  1. This is now an update. The bank gave the money to the Wheel clampers PARK DIRECT. The signs about "No Ball Playing" was twice as big as the "PRIVATE PROPERTY" signs and notes about wheel clamping. They have stated. I am now writing a second letter stating the Unfair Terms in Consumer Regulations 1999 and will have to threaten legal action. I guess it will be the county court for us.

  3. Thanks for the data. It's given me a few ideas, although they have ignored my letter over their defaulting on my S.A.R. (Subject Access Request). Anyone here put the total amount of debt instead of just the charges? I seem to have paid more in charges through the years compared to my original debt.
  4. Hello Shagtastic, May I ask, how did you word the claim in Moneyclaims online? I haven't sent mine off yet. They have not given me any details about my account pre-2005 (Royal Bank of Scotland account beforehand). THanks
  5. I'm doing the same with MBNA at the moment and may have to do another for Barclays. Could you provide the wording you used for the claim, please. My problem is that MBNA have not provided the whole six years of my account and only when they took over from Royal Bank Of Scotland. Unsure on how to word it in MCOL. THanks.

    Found the moneyclaim online form. Not sure whether it should be via the internet or go to County Court for the N1 forms. Account was with Royal Bank of Scotland until 2005. MBNA have now defaulted on the SAR and gave a credit of £130.00 to Global Arrow/Eversheds. Do I enter in the moneyclaim online form the date from when I started with MBNA or the entirety of my account? Below is one template I found, but since they have not given me any details of my account, do I change it to mean the whole of the debt? As it stands I will be paying the costs of £120.00, until it is claimed back from MBNA.
  8. Vehicle immobilisation is run by private companies and supervised by the sia (Security Industry Authority). One thing I was not aware of, is that they legally cannot put a limit to the amount that wheel clampers can charge. One driver I know got charged: Fixed penalty - £150.00 Release fee - £150.00 Surcharge for paying by credit/debit card 2.8% VAT 17.5% Total £362.37 Calling the council does not help and I have to go through the SIA. I have now advised him to call his bank and dispute the transaction. We shall have to contact the company. thank you for the posts. I shall include them in the letter I am writing.
  9. I'm about to go for my small claims, but not sure how to proceed. Do I go to court or is there a website in order to file a claim? I know that it would cost me £150.00 due to the size of claim, but other than that calling the council was not helpful.
  10. Driving licence or passport. I'm sure if you send it to them, they'll come up with something else.
  11. With the assistance of Battleaxe...thank the gods. I've now decided to go straight into filing an N1 with the county court. Why do they ask for an I.D. when they still send the letters to your address and call you at the same number?
