  1. Yeah both names were on the claim form that I defended, I’ve just checked the form and my wife’s address was down as our previous address and mine our current. So they might have sent something to that old address, but we hadn’t lived there for 6 years when the claim form was sent

  4. So the N244 is just for information? It was a joint account with my wife, same account number, I just submitted one defence for the account. I denied the payments, as I have no recollection of doing so, and there is no pattern to the payments they have said I made, and they couldn't provide any further proof, receipts, or confirmation of payments made.
  5. The N224 form - do I not need to sign and return that? The covering letter ends with "At this stage, we ask that you consider and confirm if you are willing to consent to our client's application, by no later than 4pm on 16 May 2019." It was a joint account so both names were on the N1, I submitted 1 defence at the time. I submitted a statue barred defence, they said a few small payments had been made and sent a list of supposed payments made, but no evidence (attached) This was an account I had and they would increase my overdraft every month, to cover bank/overdraft charges. So it was irresponsible lending, as well as them treating me unfairly, as I asked for charges to stop and they refused. Payment History.pdf
  6. Thank you, so I do need to sign and return the form, and include my statement. There is also a mentions of defendant 1 and defendant 2. I have just submitted the defences and any forms, does this need to be done for both or can I just do it all.
  7. Thank you. I thought these had gone away, I am still trying to digest this and understand what it means. I would appreciate any help on how to proceed. I have only got until 16th May to consent to this.I have attached the N244 application notice from Shoosmiths. I think I have taken out all identifiable information. To be honest I haven't a clue how to approach this.I really don't need a CCJ now,I have worked so hard in the last 6 years,my defaults are now off my credit report and I now have a healthy credit score this is the last thing I need after so long since this account was defaulted.   8. Hi, Just received a LBA from Shulmans on behalf of UK Search, which relate to an old GB energy account, I switched suppliers when they went under a few years ago. I have previously had demands from another company who couldn't prove that the amount they are claiming is the correct amount as I said it seemed a bit high. They didn't reply, and I heard nothing for about 6 months until UK search contacted me for payment. I've a feeling that I will be going round in circles again, but now these have threatened court action, is this just a frightening technique to make me pay. I have sent them a SAR, and all they sent was the correspondence that they have sent me since the first letter asking for payment, no evidence of the amount owed.

I thought I had told them it was a not as described, it difficult to sort as I wasn’t logged into my PayPal account at the time of purchase, but used PayPal and my email address, so it doesn’t show in my account when I log in but they did see the purchase when I first rang them to make the claim. However, it’s still strange that the company do not reply or acknowledge my purchase and have ignored all my emails, but replied to PayPal.
  10. The advert I clicked on had the actual Lego box in it, and the invoice I received with the delivery clearly states “hogwarts castle” but the instruction manual is for a “magic world”

[it was over £100, and it's not showing on my paypal account as I wasn't logged in at the time, and paid through paypal with my credit card, I phoned both paypal and credit card company immediately after making payment, but neither were interested. OK so I didn't think, my fault, but surely that's not a reason to accept that this company are [problem]mers, and forget about my money, what happened to buyer protection, didn't see stupidity being a reason for not claiming.

