Bought a car on 31/8/13 from a dealer it was second hand but in good condition Drove home approx 70 miles and parked car as it was un taxed and was going to be done on the Monday ( clamped by DVLA on Sunday morning and towed but that is a different issue) On Sunday discovered a large pool of oil under car Phoned dealer on Monday morning informed him of problem with car and was told he was busy but would collect with a transporter on Wednesday 4/9/13 Got car back from DVLA pound on Thursday morning as need it to get to work for my new job Left car now taxed for dealer to collect from my home. Had to move vehicle on Saturday but discovered that the clutch has now stopped working and you cannot select gears or drive vehicle Called dealer Saturday 7/9/13 to inform him of new problem and ask when it was going to be collected as I was still waiting. He just said what do you want me to do about it. I informed him that after only 100 miles ish that I thought it was unfit for purpose and he should collect and give me my cash back. His reply was take it to a garage for repair not his problem I informed Hom that the vehicle was given a warranty by him and he told me that he was to busy to come collect the vehicle as promised as they were short staffed and that was that. Further to the above issues the vehicle has got a clink on Nearside when turning a right corner and the air on has stopped working. Am I right in assuming that with the above faults and his reply to my calls that I can claim that this vehicle is unfit for purpose and force him to collect vehicle and return my cash ? Also as I have to keep the vehicle safe and I shred whilst in my care is it fair to charge storage fees while I am waiting ? Any help would be appreciated
  7. I am in a quandry as to what I should do. I received a letter yesterday informing me that I owed a debt collection company £183 for a firm that I have never heard of. So rightly or wrongly I called the firm and asked to speak to someone regarding this matter. After the usual idiot on the phone informing me pay up or see you in court. I actually got to speak to a very helpfull guy, who told me that this debt was an account taken out in 1994 which was defaulted 3mnths later. I asked for him to send me information on this because I have no recollection of any such account. He then informed me that there were 2 other accounts in my name that they would be looking to receive payment for. (Both apparently PC World) On asking him to confirm the details of these account he said it was my responsibility to prove that I did not owe the money and not theirs to prove I did. Although helpfull this guy would give me no further information regarding the supposed debts. But what he did say was the address at which these accounjts were registered. It is an address that I have never lived at and have no connection with. I have tried to speak to the police but did not get very far. Does any one have any suggestions as to who I should contact with regard to dealing with this? Any help will be very much appreciated.
  8. Hi Good luck with your claim you will get your money back. I have this morning received a letter from Cap1 agreeing to pay it all back except the interest I have claimed. I am not accepting this and am just about to write and confirm this. They charged me 29.9% on these charges and I want it back. LOL Anyway good luck. You will end up issuing court proceedings but it will come back to you in the end.
  9. Hi it seems to me this is just their way of dealing with it. And delaying us in our fight for our money back. As soon as you get your statements and ask for your money back it will then be escalted to barclays head office to deal with. It does not matter you will win in the end. In my case they have 7days until MCOL.
  10. Hi. Well the choice is yours really but it is your money that they have edit. And it would at least pay for a night out.   11. Hi Guys/Mods Thought I had posted under this but do not seem to be able to find original thread so maybe I didnt do it. LOL As am having so much fun with all these banks and credit card charges. Anyway having done the DPA request and having had a reply (Within 10 days) I decided to send off the prelim letter asking for my money back. Due to having had a car accident and getting my car written off 2 weeks ago I had forgotten to send them off the LBA, And I had received nothing from them not even an acknowledgement so it had slipped through the net. Well Low & Behold in this mornings post cam a nice letter from GE sayiny the usual despite this and that Blah Blah Blah Then finished with " Upon investigation into your account the total amount to be refunded is £306.00. This amount will show as a credit on your next statement." Well that was a nice start to a saturday and I have the whole weekend off as well. Beers on me tonight me thinks LOL:)
  12. Well I have given them the extra time and they have refused to increase their offer so I have just issued through MCOL fot the sum of £2226.30 incl court costs. Lets see what if anything they have to say about that. LOL
  13. Hi. In answer to your question yes it is worth going for it is your money. As for how much it will cost you need to look at the MCOL site for guidance. From reading all the other posts it is probably easier to claim in three seperate actions starting with the oldest and working forward. If the claim is kept under £5k it goes through the small claims court and you are not liable for there costs. This would be the best option in my opinion. Takes a bit longer as you have to wait until one is settled before starting the next but seems the way to go.
