Right today is the day to do my court bundle, i have all my statements. a shedule of charges, all letters i have sent to HSBC/DG, all the relevant cases etc, anything else i need?

ok well from reading that it seems i should still go ahead and do my court bundle as ihave heard nothing else from the court on this matter. it is good some action is finally being taken but it has not been done in the most desirable way.

Hello everyone, back from my hols now. Got home to find i had a letter from the court giving me a 15 minute court hearing on the 16th October. i now have to do my court bundle, is there any new news on when DG are settling? or as anything else happened while i have been away?

ok ill get him to try that and see what happens. still no news on my case, i send a letter to the court to let them know im on holiday next week so doubt ill hear anything until i get back

i have heard nothing on my case yet. My brother has now got a court date and needs to send off his court pack, he calculated his charges using online banking statements, HSBC have now closed his online bank account so he cant get copies to put in his court pack, HSBC take up to 40 days to send them and he only has 21 days to submit his pack, does anyone know what he can do about this?

im thinking this week is the week i will either get a court date or i will win. either way that makes it a good week.

i have phoned the court today and my letter and evidence to get the case thrown out is now in with the district judge so hopefully i will hear the outcome of this next week. fingers crossed the judge will see that as the best option.

im not sure what to put in the nudge as i have said it all before. i suppose if i phone the court and see whats happening and then do the nudge because something may have happened. doubt it though do you think its ok to say my letter about abuse of process is with the judge and he will be making a decision even if it isnt?

dont have to nudge the landlord, he gave up and gave the money back. i said i was a law student and made some stuff up. im not a law student by the way just a trainee accountant lol

Still nothing, maybe i will phone up again. i am trying to leave my case for a while but i just cant lol i am intent on legal action at the moment, i even threatened to take my girlfriends landlord to court at the weekend as he wouldnt give her deposit back lol

go for it, they are offering you this because they want you to stop. Keep pushing for the full amount and you will get it.

i think i am gonna try to forget about my case for a while or until i hear from either the court or DG because it really starting to stress me out now

i just phoend the court and nothing has been done about my letter yet, my case has been at my local court now for 3 months with no real action being taken by the court. the guy on the phone told me to sit and wait as they dont know how long it will be

are the new charges from a later or earlier date than the ones you have already claimed for?

yeah sounds like it could be best, ill give the court a call today to see if anything has happened. i can believe looking from my prelim i have been going since january and if the judge doesnt allow this (which by judging on the whole allocation questionnaire business i dont think he will) i could be going for at least another couple of months. Still ill be so relieved when i have my money and right now i would rather get it through beating HSBC than a settlement. i feel like the really need to be punished for doing this to people. they are taking our money and then wasting our time while we ask for it back. Sorry everybody rant over lol

sounds like a good plan then. the only thing is i have just sent a pack to get the case thrown out due to abuse of process, do you think i should wait until the judge gives his opinion on this before i try the draft order. im not sure if it will make me look a little despirate

do you know if the judge has accepted you draft directions?

any idea how i go about sending these draft directions or does it need to be done with my court bundle?

can i write to the court asking for disclosure and therefore push my offer from DG forwards as i have heard nothing back about throwing the case out due to abuse of process and really dont think that i will
