  1. Unfortunatley I did sign my name on my letters, but surely a company like this won't resort to forgery, will they? I have a scanner so I can scan it in, but how can I display it on here?
  2. I requested a copy of the CCA with Littlewoods through Nationwide Debt Recovery as they were starting to become difficult about my reduced payments I was sending. They sent one but it doesn't look right to me. My signature is very similar but not exact, and the date is written in a way that I never write a date. It all seems dodgy to me. It states on the top that it is their copy of the agreement, but I don't have mine. I'm not saying I never had a copy but I can't find it and I never throw any documents away. Is there any way to check that this is a genuine agreement. If it is then it's a fair cop, but I need to be sure. Thanks.
  3. I submitted my AQ to the court on Monday 25th, as this was the deadline date. I still have not had an offer from DG. When my wife was at this stage with them a few months back, she was given an offer for full settlement on the day the AQ had to be submitted. I don't know what to do now, or what the next stage of the process is. This has probably been covered elsewhere, so a link to the appropriate thread or any advice will be appreciated.

Yorkshire bank are demanded £2500 overdraft to be paid at £24 a month, as a reaction to me winning my charges back from them they cancelled my overdraft facility, and I have opened an account at another bank in case they took all my money off me to pay it back. I can't afford to pay that much and have told them this several times, but they have ignored me and now they have sent a letter from their solicitors threatening court action in 5 days. Can I send them a CCA request so I can buy a bit time while I decide what to, or does this not apply to bank overdrafts. My feeling is that this letter is the usual threatening legal looking letter trying to frighten me into paying up, but this is the first one I have had from the bank and I don't know what my rights are. Any advice as to what I can do would be much appreciated.
  5. Yeah, my overdraft consisted more than charges, but the extra money from the refund would have been better for me and I could have reduced the overdraft by a little and had the rest for myself. Now they are reducing it by £50 a month until it is paid, out of spite I think.
  6. I've got a similar problem with these 'people'. They refunded my charges but paid it straight into my account, then reduced my overdraft by the amount they refunded. I only went overdrawn in the first place because of charges. I have already opened another account with a different bank and transferred everything over to that account, but I was expecting to get the refund by cheque so I could pay it in to the new account.
  7. Apologies if this has already been covered, I have looked on this site but can't find any similar threads. I sent my preliminary letter to Yorkshire asking for my charges to be refunded. I have opened another account at another bank just in case and I was going to pay the refund cheque into the new account. They paid back my charges straight away, however they did not send me a cheque as I had expected, but instead paid it into my account I have with them and then reduced my overdraft by the amount they had refunded, so I am no better off. They said they were within their rights to reduce my overdraft when I challenged them. I only went overdrawn in the first place because of charges and now they are demanding that I pay back the full overdraft. Is there any way I can insisit on my charges being refunded by cheque or are they entitiled to do this. Having the cash would help me pay back some of the overdraft and keep some for myself. If this has been covered in a previous thread I would appreciate a link to it, or any advice would be appreciated.

  10. I lost my job last year and was unable to pay my monthly credit card bills so I set up agreements to pay a pound a month which all but one agreed to. However one credit card Vanquis refused to accept the offer and now my debt with them has spiralled from £500 to £630 with charges and interest been added for the last 5 months. Now they have sent my account to Moorcroft who are threatening legal action and are adding £165 onto my account making a total of £798. They claim that I am purposely avoiding paying the debt, despite me writing several letters to Vanquis over this period and trying to come to a payment arrangement which they have refused. I know I can claim back these charges but is there anything I can do to avoid all the extra costs being added to what I already owe them, and can I contact the court to explain the situation and that I have been trying to sort something out for months and I consider then to be unreasonable in refusing. Any advice would be appreciated.
  11. I have done all that and now just have to wait for the cheque. There was no extra AQ charge as it was less than £1500. Thanks for all your help on this site, I wouldn't have got this far without it. I can now claim back my charges from Halifax, Nationwide and Natwest with confidence.
  12. Came back yesterday after a weekend away and full offer in the post which I have accepted. I had already submitted the AQ. Do I need to phone the court to tell them about the offer.

  14. Deadline date this Saturday, I'm delivering it by hand to the court on Friday. No offer as yet, I've sent a few emails to D&G and had standard reply 'your case is being dealt with and you will be informed in due course.'
  15. Thanks for the advice, the deadline is 17th March. I have the notes on completing the AQ and am happy with filling it in. DQ have confirmed they have my breakdown and will be dealt with "in due course". I have read nettys thread and will keep an eye on it to see what happens next. Thanks again.
  16. I've managed to get this far with the help of this site and everything has been straight forward. I am now at the stage of submitting the AQ and I am confused as to what to do next. I have read various threads on here about the AQ and the general agreement is to wait until the last minute to submit it. Is this right and what happens then? Should I expect an offer from DG before the deadline date. I am confused, any help would be appreciated.
