  5. Received defence from Yorkshire today. Pretty standard I think, saying charges not unlawful and quoting terms and conditions etc. Only thing is they keep dropping in the sentence "which we will rely on in court". Anyone know if this is the norm.

  7. Hi Boost. Welcome to the club lol I'm claiming against Yorkshire for my friend (13.5K) who like you is a sole trader. Like caro said don't know why they want £10, that's adding insult to injury isn't it! We are currently waiting to hear what there defence is. If it's not to nosey how much you claiming?   8. Update. Had Notice that Acknowledgement of Service Has Been Filed. The Acknowledgement was filed by the Banks solicitors and they are indicating an intention to defend all of the claim. Now preparing my Court Bundle. Lizzy
  9. Hi tifo, I woudn't accept it. 50% is no where near enough. If it was me I would carry on and issue court proceedings. It's not as if you are refusing a reasonable offer. That's just my opinion, you must decide yourself but most of the postings on this site say to rip up the offer cheque up and return it. Let me know what you decide.

  11. Couple of big one's there Emmtay (claims that is!!). I am of course expecting mine to go fast track due to the amount which means disclusure is mandatory so I really can't see them putting a defence in as they will have to tell how they made up these ridiculously high charges in the first place. Your two will probably go that route as well. Will update as soon as I hear anything. Lizzy

  13. Hi Goodison, how you doin. Hope you haven't given up the fight! Just to let you know that we have today submitted the N1 to Warwick County Court for £13.5K naming our local branch in Leamington Spa as the Defendant. My friend and I stood outside the court for half an hour debating whether to take it in or not. Then we thought *** them they didn't think twice about adding the charges. We also sent a letter to Neil McKirdy informing him of the action we had taken. Can't wait for the reply. Keep your chin up. regards Lizzy

  15. Hi Photoman, I like many others have been reading your thread with great interest. I am also claiming on a business account (for a friend) (13K). I was doin ok until I read Booth v Yorkshire Bank, that really threw me and made me very paranoid. However I think Zooman may have come to my rescue. He claimed back charges on a Ltd company account and WON. I think he was very clever because he did not quote any case law, only common law. He has posted the details of his POC in the thread "Business Accounts". I did ask him if he thought I would get away with that for a sole trader and his opinion is that I would. I must say here that he is not offering any legal advice simply stating the route he took. He also suggested a CMC (Case Management Conference) which would speed things up dramatically. I have decided to follow his POC, as it makes things so much simpler, to see what happens. Good Luck with your claim. Lizzy.

  17. Fully understand what you are saying Zoo. We are all responsible for what we put on our own claims. It's just that there is very little in the templates library for Business Claims. Even a rough guide (which I believe is what all the other templates are) would be a big help. Thanx for the POC. Regards Lizzy Have just read the POC.   18. I agree Goodison, that's why I am waiting with baited breath for post from Zooman. When I have received it I am hoping with Zooman's permission to ask the mods to use it as a template for business claimants. Just keep watching the threads, I know you are feeling particularly frustrated at the moment but we will get there in the end. Regards Lizzy.
  19. Hi Goodison, Well everything seems to be geting a bit technical now. Looking at photoman's post in particular the bit in bold ©that there has been a failure to comply with a rule, practice direction or court order. Does this indicate that you did not follow the proper procedure? Is it possible you made an error in some of your paperwork? Not pointing the finger just trying to interprete the statement. Also this bit: (6)If the court strikes out a claimant's statement of case and it considers that the claim is totally without merit – (a)the court's order must record that fact; and........ Does this not mean that they have to give you a proper explanation for the strike out? Sorry I am not much help jst posting my thoughts.

  22. Hi tifo, if they have said they are not paying you don't need to wait the 14 days (same procedure as me). However as I said in my pm to you the legislation for Business Accounts is not the same as a personal account. I sent the LBA template from the library and received the reply as posted in the thread "Business Claims against Yorkshire Bank". I am currently (with the help of people on this site) trying to determine what legislation to quote as this will also be very important when you come to complete the POC part of the court papers. Will update the above thread when I am more certain of facts. Regards Lizzy
