  3. HI BACK AGAIN!! HOPE YOU ARE ALL WELL? hOW DO I GO ABOUT SORTING OUT MANAGED LOAN - TAKEN OUT LAST YEAR AS FORCED INTO IT BY HSBC AFTER GETTING INTO DEBT AND BEING UNABLE TO PAY BACK CREDIT CARDS AND PERSONAL LOAN - THEY CONSOLIDATED IT ALL INCLUDE BANK ACCOUNT OVERDRAFT WHICH TOTAL £13,500 - i HAVE MADE REPAYMENTS TO DATE BUT WHEN CHECKING BALANCE HAVE HARDLY DINTED THE TOTAL AS MOST GONE IN INTEREST. THIS WAS FORCED ONTO US AS HSBC CLOSED DOWN ON US COMPLETELY AND WOULD NOT ALLOW US ANY MONEY AND WE HAD A BUSINESS ACCOUNT WITH THEM AT THE TIME WE COULD NOT MOVE SO EVERYTIME A CLIENT PAID THEY HELPED THEMSELVES LEAVING US WITH NO MONEY FOR FOOD, RENT ETC...BASICALLY WE HAD NO CHOICE IN THE MATTER! CAN I DO ANYTHING ABOUT THIS - WE HAVE ALREADY SUCCESSFULLY WON BANK CHARGES CLAIM WHICH PAID OFF A FEW SMALL DEBTS WHICH ALSO AROSE AT THIS TIME - NOW I WANT TO KNOW IF I CAN SORT THIS OUT OTHERWISE I AM TIED TO HSBC FOR NEXT 11 YEARS WITH POOR SERVICE FROM THEM AS CLASSED AS SECOND RATE CUSTOMER FOR HAVING MANAGED LOAN AND ALSO CRAP CREDIT SCORING! ANY HELP DESPERATELY REQUIRED - I HATE HSBC AND THE QUICKER I CUT ALL TIES THE BETTER! CHEERS FOR ANY HELP RIBENA

Well after success of claimng bank charges back I am now looking into claiming managed loan interest paid to date as read a couple of months ago that this was possible? Anyone got any ideas of where the hell I start and where I need to go as cant find the thread? Hope you all good ST4 how's your claim going - any good news? Ribena:p

  6. Thanks Guys I will scan the return letter and send tonight and then send a hard copy tomorrow in the post first class as it runs from the date they receive the signed letter. I dont mind waiting I suppose I have waited this long it was just I wondered if they were just dragging it out longer......oh and the little fact that I have promised to put the money to good use and treat my twelve year old to a new bedroom makeover.....something she has never had (sufficing on second hand me downs!)........I will wait and be patient and thank my lucky stars that I have received an offer out of court.   7. Hi all Had response from DG today regarding my letter accepting their offer without confidentiality clause. They have agreed to exclude this clause but have stated that becuase their client is settling in full they will attempt to put the payment into our then we are unlikely to succeed in court. I want to accept the offer of course as its closure but I am not happy that they are stipulating they will 'attempt' to make a payment within 14 days as I feel they are just dragging this out longer! Any advice as I would like to respond to their letter asap preventing further delays! Hope you all well
  8. Thanks again everyone you have all been a great support. Today i sent letter as advised, I sent this recorded delivery so they will definately received, giving them 7 days to put money into account. I will let you all know how I get on. Right now onto claim number 2!! Although this one is going to be complicated and a bit more nerve wracking as I am going to attempt to claim all interest on Managed Loan paid over the past year and still am not quite sure where to start - alot of investigating and pulling paperwork to suss out how much of the managed loan was to clear everything up with HSBC and then take percentage and work out interest for this percentage charged and then do a nice little letter to HSBC politely asking for it back!!! Anyone got any further advice on this one I am all ears - up for a challenge now!!!
  9. WAW My AQ Deadline was 4th April - DG did not submit theirs until Friday after receiving order from court ordering AQ within 7 days or struck out! Contact the court and ask them if they hav received AQ and if not what they plan to do next??? You need to keep up contact with both sols and court.....I think however I was particularly lucky maybe that the judge was so quick to act and order the AQ within 7 days am not sure if this is the norm. Keep your chin up and keep on - you will succeed I am positive of that - I would suggest sending nudging letter to DG and contacting court for their next plan of action becuase the AQ has not been submitted. Chin up
  10. WAW There seems to be no set rule on offers they are very random! I am sure you will get one soon. I gave them a call well a few calls and left messages as never spoken to anyone at DG, on Tuesday / Wednesday (cant remember precise) got call from DG returning message to say they have got my paperwork and are dealing with.....this seems to be the point in most cases when an offer comes through. Have you sent gentle nudging letter yet? See Lattie thread on my posts - this wll just say you are still around and awaiting response!! I agree no to harrass them as I did not and they seemed to get on with my claim but they may need gentle prod to let them know you are around and your claim is being dealt with! You will get it I am sure...I have had my confidence restored however I should not be too quick to be cheery and smug as it was only this week I was posting explaining V worried as no offer and no contact from DG - they too had not submitted AQ! St - i read your thread - good plan - I still stand by what I said I am here to support yu so if you need any support at court stage etc I am on hand always! Just cos won this time am staying around I'm afraid !! lol!!! And netty large voddies all round!!! Ooohhh I feel like celebrating however money not in my hands yet!!! Have to stay level (boring)......just one question - Do i copy court in on letter accepting offer etc as drafted by GMMM???
  12. WAW Just received full offer from solicitors today. Began claim 7th jan Unfortunately it appears that with so many claims going through they are stalling time process and those offers are taking longer to come through. I felt the same though and as Netty will inform you was jittery mess for a while wondering if would ever get money and if should have accepted pathetic offer. Am so pleased stuck with it it really is worth it and Netty, Lattie and GMMM are all here to support you they are a great support use them if you need help or advice!

