hi everyone, i currently have 2 bank cases at Norwich County Court. The one against HSBC has apparently been stayed. (AQ sent in early July). I still have not heard from court to confirm this though. Secondly my case against Natwest, i received a letter from Cobbetts stating that they had filed a defence, i also got a letter from the court saying that my AQ must be in before the 24th Aug. My question is this, do i fork out another £100 only to find out that it is going to be stayed also? I am fed up of both banks stalling tactics and i dont know what to do for the best. HSBC case i am thinking of applying the N244 form for the application of a removal of a stay but i have not heard of any successes using this method so far. Could someone reassure me please. Yes it was. They said that i should receive a letter any day now with directions.

After being told that it is business as usual at Norwich Court i have been told this morning that all bank charge cases have been stayed pending the result of the High Court Case. What can i do now??

Just rang Norwich court and the clerk said that she has had about 200 calls about bank charges but she said that the court are proceeding as normal.

What now? I rang the Norwich Court and they said to carry on as normal. I have 2 cases (HSBC & Nat West) Hsbc is at the AQ stage. They still had not sent their AQ in friday and it was due on the 16th July. Natwest has just acknowledged service and have until 8th Aug to submit defence. I presume i just carry on following the courts directions. I believe that a lot of scaremongering is going on at the minute by the banks and some of their representatives to stop people going ahead with their claims. What do the good people of CAG think?

I phoned Norwich County Court today to find out what was happening and the clerk said that everything is proceeding as normal. Stick to your guns and dont get washed up in all the hysteria. You will get your money back!!

Nice work Birchave0. I have an Egg agreement very similiar to your marbles one so in your opinion would i be able to follow the same course of action that you have just taken. The agreement that they sent me had no credit limit or prescribed terms so i am thinking of sending them a letter similiar to your one. What do you think?

Hi everyone, i have currently got 2 bank charge claims going on and i have requested CCA from 2 other lenders. I rang HFC today because i wanted to clarify which DCA were looking after my account and as i suspected Weightmans solicitors are acting on their behalf. I currently pay £20 monthly to these particularly nasty parasites. (They put a charge on my home when i fell into difficulty with my Marbles card). When i asked for the address to send my request to they said that i had to send to HFC as they are only acting on their behalf. When i queried this they said that HFC still has full title on the debt and that i had to send the CCA to them as it had nothing to do with them!! Am i right in thinking that if they are collecting money on behalf of HFC then they have to produce the agreement or should i just ask for CCA from HFC? Many thanks for any replies.