  14. Just a note to the mods - will be donating but will have to wait untill I have paid into my credit card as only have a few pounds left on my credit limit at the moment.
  15. Hi Jonni Yes I have to say they paid it all. Everything I think the only thing I forgot to claim was the £10 DPA fee but I dont think I will worry about that. LOL At least now I can start MCOL with the others without worrying about where the money will come from.
  16. They Have Paid In Full - Yes, Yes, Yes I am sitting here in a total state of shock. Just opened the mail this am and there it is in black and white. They have paid up in full. Just to make sure before I did anything I checked it out online and it is true. For the first time in a very long while my account has a very nice positive balance. I cant beleive it but it is there in my account. The letter is the usual dont admit liability but due to blah blah blah. Who cares I dont. I can now afford to claim against the others through court and then maybe a little holiday. The only really bad thing is I am working tonight so will have to wait until tomorrow to celebrate with a lemonade or two (and if you beleive that it will be lemonade then you dont know me) Might even splash out on a bottle of champers.   17. It seems that cap1 refund the last six mnths charges as a gesture of goodwill. Hoping that we will go away and forget them. They refunded me £100, and then insulted me by adding a late fee the very next day. To be honest I was having so much fun with all the DPA's etc that I forgot to pay it on time. Oh well just think of it as a savings account.
  18. Further to MJanet post. I have just had a similar call from Heatons the solicitors who act for the woolwich. I informed them thaqt I was disputing the balnce and that it had been acknowledged by the woolwich. The helpful gentleman at heatons just asked if I could fax him a copy of my letter to the woolwich which i did. He then confirmed that he could do nothing as the amount was in dispute. And that he would put that in writing for me. So hang in there and dont worry:)
  19. You must make your own decision on this as everyones problems are different. But I would hang in there write to them saying you will accept it as an interim payment and that you will be pursuing the full amount. I have come to the conclusion now that it is time for us the little people to stand up and be counted. I have a claim for 3k going through with the halifax and yes when they offered me a goodwill gesture I really needed the money but just thought what the heck and went for the full amount. The sweetest thing being that I used a goodwill gesture from Cap1 to pay MCOL against Halifax. Keep up the fight they will give in. Its your money but also your decision. Good Luck:)

No we cant all afford to claim at once but how sweet it will be when the first one paays up and then you can hit the others all at the same time as you are ready and waiting with the information, That is the way i am going and have issued my first moneyclaim. With the others in the pipeline when I get my money back...LOL:)
  21. Go for it we are all in the same boat and want are money back. As you are in Scotland and you can only get back 5yrs it is a stupid point but remember go afte the oldest charges first. I would hate you to miss out.
  22. I have had the same offer from Cap1 and have just replied to them saying I will accept but will pursue the difference. You just have to sit tight and go for it. You are like the rest of us it is our money and we are entitled to it back. Good Luck
  23. Well i received the usual Ackowledgement of Claim form MCOL this am. Stating that the Halifax intend to defend. They have until the 12th July it seems to enter their defence. It seems I am on the home straight now. LOL:-) :-)
  24. Hi not an expert but have asked the very same question. You would normally only charge the 8% interest when and if it goes to a court claim. There is a spreadsheet in the template library to assist you with this.
  25. Well as it seems they are now doing with everyone. Just before deadline they offer to pay the difference between OFT figure and what we have actually been charged. When in my last letter from the very busy Mr Udy he stated that they disagreed with the OFT and that Cap 1 were right and legal in there charges. So have just sent off a leeter extending by deadline 7days to give them time to reconsider and to state that I accdept there partial refund but reserve the right to claim the full amount. Roll on next tues. If no settlement then it is off to court I go:D :D