Received Full Offer from DG!!!!!!! :) Today I received letter from DG solicitors with a full and final settlement offer of entire amount of claim totalling - £1721.87 (this includes all court costs) I have written the letter received out below and wanted some advice on how I respond to this and accept their offer without the confidentiality clause etc: 'HSCB i however mindful of the management time and irrecoverable legal costs associated with litigation in the small claims regime. For those commercial reasons alone, and without any admission of liability whatsoever, HSBC is prepared to make an ex gratia payment to you in the sum of £1721.87. That payment is made in full and final settlement of your claims arising from the charges applied to your account in the period referred to above (31 October 2001 - 10 April 2006 - all charges applied at this time) and by accepting this payment you agreed not to make any other claims relating to charges for the period stipulated (well there are no further charges for these dates). HSBC also, reasonably, required your confirmation that you will treat this payment as confidential. If you accept this proposal please sign and return the enclosed copy of this letter to us and we will arrange for a refund to be made to you.' I also received a copy of their completed AQ?? Any advice on how I should move forward with this would be much appreciated. I dont want them to stall any longer so was thinking of putting time scale on receiving payment as I know what they are like?? I will also be making a donation to this wonderful site...you are all great and I intend to continue with other claims especially for Managed Loan and keep in touch regularly with this site for help with this.   16. Thanks Netty I am hoping so I am keeping everything crossed. I have mocked up nudge letter using template but omitting the section for offers as have waited this long now! Just to say here and can they let me know their status on things and will put in post tomorrow. Will let you know if hear anything
  17. Cheers Lattie will get onto that straight away. Just a quick update on situation. Received letter from Worksop County Court today reading the following:- Before District Judge Hudson sitting at Worksop County Court Upon reading the court file It is ordered that Unless the defendant files a completed Allocation Questionnaire within 7 days of service of this order, the Defendant's defence shall be struck out. Dated 10th April 2007 I presume this is good news and means that if they have not filed AQ by next Friday (was advised by court to check again then) then it will be struck out and I have won??? How does this affect actually getting your money out of them and does this slow everything down? Might be jumping gun a little after all they may still file defence in time but just curious? The judge has also made no mention to the draft order for direction....I presume this wont be requested until DG have submitted their AQ? Any thoughts anyone??? Should I be hoping????
  18. Hi St Good to hear your progress....I contacted Worksop court today and the judge has ordered DG submit their AQ within 7 days which I thought was quite on the ball! Maybe they will be the same for you as they seemed to have dealt with this quickly, only submitted AQ on 4th April. Good luck

Right your words of support last night have seemed to have done the trick at bang on 9am this morning received a call from DG sols confirming they have AQ copy and breakdown of charges but thats all they could tell me. Contacted court who confirmed that judge have requested DG submit their AQ within 7 days, so allowing for post this is due to them by end of next week 18th April. Dont know if should now be waiting patiently or still should send nudging letter to DG - seems to be mixed thoughts on threads so any suggestions would be much appreciated. Thanks again Lattie for your help last night it perked me up knowing I have full support on this website thanks again Fingers crossed that offer is winging its way to me!

Thanks Lattie Quick Brief on events: AQ submitted 04/04/07 no offer received from DG sent second lot of breakdown of charges 05/04/07 and copied in court (sent first lot feb 07) am ringing court tomorrow to find out if filed AQ and if not will need help on nudging letter to let them know am still here and not going away, thans Lattie. Courts have already informed me looking at June for court date so hopefully will get resolved before then as business starts picking up end of month (landscapers) and want this resolved before am never at home anymore......as happens every year, I forget what my house, daughter and dog look like from April - Dec! Will update tomorrow after phone call to courts and attempted contact with DG. Enjoy our bath Lattie (sounds like good idea I think I might do the same)
  24. Ok will start working on this. Just getting feeling that missing something here at the moment...is it just me or do I appear to be the only post on here that has not been able to make any contact whatsoever with DG, its really starting to annoy me as I feel that I am missing out on a potential offer or the chance to get them moving on my claim as have tried every number and email going and still no one at DG has ever acknowledged my existence by either telephone, email or any letters from them regarding my claim Am i just being an impatient person and what can I do except for kneel down every time I phone and pray someone will just pick up the bloody phone????
