this might sound a little stupid but how can i use the t&c's in my case. Are they just to show the charges are not explained indetail when you sign up or to show that they are charged because i have breached the t&c's?

i sent mine around then too, i think mine would be sorted by now if they had sent the AQ off and then we would have a court date. but because they didnt do that think it will still be ages before i get my money back

do you think it has come too far for me to request that the case be thrown out due to abuse of the court system by DG. all the evidence i need is there i have a list of sattled cases and the fact they havent filed their AQ will help that judgement. What do people think?

Some news, i rushed home from work last night (as always) and a letter from my local court was sitting waiting for me. I was hopeful this would be the letter telling me the case was thrown out due to DG not handing in an allocation questionnaire and being over 2 months late to do so. to my annoyance the judge has now given them until the 15th June to file one. why is it the banks are getting prefferential treatment. if it had been me not handing it in im sure it wouldnt go on like this.

Still sitting around waiting lol everyday i rush home from work in anticipation, hoping my settlement or at least some contact will be waiting for me. nothing.

i think everybody gets the same letter from DG, i know i recieved one the same as this. i didnt notice they called them charges before though, well spotted. i sent them a list of charges and said if they need any more info on my account they should contact HSBC as they have the details of my charges in more depth because they placed them on my account.

i have nudged them about that too lol

i have paid the fee. they told me my claim has been 'boxed' which means it will be looked at by a judge between other cases, this means that it could take a while for the judge to get to my case

Castlebest, i have phoned the court and my case has been handed to a district judge to decide what happens from here. obviously because they are so late with their AQ i am guessing there will be no court date. i contacted DG telly them whats going on with the case now but no reply.

does anyone have the phone number for DG? they still havent got back to me after 5 nudges. they have as good as lost the case now as their AQ is nearly two months overdue.

he goes on to say this which could put people minds at rest. "The interests of the consumer will not be damaged if the case is struck out."

It does seem like he has a sound case, just dont think this case has as much bearing on other bank charge cases because of the damages. the story about llyods is driving me nuts, many people have turned up in court and won now due to the banks not showing up. i dont see why the BBC keep bringing this back up.
