  1. Hi everyone, Apologies for the length of this, but I’m a little annoyed!! I've got an issue with our house insurer MMA. Around last October, we had water coming into the front bedroom of our house. We called a local builder who informed us, after taking a look that a hip tile had become displaced, probably due to heavy winds and he gave us a quote of around £800 to replace tiles etc and make good the damage. He (builder) took a number of photographs and we duly sent these off as part of our claim for repairs to the roof and bedroom ceiling. MMA eventually sent their assessors out who carried out a street level assessment of the damage to the whole roof (somehow). We received a letter a couple of days later saying the claim was to be rejected because of damage to the fascias and sofits, which they believed lead to the water ingress. Now, there’s no way on this earth that this could possibly be the case, so I complained to the MMA telling them this. I sent them photographs (again) including this time, the sofits and fascias as proof. These photographs plainly showed both sofits and fascias in reasonable condition with the surface areas intact; they are, at least in a condition not to allow the amount of water into the house that we’d experienced. I also asked how a roof assessment could be carried out from street level and without visiting the roof itself or the attic spaces and asked for the inspection report along with the qualifications of the people involved who had made the decision. Nothing was received from MMA of the assessor in this. About 2 months later, we had a second letter from the MMA, this time from their complaints team. They informed us we had no basis for a complaint and that they would uphold their initial decision. This time, they gave the reason for the water ingress as being ‘rotting tile mortar’? I was amazed at this. What had happened to the original assessments of the ‘sofits and fascias’ being the problem? Why had they changed it? How had they come to this new conclusion; there wasn’t a new inspection on our roof. Who had made this new decision. They also noted there had been no ‘stormy’ weather in our area which would have caused the tile to become displaced in this fashion. But, in my original complaint, I proved there was a number of bad weather events by listing 5 Met office warnings of heavy autumn rain and storm force winds of between 60-70mph from October 2009 alone. MMA go to great pains, pointing out to me that insurance should be ‘fair and reasonable’ time and time again in these letters. But, I don’t see MMA being either in this. They just seem to have changed their minds accordingly to whatever suits them and, have, just made stuff up as they went along. Is there any opinion as to what should be done next? The Ombudsmen I guess? How strong would you say my case was based on the above? I honestly feel like we are being shafted good and proper here but am concerned about ‘regulatory’ bodies like the ombudsmen and their motives and integrity in trying to help us as consumers. Very many thanks for the input, and again, I apologise for the length of the post.
  2. Kim (and anyone else who needs them), the FTP site is now available - bit of a system problem...(my boss! ). If you need the t&c's, use the link in my last post and download what you need.
  3. Afternoon everyone, I've been PM'd by so many people about the T&C's I've have, it's been almost impossible to email them around, so I've hosted them on an FTP server for a short time. As it's using my work bandwidth (shhhhh, don't tell my boss;)) , the server will only be available between 7pm and 11pm at night and only for a couple of weeks. Click on the link below with your web-browser to access the 1998 and 2001 t&c's, copy and then paste them to your desktop or any hard-drive location. Fill yer boots! ftp://caguser:caguser1338$@217.40.45.202
  4. Thanks. Same to you. No, I haven't thought about costs yet, and I'm not sure I will at this stage. I'm kind of glad the whole thing is done and dusted - it's seemed like a pretty long road. I'll maybe think more about it after the weekend. Best wishes
  5. Success for me too. Bank settled for full amount
  6. Have a quick glance through this thread here; http://www.consumeractiongroup.co.uk/forum/bank-templates-library/34887-5-money-claim-line.html The wording on Jonni2Bad' first post is the one I used with relevant alterations. It seems some people perfer the N1 since it allows you more room. Once my claim was filed, I send off my schedule of charges to the Northampton court with a covering letter.
  7. Kashie, yeah that's correct. (obviously, you can't add 8% onto the costs though...unfortunately;) Thanks Poppy. I will try
  8. I called the litigaton team via Krysta Campbell's number Krysta Campbell Legal Clerk Barclays Legal: Litigation and Disputes Level 29 One Churchill Place E14 5HP Tel: 020 7116 4753 Fax: 01452 638 359 and asked for the person dealing with my claim. Krysta is indeed very helpful. I then spoke to a nice guy called Dino Papaevripides. After giving him a little background on my claim, he asked for an up to date figure so I sent him my schedule via email, and he sent my settlement letter by return.
  9. Yeah, for the directions hearing. Same as you.
  10. Good news everyone. I received my settlement this morning Stick at it, you'll all get there soon. Thanks to everyone for the help and to the admins and moderators of this site. Donation sent, survery filled in!
  11. Good news everyone.....We did it!! Settlement arrived in the post this morning! Thanks to all who helped me during my claim and to the hard-working folks who admin and moderate this site. Survey completed, and donation duly sent. Now, where did I put that Mothercare book!
  12. Poppy - If you already haven't done so, see Gary's post (number 10) on this thread and follow the links. There are instructions for ordering directions. everybodiesmum, if you've used the spreadsheet, the interest should have been calculated automatically from the date of the 'offence'.
  13. LL, that's really interesting re the dismissal. Please let us know what the judge says. I'll keep my fingers crossed for you.
  14. Nursie, yes, I'm going to send in a letter asking for the (new) draft directions. If anyone needs the T&C's for Barclays accounts to complete their bundles, let me know via PM. I've got PDF versions for 1998 and 2001. Best wishes to you all.