I did something stupid, something that I have told my kids over and over again not to do, but I clicked on a Facebook link, to a Chinese shop called Sweet Offerz, advertising the Lego Hogwarts Castle, for half price. I paid using PayPal, but not logged into my account at the time, as I couldn't remember my password, and used a credit card for extra protection. As soon as I had made payment, I regretted it, and thought it was a [problem], so I immediately phoned both PayPal and my credit card company to see if I could stop payment, and explained that I thought it was a [problem], but neither would do it, and said I could raise a claim if the item wasn't received in 30 days. What arrived through the post was a box full of cheap, bad quality plastic bricks, not Lego and instruction books to make a "magic world castle" not a Hogwarts castle as advertised. I thought, I'll just claim my money back through PayPal as what I was sent was clearly no what was advertised, and I thought PayPal would accept this and that would be that. However PayPal have ruled the claim against me and I am not getting a refund, as the company sent proof of the item being posted and delivered, which wasn't the basis of my claim, but they won't budge. I have contacted Sweet Offerz, through their email address supplied by PayPal but they have ignored all my messages, I have asked for a refund, and to return the item but they don't reply. Also I can't log in to the account I created when buying the item, and their site does not recognise my email address when I try to recover my account details, the same email address they sent shipping details to. I should have known PayPal wouldn't be bothered to help, they never do, but is there anywhere else I can take my claim.
  13. Hi This has returned after nearly 4 years. Why are they still pursuing this after the initial court claim ended when the didn't respond after I filed my defence. The document "shoo" is the what they sent asking for the outstanding balance of £2488.72. The last paragraph is interesting, they have finally, after 4 years received a response from Yorkshire. Nothing has changed, they have offered no further information. The document "Cabot" is interesting. I have been receiving these regularly, but this amount includes the fee for the last court claim they issued, which the letter from Shoosmiths doesn't but is dated after. The document "payments" show supposed payments I made, but can't offer any further information. Can they claim through the courts for the same thing twice? Should I just ignore them? The debt came about around the time of the bank charges reclaims. Yorkshire were charging me around £100 a month in charges, so would up my overdraft to cover them, then the same would happen the next month and so on. So irresponsible lending, which should be a suitable defence in itself. However I still deny making those payments they claim I have. Any advice would be great.   14. Call credit have confirmed that exactly the same information is shown on both the free Noddle and their £2 reports, so I don't see the point of paying for something I can get free.
  15. At my current address for 10 years I always pay more than the minimum amount, and have been for the last 2 years. I wasn't aware that we are not shown everything on the free version of the credit report, so what's the point of it. Even a questionable entry that you challenge is ignored by the CRA, they sprout the usual "we have been informed that it is correct, so we can't remove it"
  16. OK thanks. I'm not giving up without a fight, if they know exactly why I was refused, but they are not telling me, then I need to know why.
  17. neither the bank or call credit will let me know the exact reason or what exactly was reported by call credit for the refusal (They only said "something" reported by call credit, NOT specifically what that "something is"). No late payment, no defaults, no unauthorised overdraft, no over limits on credit cards, loans paid on time, not a lot of credit applications. No reason that I can see. All I want the bank to say to me is "The reason you were refused the overdraft is ("this entry on your credit file") that ONLY call credit have reported.

You are encouraged to check your credit file and when you query anything that you don't recognise you always get the same bull from the CRA "We have been advised that this is correct", not interested. I was recently refused an overdraft from my bank, despite having a loan and credit card with them I was informed after the online application that something reported by call credit was the reason, I phone the bank and asked them the reason, they said to contact call credit which I did, who told me to contact my bank. Being fobbed off from all ends. My credit report has nothing on it to suggest why i was declined, everything paid on time, never over my limits, salary going into the bank every month etc. the bank won't tell me why and call credit won't tell me why. No adverse reasons from the other 2, only call credit. Also, I know credit scores are just a guide but experian and equifax are showing "Fair" while call credit shows "very poor" and have been stuck on the same score with them for 6 months, what's that all about? Is it not my legal right to know why I have been refused credit?
  19. I have, 3 times, and all they send is threatening letters, as above. There's a formal complaint letter on the way, whether that does any good remains to be seen. Any point in the energy ombudsman?
  20. All the letters I have received, just the usual threat-o-grams. I received letter4 yesterday with the threat of the doorstep monkeys.   21. Just a quick update, they have ignored my letters and are now threatening legal action, I have started making payments of £20 month, I know I owe something, it's the amount I'm querying. I'm more worried about them being arsey and sticking a default on my credit file, cos they are impossible to get rid of. Any ideas, is it worth going to the ombudsman, my thought is probably not.
  22. Hi, I was a customer of GB energy for a couple of years, and was still a customer when they went bankrupt, I switched suppliers as soon as heard of their demise. A couple of months before this happened I switched bank accounts, and tried to change my direct debit with GB but couldn't get through to speak to anyone about this, and they had no method of paying bills or changing details on their website, so I was stuck for about 3 months unable to pay anything to them. This still wasn't resolved when I switched, and they tried to block it but it eventually went through. They are now claiming I owe them (co-op) £500. This was because I was unable to make any payments, as I was actually in credit when I changed banks. and they are demanding payment. I also think they continued to charge me after the switch. I just want some advice as to where I stand with co-op and this debt, as I was under the impression that I might not have to pay back any/all of ant outstanding balance after GB went under. And as I am now paying my current supplier, can co-op demand I pay the full amount back, and how can i check that this amount they are claiming is correct. Thank you
  23. Looks like it's the end of the matter, fingers crossed I don't here from them again. It's well over 28 days since I submitted my defence, and have heard nothing back. Do I have to contact the court or is there something else I need to do?
